WITNESSETH, that the party of the first part, in consideration of ten dollars paid by the party of the second
part,does hereby remise, release and quitclaim unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingymdoe c. at Fisher ' s Island, Town of Southold, County
of, Suffolk and ,5tate of New York, bounded and described as follows:
Beginning at a locust post in the northeasterly corner of premises
hereinafter described being 5219. 48 feet north of a point which is
997 .82 feet west of another monument marking the United States
Coast and Geodetic Survey Triangulation Station "PROS" : running
thence south 03°59' 40" west, along land now or formerly of
Pierre S. Dupont, 110. 22 feet; thence south 87°34 ' 40" west,
109. 80 feet; thence north 03159 ' 40" east, 106 . 86; thence north
85°51' 40" , 110. 23 feet to the point or place of beginning.
SUBJECT to any state of facts an accurate survey might show,
and to covenants, restrictions, easements, agreements, reservations,
and zoning regulations of record, if any.
TOGETHER with a right of way of ingress and egress to and from
the above described premises over a 10 foot right of way the
center line of said right of way being described as follows:
beginning at a point on the southerly line of Avenue B, said
point being south 78003110" east, 5. 05 feet from the monument
being north 5366 . 65 and west 1096. 93 from the United States
Coast and Geodetic Survey Triangulation Station, and thence
running south 03°59' 40" west, 63 feet; thence south 08° 35 '
east, about 93 feet.
TOGETHER with all right, title and interest, if any, of the party of the first part of,in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part,the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part,in compliance with Section 13 of the Lien Law,hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word"party" shall be construed as if it read "parties"whenever the sense of this indenture so requires.
