3 WITNESSETH, that the party of the first part, in
consideration of One hundred Dollars ({100.), lawful money of
the United States, and other good and valuable consideration
paid by the party of the second part, does hereby grant and
release unto the party of the second part, his heirs and
assigns forever,
ALL that lot or parcel of land in the Town of
Southold, Suffolk County, State of New York, being a parte.
of that portion of Fishers Island belonging to the grantof
(which portion is hereinafter called the "Park") lying

Military Reservation, Mount Prospect Tract, on the shore
of Block Island Sound or the Atl.ntic Ocean (as said I
Tract was constituted prior to the extension thereof by
the acquisition of additional lands in condemnation pro-
ceedings instituted in 1942) and running thence northerly;
following the -East bsundary of the said tract of land of
the United States (as same was constituted prior to such
extension thereof) to the southerly line of East End P.oad
(sometimes called Oriental Avenue) and which point is the,
northeasterly corner of said tract of land of the United
Stites (as same was constituted prior to such extension
thereof), thence crossing the East End Road and following
the same course as the last to the shore of West Harbor
or Fishers Island Sound;
Said lot or parcel of land being bounded and
described as follows:
Beginning at a stone monument set on the Easterly
side of a road forty feet wide, said monument being forty,
seven hundred and fifty-six and ninety-four hundredths
feat North of a point which is one hundred and seventy-
two and nine-hundredths feet West of another monument
marking the U. S. Coast and Geodetic Survey Triangulation]
Station -Nin' (which said "Nin" monument is located near
the Western end of a ridge overlooking the South shore ofj
Fishers Island and on the highest point between Choco- I
mount and Mount Prospect and lies South forty-five de-
grees seventeen minutes and twenty-six seconds East of
North Dumpling Light In Fishers Island Sound); and mon
thence North sixty-nine degrees twenty-two minutes ten
seconds Nest one hundred forty-nine and twenty-five hun-
dredths feet to a stake; thence North twelve degrees one
minute fifty -seconds East one hundred seventy and eighty-
two hundredthsfeet to a stake; thence North seventeen
degrees thirty-one minutes thirty seconds Bast three hum- }
dred eighty-two and seventy-three hundredths feet to a

stone monument on the Southerly side of another road
forty feet wide, said monument being fifty-three hundred
and forty-one and fifty-seven hundredths feet North of a
point which is one hundred and sixty and ninety-two hun-
dredths feet ',est of said monument marking the U, S.
Coast and Geodetic Survey Triangulation Ste.tion "Nin";
thence South sixty-one degrees thirty-three minutes East
fifty six and thirty-six hundredths feet to a stake;
thence Seuthecsterly (following the arc of a curve to the
right whose radius 1s three hundred fourteen and seventy-
three nundredths feet and the direction of whose radius
at that point is South twenty-eight degrees twenty-seven
minutes Nest) two hundred twenty-five and sixty-six
hundredths feet to a stake; thence South twenty degrees
twenty-seven minutes forty seconds East one hundred
seventy-three and sixty-nine hundredths feet to a stake;
thence South eighty-five degrees fifty-one minutes thirty
seconds West one hundred twenty-two and forty-six hun-
dredtns feet to a stake; thence South forty-one degrees
four minutes West ninety-three and eighty-nine bundredths
feet to a stake; thence South twenty-nine degrees three
minutes forty seconds Test one hundred seventy and five
hundredths feet to the place of beginning; containing two
and seventy-nine hundredths acres, more or less.
TOUETRER with an easeuent to the grantee, his heirs
and assigns, for ingress to and egress from the premises
hereby conveyed over and along such private roads as now
or may hereafter exist connecting the premises hereby
conveyed with the public highway; provided, however, the
the grantor hereby reserves the right to cnange the loca-
tion, route or grade of said roads from time to time,
provided that such cnange shall not prevent adequate
access to the premises hereby conveyed.
RESERVING to the grantor, its successors and assign; $
fron the grant of the premises hereby conveyed, an ease-
ment end right of way within a strip of land five feet
wide along thefirst, second, third, fourth, fifth and
sixth courses of the boundaries of said premises for the
erection thereon of poles to support wires for the trans
mission of electricity for light, nest, telephone and
otacr purposes, and for the construction, operation and
maintenance of Ste lines or conduits under the surface
of s.-Ad reservation for any lawful purpose whatsoever,
but the grantor shall h..ve the right to release the pram
Sses 'eereby conreyed from these particular easements and
ri€hts of way; provided, however, that whenever the
surface of the ground shall be disturbed by the grantor,
its successors or assigns, for the purpose of construct-
ing or repairing any such pole line, pipe line or condui ,
it Shull bccome the duty of the grantor or its successor
or assigns, forthwith, at its or their own expense, to
repair and restore the surface of the ground so distur
to substantially the same condition ss snall have exist
before the time of such disturbance.

ever.
PROVIDED, 110VIVhR, that this conveyance is made
subj7 ct to the following covenants and ugreements which are
hereby entered into by the party of the second part for him-
