WHEREAS, the applicant proposes to adjust the lot line between Parcel A (SCTM# 1000-22-3-18.7 and Parcel B (SCTM#1000-22-3-18.1) equal in area to 1.1 acres to amend the location of the right-of-way described in a deed recorded in Liber 8717, Page 267, Office of the Suffolk County Clerk; and WHEREAS, the Southold Town Planning Board, acting under the State Environmental Quality Review Act, performed an uncoordinated review of this Unlisted Action and granted a Negative Declaration; and WHEREAS, the Southold Town Planning Board granted sketch plan approval on the plat dated February 5, 2002; and WHEREAS, all the requirements of the Lot Line Regulations of the Town of Southold have been met; be it therefore RESOLVED that the Southold Town Planning Board grant conditional final approval on the plats, dated February 5, 2002, and authorize the Chairman to endorse the final plat subject to fulfillment of the following conditions. These conditions must be met within six (6) months of the resolution: I Cove Beach Estates Lot Line Change — Page Two —4/15/03 1. The filing of new deeds pertaining to the lot line amendment with the Suffolk County Clerk and submittal of the corrected deed to this office. 2. The submittal of 5 paper copies of the plat. You submitted a copy of the State Environmental Quality Review Negative Declaration issued by the Town of Southold Planning Board on October 14, 2003 and a copy of the September 2, 2003 report of the results of the rare,threatened and endangered plant reconnaissance conducted by the Gibney Design Group. You also provided a print of the road and drainage plan for the project which depicts two significant changes in the alignment and design of the access roadway.The new alignment more closely follows the existing roadway on the site and reduces the amount of clearing on Open Space Parcel A and is,therefore, an improvement. However,this design also includes the construction of a large drainage pond on Open Space Parcel B,which contains regulated freshwater wetlands and is supposed to remain undisturbed.The Department of Environmental Conservation will not approve the construction of a pond or any other drainage structures on Open Space Parcel B,because the disturbance is certain to degrade the sensitive freshwater wetlands,which consist of a complex of small, glacial ponds. The stormwater from the access road must be accommodated elsewhere on the site,outside of the two open space parcels. We suggest installing a series of leaching catch basins along the length of the road. Please submit six sets of the road and drainage plan revised to eliminate the proposed drainage pond on Open Space Parcel B and show an acceptable alternate design for the drainage system.Please be certain that the revised set of drawings includes the profile and section drawings for the new road alignment and details for the selected drainage structures. An additional unresolved item involves the stake out of the proposed development on Lot 10. In my May 6, 2003 letter to Thomas WolpeM P.E. of Young&Young Surveyors, I asked for an explanation of what is represented by two stakes numbered 118019" and"8020" we found on lot 10 in addition to the stakes labeled "building envelope" and a drawing of lot 10 which shows the locations of all four stakes.No response has been received to date. Lastly, you were issued the Department's Notice of Complete Application for the project.This notice must be published once during the week of October Z7, 2003 in the Town of Southold's official local newspaper for the East Marion area as described in the instructions included with the notice.
