(631) 765-1809•Fax(631)765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF NOVEMBER 9, 2006 ZB File No. 5963—Joseph Polashock Property Location: 570 Third Street, New Suffolk CTM 117-9-21 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 5,318 sq. ft. parcel in an R-40 Zone is improved with a single-family, 1-1/2 story frame dwelling and accessory two story frame garage as shown on the March 26, 2006 survey prepared by Joseph A. Ingegno, Land Surveyor. BASIS OF APPLICATION: Based on the Building Inspector's July 21, 2006 Notice of Disapproval, amended August 31, 2006, citing Code Sections 100-31 (280-13) and 100-33 (280-15), variances are requested concerning an existing accessory building (ref. Building Permit#3839, issued 4/11/68; ZBA File #1074 granted 3/30/67 and ZBA File #3104 granted 4/20/83). The height, design and setback of the existing accessory building do not meet the requirements of the zoning code when the height exceeds 18 feet, the setback is less than three feet from the property line, and structural alterations were built to add heat and plumbing, creating a use that is not permitted in an accessory building. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 26, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to obtain town approvals for a building which exists at one foot from the property line and at a height of 19.5 feet. This property was issued a permit on 4/11/68, to construct an accessory building on the property line, one foot from the property line, based on ZBA appeal #1074. The building never received a Certificate of Occupancy and upon an application to renew the building permit, it was determined that the structure was already built. Page 2—November 9,2006 ZB File No. 5963—Joseph Polashock , CTM No. 117-9-21 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The accessory garage on the owner/applicant's property was approved by the Building Department in 1968 with a rear yard setback of 2' but was actually built with a setback that is 2.5" less than the allowed setback. The garage has been non- conforming and in existence in the neighborhood for more than 30 years and there are no objections from the neighbors. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because the accessory garage was approved by the Building Department in 1968 but there are no existing records of the building permit or inspection reports. 3. The variance granted herein is not substantial. The code-required maximum height for an accessory garage is 18 feet and the owner/applicant's pre-existing non-conforming accessory garage exceeds the code by 1.9 feet (111.5") and the rear yard setback variance that was approved in 1968 by 2.5 inches. 4. The alleged difficulty has been self-created, since the original owner of the subject property built an accessory garage that was approved by the Building Department in 1968 but never obtained a CO and is not conforming to the today's existing code. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage with a certificate of occupancy while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Member Simon, to GRANT the variance as applied for, as shown on the diagram prepared by Mark K. Schwartz, A.I.A. dated 5/25/2006 and shown on the March 28, 2006 survey prepared by Joseph A. Ingegno, amended September 7, 2006, subject to the following Conditions: 1. All plumbing in the accessory garage be removed (laundry room at ground level and upstairs bathroom). 2. All heat in the accessory garage be removed. 3. The accessory garage be used only for storage, and no living space shall be allowed in said structure. 4. The ZBA reserves the right to inspect for conformity with the above ZBA conditions; and an inspection by a ZBA representative is required prior to issuance of a Certificate of Occupancy Page 3—November 9,2006 ZB File No. 5963—Joseph Polashock CTMIA. 117-9-21 with notification by the owner or the Building Inspector in a written memo to the ZBA - when the accessory building has been brought into compliance and ready to be inspected. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. BASIS OF APPLICATION: Building Department's March 21, 2005 Notice of Disapproval, citing Section 100-32 in its denial of an application for a building permit concerning partial reconstruction of the existing upper level (proposed addition/alterations). The reason stated In the disapproval is that the height will be an increase in height, from 2.5 stories to three stories. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 4, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting new construction to alter the existing Observatory (Greenhouse) by replacing the existing Plexiglas around the western and southern exposures with a new wooden roof sloped on an 8:12 pitch, covered in standing seam copper, new window banding. This area covers the existing 13'5" by 13'5" floor area at an elevation 197" above the finished first floor, an existing egress stair, all of which will remain unchanged. The new construction areas will replace the existing roof and window banding, and related materials, without changing the size of the existing floor area or egress stairway, and the areas will continue to be maintained for safe exiting and comprehensive fire-suppression system. 2. The benefit sought cannot be achieved by some method, feasible for the applicants to pursue, other than relief from the level above the second floor area, while maintaining the existing 33+- height to the top of the roof. This is the maximum that this Board will allow. 3. The variance is not self-created. The existing observatory room is in need of repair. 4. No evidence has been submitted to suggest that the grant of the relief requested will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. 5. Grant of the requested relief is the minimum action necessary and adequate to enable applicant to enjoy the benefit for repairs of the existing observatory, while preserving and protecting the character of the neighborhood and the ,health, safety, and welfare of the community. The petitioner is seeking relief from: 19 NYCRR Part 1220, The Residential Code of New York State, Section R317.3, which requires that buildings having a height of three stories be equipped throughout with an automatic sprinkler system installed in accordance with NFPA 13D. [The petitioner requests a building having a height of three stories not throughout with an automatic sprinkler system.] FINDINGS OF FACT 1. The building that is the subject of this was constructed under the provisions of the old State Building Construction Code. In the original building, an observation room of approximately 190 square feet was constructed on a third story. Although not permitted under the old Code, the third story was not identified as a Code violation by the municipality at that time. 2. At this time, the building is to undergo an addition and alterations and the petitioner wishes to reconstruct the observatory in the same configuration and square footage as the original. Upon submission of the plans to the building department,the plans examiner identified the third story as a Code violation. 3. The petitioner proposes to provide at least one new window in the third story observatory that will meet the requirements of Section R310 of the Residential Code of New York State for an emergency escape and rescue opening. The petitioner proposes to install a limited area NFPA 13D sprinkler system which will provide protection to the third story, the stairway down to the first story, and the corridor to the front door leading directly to the exterior. 5. The petitioner proposes to install smoke alarms, interconnected with devices in the rest of the building and monitored by a central station supervisory service. 6. The petitioner proposes that the observatory on the third story will not be used as a sleeping room. 7. The petitioner argues that installing an automatic sprinkler system throughout the entire existing building would result in practical and financial difficulty. 8. The petitioner has proposed that the addition and alterations will meet all other applicable provisions of the Residential Code of New York State. 9. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section R317.3, to permit a building having a height of three stories that is not provided with an automatic sprinkler system throughout, be and is PROPOSED TO BE GRANTED with the following conditions: 1. That at least one window be installed in the third story observatory that will meet the requirements of Section R310 of the Residential Code of New York State for an emergency escape and rescue opening. 2. That a limited area NFPA 13D sprinkler system shall be installed to provide protection to the third story, the stairway down to the first story, and the corridor to the front door leading directly to the exterior. 3.
