HomeMy WebLinkAboutL 3319 P 147 Lw9319 w147 THIS INDENTURE, made the 10th day of January one thousand nine hundred and fifty-two, between FISHERS ISLAND ESTATES,INC., a corporation organized under the laws of the State of New York, having its principal office at 14 East 52nd Street, Borough of Manhattan, City of New York 22, New York, party of the first part, and ELBERT W. BURR, residing at No. 116 Roosevelt Avenue, Hasbrouck Heights, New Jersey, party of the second part, WITNESSETH, that the party of the first part, in consideration of One hundred Dollars ($100.) lawful money of the United States of America and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, his heirs and assigns forever, A certain tract of land located at Fishers Island, Town of Southold, Suffolk County, State of New York, bounded and described as follows: BEGINNING at a point in the center of an iron pipe driven in the ground on the Easterly line of a twenty foot right of way leading Northerly from the highway leading to Peninsula Point, so called, said point being the Southwesterly corner of Lot #28 as shown on the plan hereinafter referred to, and thence running North- erly, along the Westerly line of said Lot #28 and a line in continuation thereof, a distance of one hundred seventy-three and seventy hundredths feet, more or less, to the Southerly line of Lot #1, as shown on said plan (passing through another iron pipe on the Easterly line of said twenty foot right of way at a distance of one hundred fifty-three and fifty hundredths feet from the point of beginning); thence in a Northerly direction, on a line parallel with the Westerly line of Lot #1 as shown on said plan and distant ten and eleven hundredth feet Easterly therefrom (measured at right angles to said Westerly line of Lot #1) a distance of 0 n e h u n d r e d f o r t y - s e v e n feet, more or less, to the shore line of 4!est Harbor; thence following the meanders of said shore line in an Easterly direction about o n e h u n d r e d s i x t y - o n feet to the Northeasterly corner of Lot #3 as shown on said plan; thence Southerly along the Easterly line of Lot #3, as shown on said plan and a line in continuation thereof, and along the Easterly line of Lot #26, as shown on said plan, three hundred and sixteen feet, more or less, to a point in the Northerly line of an- other twesty foot right of way said point being the Southeasterly corner of Lot #29, as shown on said plan; thence deflecting ninety degrees to the right and run- ning Westerly along the Southerly line of Lots #26, #27 and #282 as shown on said plan, a distance of one hun- dred fifteen and fifty hundredths feet, more or less, to the point of beginning; containing one and t w o - hundredths acres, more or less. BEING a part of Lot #1 and being Lots #2 and #3 and Lots #26, #27 and #28 and the strip of land twenty feet in width located between a parcel of land compris- ing a part of Lot #1 and Lots #2 and #3 and a parcel of land comprising Lots #26, #27 and #28, as shown on a "Plan of Peninsula at Fishers Island owned by Charles Lm3319 PAA48 2 W. Hedge and Frances G. Thorp, made by Chander & Palmer, Engrs,Norwich, Conn. 1913"1 and flle� in the office of the Clerk of the County cSuffolk on March 11, 1913, File No. 223• TOGETHER with all the right, title and interest, if any, of the party of the first part in and to the shores and land under the waters of Nest Harbor in front of and a%oining saiu promises; RESERVING to the party of the first part, its j successors and assigns, from the grant of the premises hereby conveyed, easements and rights of way within strips of land five feet wide along the first, second, fourth and fifth courses of said premises, for the erection thereon of poles to support wiresfor the transmission of electricity for light, heat, telephone and for other purposes and for the construction, operation and maintenance of pipe lines or conduits under the surface of slid reservation for any lawful purpose whatsoever, but the rnrty of the first _part shall have the right at any time to release the prem- ises above described from these particular ea_Erc,ints and rights of way; provided, however, that whenever the surface of the ground shall be disturbed by the party of the first Dart, its successors or assigns, for the purpose of constructing or repairing any such pole line, pipe line or conduit, it shall become the duty of the party of the first part, its succ-ossors or as- signs, forthwith, at its or their own expense, to repair or restore the surface of the ground so Cis- turbed to substantially the same condition as nha.11 have existed before the time of such disturbance.
