WITNESSETH, that the party of the first part, in consideration
O of Seventy Nine Thousand and 00/100 ($793000.00) Dollars
lawful money of the United States, paid
Oby the party of the second part, does hereby grant and release
O unto the party of the second part, their heirs and assigns forever
O ALL that certain plot, piece or parcel of land, with the buildings
and improvements thereon erected, situate, lying and being in the
Town of Southold, Suffolk County, State of New York, being a part

Island Estates, Inc. (which portion is hereinafter called the
"Park" ) lying easterly of the following line, viz :

owned by the United States, known as the Fort H.G. Wright Military
Reservation, Mount Prospect Tract, on the shore of Block Island
Sound or the Atlantic Ocean (as said Tract was constituted prior
to the extension thereof by the acquisition of additional lands in
0 condemnation proceedings instituted in 1942) and running thence
northerly following the East boundary of the said tract of land of
the United States (as same was constituted prior to such extension
z thereof) to the southerly line of East End Road (sometimes called
w0 Oriental Avenue) and which point is the northeasterly corner of
said tract of land formerly owned by the United States (as same
W 0 was constituted prior to such extension thereof) , thence crossing
the East End Road and following the same course as the last to
O the shore of West Harbor or Fishers Island Sound;

point" ) in the southeasterly line of the road leading from the
Fishers Island Club House to the easterly end of Fishers Island,

Evans measured along the southeasterly line of said road on a
course south 62 degrees 38 minutes 30 seconds west (said point

the summit of the highest hill east of East Harbor to Fishers
Island) and from said beginning point running south 62 degrees
38 mZnutes 30 seconds west along the southeasterly line of said
road 175 feet to a point; thence running along remaining land of
the grantor south 27 degrees 21 minutes 30 seconds east 108.5 feet
to a point; thence running along remaining land now or formerly
of Fishers Island Estates, Inc. on a line parallel with the south-
easterly line of said road, north 62 degrees 38 minutes 30 seconds
yeast 175 feet; thence running along remaining land now or
formerly of Fishers Island Estates, Inc . north 27 degrees 21 min-
utes 30 seconds west on a line parallel with the second course
108.5 feet to the point or place of beginning; containing 0.43
acres, more or less.
TOGETHER WITH the easement for ingress and egress from
the premises hereby conveyed over and along a private roadway
now or formerly of Fishers Island Estates, Inc. connecting the
premises hereby conveyed with the public highway, granted to
Thomas R. Rudel and Doris T. Rudel, their heirs and assigns, by
a deed dated August 253 1948, between Fishers Island Estates,
Inc. , as grantor, and Thomas R. Rudel and Doris T. Rudel recorded
in the office of the Clerk of Suffolk County, New York, in Liber
2881 of Deeds at page 547 et. seq. , thereafter granted to
Richard Stowers Smith and JosephIne Powell Smith, their heirs and
assigns, by a deed dated July 27, 1972, between Thomas R. Rudel,
as grantor, and Richard Stowers Smith and Josephine Powell Smith
recorded in the office of the Clerk of Suffolk County, New York,
in Liber 7210 at page 563 et. seq., thereafter granted to the
party of the first part, t e r eirs and assigns, by a deed dated
September 2, 1975, between Richard Stowers Smith and Josephine
Powell Smith, as grantors, and Gerald D. _McLellan and Jean M.
McLellan, recorded in the office of the Clerk of Suffolk County,
New York, in Liber 7908 at page 318 et. seq.
The grantor -aerein is the same person as the grantee in
the deed dated September 2, 1975, recorded September 12, 1975, in
Liber 7908 cp 318.
TOGETHER with all right, title and interest, if any, of the
party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises .
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of
the party of the second part forever. SUBJECT, however, to the
covenants, easements and agreements set forth in the aforesaid
deed between Fishers Island Estates, Inc. , as grantor, and
Thomas R. Rudel and Doris T. Rudel dated August 25, 1948, and
recorded in the office of the Clerk of Suffolk County, New York,
in Liber 2881 of Deeds at page 547 et. seq.
