York, hereinafter called the grantor, party of the first part,

paid by the party of the second part, does hereby grant and
release unto the party of the second part, his heirs and as-
( signs forever,
ALL that lot or parcel of land in the Tout of South-'
old, Suffolk County, State of New York, being a part of
t'ro.t portion of Fishers Island belonging to the grantor
(which portion is hereinafter called the "Park") lying
easterly of the following '_ire, viz:
BEGINNING at the souther-sterly corner of land owned
by the United States, known as the Fort H. G. Wright Mili-
tary Reservation, Mount Prospect Tract, on the shore of
Block Island Sound or the Atlantic Ocean (as said Tract
was constituted prior to the extension thereof by the ac-
euisition of additional lands in condemnation proceedings
instituted in 1942) and running thence northerly following
the East bounder
y of the said tract of iand of the United
States (as same was constituted prior to such extension
thereof) to the southerly line of East End Road (sometimes
called Oriental Avenue) and which point is the northeast-
erly corner of said tract of land of the United States (as
same was constituted prior to such extension thereof),
taence crossing the Bast End Road and following the same
course as the lest to the shore of West Harbor or Fishers
I sland Sound;
Said lot or parcel of land being bounded and de-
scribed as follows:
BEGINNING at a point on the Northerly line of a tr-

of land, herein called the Jacobs' Tract, said point of be-
ginning being thirty-seven hundred thirteen and ninety-six
hundredths feet ^ast of a point which is twenty-three hun-
dred eighty-eight and sixteen hundredths feet North of a
stone monument marking the U. S. Coast and Geodetic Survey
Triangulation Station "NIN" (which said "NIN" monument is
located near the Western end of a ridge overlooking the
South shore of Fishers Island and on the highest point be-
tween C'.zocomount e.nd Mount Prospect and lies South forty-
five degrees seventeen minutes and twenty-six seconds East
of North Dumpling ight in Fishers Island Sound); and run-

no seconds Ecst three hundred thirteen and thirty-nine hun-
dredtss feet to a stake; thence North sixty-seven degrees
forty-five minutes and no seconds East one hundred forty-
six and sixty hundredths feet to a stake; thence South
seventy-nine degrees one minute and no seconds East one
hundred eighteen and eighty hunaredths feet to a stake;
thence North sixty-seven degrees fifty-four minutes and no
seconds East ninety and seven hundredths feet to a stake, V

thence South eighty-three degrees thirty-six minutes and
no seconds East sixty-four and thirty-five hundredths feet .
to a stake, which stake is forty-two hundred fourteen and
eighty-two hundredths feet East of a point which is twenty-
seven hundred forty-Pour and eighty-one hundredths feet
north of said "NIN" monument; thence South fifty-nine de-
grees thirty-three minutes and no seconds East seventy and
thirty-seven hundredths feet to a stake; thence South thir-
teen degrees thirty-five minutes and no seconds East two
hundred thirty-six and ninety hundredths feet to the shore
of Block Island Sound; thence with the meanders of said
Sound South forty-six degrees fifty-six minutes and no
seconds West one hundred fifty-two and ninety-six hun-
dredths feet to the most Easterly corner of said Jacobs'
Tract; thence North thirty-two degrees fifty-Pour minutes
and twenty seconds West ninety-seven and fifty-six hun-
dredths feet to a stake; thence South eighty-one degrees
twenty-six minutes and no seconds West four hundred fifty-
seven and fifty-one hundredths feet to the point or place
of beginning; containing three and seventy hundredths
acres, more or less.
TOGETH-M with all the right, title and interest of
the party of the first part in and to all land lying be-
tween the meander line above described and the actual high
water mark and in and to the share of Block Island Sound
in front of and adjoining said premises.
TOGETHER with a non-exclusive easement appurtenant
to the premises hereby conveyed, over a right-of-way,
fifteen feet wide, limited to the purpose of laying and
maintaining an underground pipe-line for water from Tress-
=a Pond to the premises above described, the center line
of said right-of-way being described as follows: Beginnin
at a point which is forty-two hundred fourteen and eighty-
two hundredths feet East of a point which is twenty-seven
hundred forty-four and eighty-one hundredths feet North of
said "NIN" monument, and running thence North forty-five
degrees forty-four minutes and no seconds East one hundred
seventy-five feet to the shore of Treasure Pond; PROVIDED,
HOWEVER, (a) that said water pipe-line shall be used only
to supply the domestic uses for water of the premises here-
by sold and of the Jacobs' Tract; (b) that the grantee and
his heirs and assigns shall pay to grantor or its successor
in interest or assips for the rights and easement hereby
granted the sum of $50 per annum (or if residence buildings
are erected on both this tract and the Jacobs' Tract, $100
per annum), payable in advance on January lst of each year,
commencing the year following the commencement of con-
struction on either tract; (c) that said pipe-line shall be
maintained in good condition at all times by grantee, his
heirs and assigns; (d) that said easement shall terminate
automatically, without notice or further act, in the event
that a water line shall be brought to any boundary line of
the premises hereby conveyed or any boundary line of said
Jacobs' Tract, by grantor or any successor in interest or
assign or any utility company supplying water service; (e)
that the grantorreserves the right, for itself, its suc-
cessors in interest or assigns, or any such utility company,
to relocate said water pipe-line at any time or from time to
tif; (f) that the grantor shall have the right to use,con-
tr 1, raise or lower the waters of Treasure Pond as may from
tiAe to time be found expedient and that the use of water a
all seasons shall be subject to the regulations made by te
grantor at any time or from time to time and that grantorl
