Five Road, Milwaukee 11, County of Milwaukee State of Wisconsin, parties of the first part, and FISHERIS fSLAND "SEA WYNDE",IV Ia New York corporation, having its principal office at 120 ^ Broadway (Room 332), New York 5, New York, party of the second part, WITNESSETH, that the parties of the first part, in consideration of One hundred (u100.) Dollars, lawful money of the United States, and other good and valuable consideration paid by the party of the second part, do hereby grant and re- I' lease unto the party of the second part, its successors and , assigns forever, I' ALL those three lots or parcels of land in the Town of Southold, Suffolk County, State of New York, being a part of that portion of Fishers Island formerly belonging to Fishers Island Corporation (which portion now is or formerly was called the "Park") lying easterly of the following line, viz.: BEGINNING at the southeasterly corner of land owned . L by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island Sound or the Atlantic Ocean and running thence northerly following the East boundary of the said land of the United States-to -tne,soutn.erjy line of-East- End Road (sometimes called Oriental Avenue) and which point is the northeasterly corner of land of the United States, thence crossing the East End Road and following the same course as the last to the shore of West Harbor or Fishers Island Sound; Said first lot or parcel of land being bounded and idescribed as follows: BEGINNING at a stone monument set on the Northwest- erly side of a road forty feet wide, said monument being twelve and fifty-one hundredths feet South of a point which is six hundred and thirty-four and sixty-six hun- dredths feet West of another monument marking the U. S. S. Coast and Geodetic Survey Triangulation Sta- tion "East End 2" (which said "East End 2" monument is located on the summit of the highest hill East of East Harbor on Fishers Island, N.Y. and lies South fifty-four minutes West of Latimer Reef Light in Fishers Island Sound) ; and running thence North seventy-one degrees four minutes and twenty seconds East eighty-six and ninety-three hundredths feet to a stake; thence North twenty-three degrees and fourteen minutes East two hun- dred and nine and fifty- six hundredths feet to a stare; thence South fifty-five degrees thirty-six minutes and forty seconds East two hundred and thirty-three and sixty hundredths feet to a stake; thence South eleven de grees thirty-seven minutes and twenty seconds West two hundred and nineteen and thirty-nine hundredths feet to - 4 .I_2 l a stake; thence Porth eighty-nine degrees eight min- utes and forty seconds West two hundred and twr ty-nine and eight hundredths feet to a stake; thence Xorth seventy degrees thirty-six minutes and thirty seconds West eighty-six and twenty hundredths feet to a stake set on the Easterly side of said ro=.d; and thence North- !� wardly, along the Easterly side of said road (and fol- lowing the arc of a curve to the left whose radius is two hundred and seventy-six and ninety-six hundredths feet and the direction of whose radius at that point is North eighty-two degrees six minutes and twenty-six seconds West) , ninety-four and forty-eight hundredths feet to the glace of beginning; containing one and eighty-two hundredths acres, more or less, TOG:= with all easements, rights of way and rights, privileges and appurtenances whatsoever granted to Douglass Van Dyke, one of the parties of the first part here- to by and under deed made by Fishers Islend Corporation d..-.ted June 1, 1927, and duly recorded in the Office of the Clerk of the County of Suffolk on June 20,1927, in Liber 1276 of Deeds page 481; deed made by Fishers Island Corporation dated Oct- ober 17 , 1927 and duly recorded in said Clerkfs Office on October 21, 1927, in Liber 1311 of Deeds pale 596, and the deed made by James Henry Rambo, as Trustee in Bankruptcy of Fishers Island Corporation dated November 27,1942 and duly recorded in said Clerk1s Office on March 19,1943,in Liber 2277 of Deeds, page 325, TOGETEM with the appurtenances and all the estate and rights of the parties of the first part in and to s�.id prenises, TO HAVE ANr TO HOLD the premises herein granted un- to the party of the second part, its successors end assigns forever, SUBJECT, however, as follows: (a) covenants, re- strictions, easements and reservations contained in deeds recorded in said Clerk' s Office in Liber 1276 of Deeds page 481 and. Liber 1311 of Deeds page 596, as continued and ex- tended by agreement recorded in Liber 2437 of Deeds page 468 and said covenants, restrictions, easements and reservations to the extent same shall have been ecuitably imposed upon the prenises hereby conveyed; (b) easements to Fishers Island Electric Corporation and Fishers Island Telephone Corporation recorded in said Clerkts Office in Liber 2135 of Deeds pages 405 and 401 respectively; (c) any state of facts an accurate survey would show; (d) the fact that no warranty of acreage is hereby given; (e) a _nlicable zoning restrictions and ordi- nances, if any; and (f� mortgage for $50,000 and interest made by the party of the second part to Douglass Van Dyke, same being given as part of the purchase consideration of this con- veyance, AND the parties of the first part, in compliance with Section 13 of the Lien Law, hereby covenant that the parties of the first part will receive the consideration for this conveyance and will hold the right to eceive such con- sideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
