East 160. 56 feet to an iron pipe on the Westerly line of Sterling Street, the last
three lines abutting Northwesterly on remaining land of this Grantor; thence.

South 2 degrees 00 minutes 40 seconds West 97. 95 feet to a monument, the last
two lines running along the Westerly line of Sterling Street; thence South 73
degrees 35 minutes 30 seconds West 142. 03 feet to a monument; thence South
68 degrees 43 minutes 00 seconds West 127. 74 feet to the point of beginning.
Containing 0. 95 acres, more or less.
Subject to a right of way for an existing utility line which crosses the premises
near the Northwest corner.Subject to covenants and restrictions contained in Schedule A hereunto annexed
and made a part hereof.
TOGETIIER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
m and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said -premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance Nvith Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

SCHEDULE A ATTACHED TO AND FORMING
A PART OF DEED FROM ALEXANDER L.
ROBINSON, JR. AND ANN L. ROBINSON, HIS
WIFE, TO LANCE ELWELL AND ROBERTA C.
ELWELI., HIS WIFE, DATED APRIL 29, 1974.
This conveyance is made upon the express condition and the parties
of the second part, for themselves, their heirs or assigns do hereby covenant
and agree to and with the parties of the first part, their heirs or assigns as
follows:
1. The parties of the second part shall on or before July 19, 197r t
construct and thereafter maintain a paling or similar fence along the division
line between the premises herein conveyed and the premises adjacent thereto
on the North and owned by the parties of the first part which division line
commences on the East side of Montauk Avenue and then runs North 81 degrees i
21 minutes 48 seconds East 141. 55 feet, said fence to be six (6) feet in height
or the maximum height permitted by the Southold Town Zoning Ordinance, if
such ordinance restricts such fence to a lesser height.
2. No exterior alterations or additions to the dwelling on the
premises conveyed herein shall be permitted without the prior written approval
of the parties of the first part which said approval shall not be unreasonably
withheld.
3. In the event that the parties of the second part desire to sell
the premises conveyed herein, then and in that event, the parties of the first
part shall have the right to purchase the same on the same terms and con-
ditions offered by a bona fide purchaser. The parties of the first part shall
exercise such right of purchase by giving written notice thereof to the parties
of the second part within fourteen (14) days of the receipt of written notice of
such proposed sale sent by the parties of the second part.
4. That these covenants are to run with the land and shall be
binding upon the parties hereto, their heirs and assigns.
