Box 9398 Riverhead, NY 11901 Re: Approval: Proposed Site Plan for North Fork Sanitation Located at 8475 Cox Lane, Cutchogue SCTM#1000-83.-3-4.7 Zoning District: LI-Light Industrial Dear Ms. Cheshire: The following resolution was adopted at a meeting of the Southold Town Planning Board on January 9, 2012: WHEREAS, this site plan is for a proposed transfer station for construction demolition, scrap metal, damaged cars; dismantling with shipping off site, refrigerators, stoves, wood, aluminum; parking of sanitation trucks, trucks, cars and dumpsters; and WHEREAS, on February 27, 1995, the applicant submitted an application for site plan review; and WHEREAS, on April 10, 1995, the Southold Town Planning Board, pursuant to the State Environmental Quality Review (SEQR), (Article 8), Part 617, declared itself lead agency and issued a Negative Declaration; and WHEREAS, on September 5, 1995, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on September 12, 1995, the Southold Town Planning Board granted Conditional Final Approval on the surveys dated April 13, 1995, conditions to be met: (1) Applicant must comply with recommendation of Cutchogue Fire Department, (2) Applicant must comply with recommendations of the Town Engineering Inspector as to North Fork Sanitation Page Two January 10, 2012 drainage provisions, and (3) Applicant shall fence the property and install a sign at the entrance to indicate hours of operation and types of waste accepted and not accepted at the facility; and WHEREAS, on January 5, 2011, the Southold Town Engineer, Chief Building Inspector and Planning Staff reviewed the expired site plan for Final Approval in connection with the Conditional Final Approval originally granted. The Applicant had satisfied the conditions of the Cutchogue Fire Department and appropriate sign and fence installation; it was determined that additional information regarding drainage provisions was necessary to satisfy the conditions of approval; and WHEREAS, on December 6, 2011, the Southold Town Engineer reviewed the above- referenced application and has determined the project to provide adequate drainage and the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, at a Work Session held on December 12, 2011, the Planning Board found that all applicable requirements of the Site Plan Regulations Article XXIV, §280 — Site Plan Approval of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grants Approval to the site plan entitled " North Fork Recycling", prepared by Sherman Engineering & Consulting, P.C., on September 27, 2011, last revised October 18, 2011, and authorizes the Chairman to endorse the site plan. Please note the following requirements in the Southold Town Code relating to site plans: 1. Any outdoor lighting shall be shielded so the light source is not visible from adjacent properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to contain the light and glare within property boundaries. 2. All storm water run-off from grading, driveways and gravel areas must be contained on site. 3. Approved Site Plans are valid for three years from the date of approval, within which time all proposed work must be completed, unless the Planning Board grants an extension. 4. Any changes from the Approved Site Plan shall require Planning Board approval. 5. Prior to the issuance of a Certificate of Occupancy, the Planning Board must inspect the site to ensure it is in conformity with the Approved Site Plan, and issue a final site inspection approval letter. Should the site be found not in conformance with the Approved Site Plan, no Certificate of Occupancy may be issued unless the Planning Board approves the changes to the plan. Drainage calculations and drainage design meets the minimum requirements of Chapter 236 for stormwater management. 2. The Storm Water Containment Area in the southerly corner of the site has been expanded to provide adequate storage and drainage capacity. 3. Guard rails have been indicated in a location that will outline the shallow recharge basin. These guard rails do not need to be constructed along the perimeter of the site. They are necessary to prevent inadvertent access of equipment and materials into the basin area. 4. This proposed shallow recharge basin would be considered a Recharge basin Type `B" and therefore should be constructed to meet the minimum requirements of Drawing 30-1 found in the Highway Specifications. This drawing specifies a 20' buffer with screen planting that would surround the basin. For this particular site plan,I would not recommend screen planting along the guardrails that separate the working site area from the recharge basin but the Planning Board may wish to consider requiring this buffer and screen planting along the two adjacent property lines. V: Staff Recommendations 1. Accept the recommendation that the guard rail does not need to be constructed along the perimeter of the site (to the SW and SE). It is meant to prevent containers and other site equipment from entering the recharge basin. 2. (2) The permit shall be valid for so long as the Salvage Center is operated by North Fork Sanitation and shall terminate, subject to application for renewal by the new owner. (3) The permittee shall apply for and obtain site plan approval from the Southold Town Planning Board in a timely manner. (4) The permittee shall operate the Salvage Center so as to comply with all laws and regulations. (5) The hours of operation of Salvaging Center related activity shall be 8:00 A.M. to 5:00 P.M. , Monday through Friday, and 8:00 A.M. to 1 :00 P.M. on Saturday. There shall be no Salvage Center operations on Sunday. (6) There shall be no shredding of automobiles on the subject site. There shall be no crushing or pulverizing of concrete or asphalt on the subject site. (7) There shall be a thirty (30) day limit to the on-site retention of all C&D or metal materials. (8) The facility is a Salvage Station and shall not be authorized to receive liquid waste of any kind, except as incidental to cars. (9) No asbestos insulation shall be received, stored or transferred to or from the subject site. 90 (10) There shall be no dismantling of automobiles on the subject site for the purpose of resale, with the exception of removal of batteries and the draining of automobile fluids. There shall be no resale of automobile parts from the subject site. (11) Batteries removed from automobiles shall be stored in an enclosed, leakproof receptacle. (12) All C&D materials stored on the site shall be placed in containers. (13) All automobile fluids shall be drained and securely stored within a covered shed with secondary containment. Drum storage of toxic or hazardous materials as defined by Article 12 of the Suffolk County Sanitary Code shall be limited to no more than 250 gallons on site at any one time, unless a proper Article 12 drum storage facility is applied for and permitted. (14) The facility operator shall establish a contract with a licensed industrial waste scavenger and a waste oil hauler to ensure that liquid chemicals stored on site are removed as necessary and disposed of properly. (15) The facility shall be operated in a manner which will eliminate or control nuisances such as vectors, odors and noise at all times. (16) The facility shall be operated in a manner which will minimize fugitive dust at all times. Yard surface material and need for drainage requirements can be addressed by the Planning Board at the time of site plan review. It is also recommended that a water source be established on site for emergency purposes, and in order to wet excessively dry soils if a stone or shell blend storage yard surface is utilized. (17) The facility operator agrees to allow access to the site and facilities by Town Officials and/or legitimately designated Town representatives for the purpose of ensuring compliance with above conditions. (18) The facility operator shall establish an emergency response plan that will provide procedures for responding to an emergency situation on the subject site. The plan should consider receipt or release of toxic or hazardous materials and asbestos insulation. The plan should consider fire response and provide a notification network and contingencies for dealing with emergency situations that may arise. The plan should be submitted to appropriate authorities, including the Town Board/Town Clerk for dissemination to appropriate Town officials. 9 • (19) The facility operator shall be responsible to obtain all other necessary permits and approvals from other agencies involved in approving the Salvaging Center, the applicant must comply with NYSDEC requirements under Part 360 of the Salvaging Center, as implemented by the NYSDEC for the subject facility. This facility was given preliminary approvals back in 1995 but it was never constructed to meet the minimum requirements of Town Code. Please consider the following: 1. The proposed disturbance resulting from the original construction activities and the hardening of this site requires compliance with Town Code Chapter 236 for Storm Water Management. The Developer has submitted a SW PPP for review but some of the drainage design items need to be further defined. 2. The Storm Water Containment Area must be dimensioned in a manner that can be easily verified after construction. The recharge area must also be protected with guard rails or other protective features from inadvertent encroachment by site operations such as the storage and/or handling of metal containers. 3. The Storm Water Containment Area would be considered a (Recharge Basin Type "B") and therefore must be constructed to meet the minimum requirements of Drawing 30-1 found in the Highway Specifications. (This drawing has been attached) This drawing indicates that there must be a minimum setback of 20' between the property line and the top of berm or high point surrounding the basin. In addition, the maximum design depth would be two feet and storm water drainage channels or access points must be controlled to prevent erosion. The location, size and shape of this proposed shallow recharge basin should be relocated and adjusted accordingly. 4. Drainage calculations have indicated a runoff coefficient of 40% for Stone Blend or compacted areas. The Town of Southold uses a 60% coefficient for all hardened surfaces such as stone blend where surfaces are not entirely solid. These drainage calculations will need to be revised. 5. The Planning Board should require the applicant to furnish copies of there DEC Operating Permits for there records. There may be restrictions or requirements established by the DEC that would be of interest to the Planning Board. (10) There shall be no dismantling of automobiles on the subject site for the purpose of resale, with the exception of removal of batteries and the draining of automobile fluids. There shall be no resale of automobile parts from the subject site. (11) Batteries removed from automobiles shall be stored in an enclosed, leakproof receptacle. (12) All CED materials stored on the site shall be placed in containers. (13) All automobile fluids shall be drained and securely stored within a covered shed with secondary containment. Drum storage of toxic or hazardous materials as defined by Article 12 of the Suffolk County Sanitary Code shall be limited to no more than 250 gallons on site at any one time, unless a proper Article 12 drum storage facility is applied for and permitted. (14) The facility operator shall establish a contract with a licensed industrial waste scavenger and a waste oil hauler to ensure that liquid chemicals stored on site are removed as necessary and disposed of properly. (15) The facility shall be operated in a manner which will eliminate or control nuisances such as vectors, odors and noise at all times. (16) The facility shall be operated in a manner which will minimize fugitive dust at all times. Yard surface material and need for drainage requirements can be addressed by the Planning Board at the time of site plan review. It is also recommended that a water source be established on site for emergency purposes, and in order to wet excessively dry soils if a stone or shell blend storage yard surface is utilized. (17) The facility operator agrees to allow access to the site and facilities by Town Officials and/or legitimately designated Town representatives for the purpose of ensuring compliance with above conditions. (18) The facility operator shall establish an emergency response plan that will provide procedures for responding to an emergency situation on the subject site. The plan should consider receipt or release of toxic or hazardous materials and asbestos insulation. The plan should consider fire response and provide a notification network and contingencies for dealing with emergency situations that may arise. The permittee shall control nuisances such as odor, vector, noise, dust and windblown litter at all times. 7. Reasons Supporting This Determination: Recognizing that the proposed use is compatible with the site, environmental impacts are expected to be minimal, and that mitigation measures are available to minimi�P potential environmental effects, this Conditioned Negative Declaration has been prepared. This determination is issued in full consideration of the criteria for determination of significance contained in 6 NYCRR Part 617.11, the Long Environmental Assessment Form Parts I and II, a supplemental environmental report (Long EAF Part III) and the following specific conditions: (1) The Salvage Center shall be permitted to handle construction and demolition debris (C&D) and scrap metal waste. It shall not be permitted to accept putrescible waste. This permit may be amended from time to time by action of the Town Board. (2) The permit shall be valid for so long as the Salvage Center is operated by North Fork Sanitation and shall terminate, subject to application for renewal by the new owner. (3) The permittee shall apply for and obtain site plan approval from the Southold Town Planning Board in a timely manner. (4) The permittee shall operate the Salvage Center so as to comply with all laws and regulations. (5) The hours of operation of Salvaging Center related activity shall be 8:00 A.M. to 5:00 P.M. , Monday through Friday, and 8:00 A.M. to 1 :00 P.M. on Saturday. There shall be no Salvage Center operations on Sunday. (6) There shall be no shredding of automobiles on the subject site. There shall be no crushing or pulverizing of concrete or asphalt on the subject site. (7) There shall be a thirty (30) day limit to the on-site retention of all C&D or metal materials. (8) The facility is a Salvage Station and shall not be authorized to receive liquid waste of any kind, except as incidental to cars. (9) No asbestos insulation shall be received, stored or transferred to or from the subject site. (10) There shall be no dismantling of automobiles on the subject site for the purpose of resale, with the exception of removal of batteries and the draining of automobile fluids. There shall be no resale of automobile parts from the subject site. (11) Batteries removed from automobiles shall be stored in an enclosed, leakproof receptacle. (12) All C&D materials stored on the site shall be placed in containers. Page 2 of 4 (13) All automobile fluids shall be drained and securely red within a covered shed with secondary containment. Drum storage of toxic or hazardous materials as defined by Article 12 of the Suffolk County Sanitary Code shall be limited to no more than 250 gallons on site at any one time, unless a proper Article 12 drum storage facility is applied for and permitted. (14) The facility operator shall establish a contract with a licensed industrial waste scavenger and a waste oil hauler to ensure that liquid chemicals stored on site are removed as necessary and disposed of properly. (15) The facility shall be operated in a manner which will eliminate or control nuisances such as vectors, odors and noise at all times. (16) The facility shall be operated in a manner which will minimize fugitive dust at all times. Yard surface material and need for drainage requirements can be addressed by the Planning Board at the time of site plan review. It is also recommended that a water source be established on site for emergency purposes, and in order to wet excessively dry soils if a stone or shell blend storage yard surface is utilized. (17) The facility operator agrees to allow access to the site and facilities by Town Officials and/or legitimately designated Town representatives for the purpose of ensuring compliance with above conditions. (18) The facility operator shall establish an emergency response plan that will provide procedures for responding to an emergency situation on the subject site. The plan should consider receipt or release of toxic or hazardous materials and asbestos insulation. The plan should consider fire response and provide a notification network and contingencies for dealing with emergency situations that may arise. The plan should be submitted to appropriate authorities, including the Town Board/Town Clerk for dissemination to appropriate Town officials. (19) The facility operator shall be responsible to obtain all other necessary permits and approvals from other agencies involved in approving the Salvaging Center. The applicant must comply with NYSDEC requirements under Part 360 of the Salvaging Center, as implemented by the NYSDEC for the subject facility. (20) The permit may be revoked by the Town Board, upon notice to permittee, if permittee fails to adhere to the above conditions. The permittee shall onlyy/accept construction and demolition debris and non-putrescible wastes such as tires, furniture, carpeting, appliances, and machinery at the facility, in an amount not to exceed 200 cubic yards per day. 3. The permittee shall not dump any material on the ground. 4. The permittee shall operate the facility from 8:00 A.M. to 6:00 P.K. , Monday through Saturday. An attendant shall be present during all hours of operation. 5. The permittee shall fence the property and install a sign at the entrance, to indicate hours of operation and types of wastes accepted an not accepted at the facility. 6. The permittee shall control nuisances such as odor, vector, noise, dust and windblown litter at all times. 7. The permittee shall notify the NYSDEC Regional Solid. The Town Board of the Town of Southold has granted a permit for a salvage center with conditions to insure all additional required permits be obtained, including NYSDEC requirements under Part 360 of the Salvaging Center, as implemented by the NYSDEC for this facility; thus the proposed action is consistant with Zoning. An Environmental Assessment Form has been submitted and reviewed, and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Design and flow specification, subsurface soil conditions and site plan details will have to be approved by the Suffolk County Department of Health Services (SCDHS). This impact is not considered significant due to the anticipated project compliance with established requirements of the SCSC and the SCDHS and the required relevant permits. There has not been any correspondence received from the New York State Department of Environmental Conservation in the alloted time. (14) The facility operator shall establish a contract with a licensed industrial waste scavenger and a waste oil hauler to ensure that liquid chemicals stored on site are removed as necessary and disposed of properly. (15) The facility shall be operated in a manner which will eliminate or control nuisances such as vectors, odors and noise at all times. (16) The facility shall be operated in a manner which will minimize fugitive dust at all times. Yard surface material and need for drainage requirements can be addressed by the Planning Board at the time of site plan review. It is also recommended that a water source be established on site for emergency purposes, and in order to wet excessively dry soils if a stone or shell blend storage yard surface is utilized. (17) The facility operator agrees to allow access to the site and facilities by Town Officials and/or legitimately designated Town representatives for the purpose of ensuring compliance with above conditions. (18) The facility operator shall establish an emergency response plan that will provide procedures for responding to an emergency situation on the subject site.
