Dowd. 9:15 A.M. - Town Historian Antonia Booth made her Annual Report for 1994 to the Town Board. 9:35 A.M. - Daniel Karpen, Consultant, met with the Board to bring them up to date on the status of the energy conservation program, additional work to be done, requiring change orders, at the Human Resource Center, Police Headquarters, and Town Hall (resolution no. 10). Mr. Karpen also explained the need for the installation of a variable speed controller on the kitchen exhaust fans, and obtaining make-up air from outside the kitchen, at a cost of approximately $5,000. He will obtain estimates and submit for Town Board approval. Other action Mr. Karpen feels should be taken by the Town Board: replace insulation in Town Hall fan coil units, replace rusted pipes in Town Hall basement, replace Town Hall wallpaper, interior painting at Human Resource Center, Police Headquarters, and Town Hall, as well as exterior painting at Police Headquarters. Lastly, Mr. Karpen presented a second phase for the energy conservation program which would be at the Recreation Center and Highway Garage complex, for an estimated overall cost of $100,000. Supervisor Wickham will ask Superintendent of Highways Jacobs, Engineering Inspector James Richter, and Senior Building Inspector Tom Fisher to g'iV~-"h~m a~i" as~s~s-§rnent of the maintenance needs at the Recreatiori Center and Highway Garage complex, 10:30 A.M. - Stephen Jones, Director of the Suffolk County Department of Planning, met with the Town Board to discuss continuing work on the Business Study for Southold Town. Also in attendance: Planning Board Member G. Ritchie Latham, Senior Planner Valerie Scopaz, Planner Melissa Spiro, and Data Control Supervisor Jeanne Ruland. A draft work plan was discUssed, which would obtain current information about the local economy, its structure, strengths and weaknesses, The Suffolk County Department of Planning will analyze the preliminary data collected this past summer, and additional data will be collected and analyzed in accordance with the draft work plan. The County will provide the professional services required at a cost of $1, however, the Town will provide the county with a 486 personal computer with CD-ROM, and possibly a laser printer, which will cost between $5,000 and $6,000. The North Fork Bank has agreed to make a donation to cover the cost of the computer, however, Supervisor Wickham has not received written confirmation of this. Once this is obtained a resolution will be presented to the Town Board to enter into a contract with the Suffolk County Department of Planning for conducting the business study. 11:00 A.M. Solid Waste: In attendance during solid waste discussions was Solid Waste Coordinator James Bunchuck.---Councilwoman Hussie discussed the proposed -.responses to the DEC's comments on the Town's Draft Solid Waste Management Plan. A number of the questions the DEC is asking the. Town to respond to are obsolete. Supervisor Wickham said he wants to respond to the specific questions and go forward, and then fix the draft report to reflect the Town's policies. It' was finally decided that Supervisor Wickham, Councilwoman Hussie, and Solid Waste Coordinator Bunchuck will work on putting the final responses together.---Supervisor Wickham . brought to the 'Board's attention three requests he recently received to waive landfill tipping fees. After discussing various scenarios whereby waivers have been or could be requested, the Board agreed it would be their policy not to waive tipping fees for brush or"debris at the landfill except during the spring and fall clean-up Programs.~-- Town Attorney Dowd submitted a proposal from Dvirka and Bartilucci for the preparation of variances from the Part 360 regulations for closure of the landfill, which was agreeable to the Board, and a resolution (no. 26) was placed on the agenda to accept the proposal. 11:35 A.M. Personnel: Town Board set 4:00 P.M., January 31st to inte,rview police officers and sergeants on the Suffolk County Preferred List.---Set 3:30 P.M., Friday, February 3rd to interview individuals on the Suffolk County List for Ordinance Inspector.---Set 2~00 P.M., January 31st to interview applicants for the part-time Account Clerk position at the Human Resource Center, and 3:40 on January 31st to interview applicants for the Committee on Local Taxes. 11:45 A.M. Planning and Zoning: Town Board reviewed and approved the proposal for an ad ~nd brochure on the Southold Sign Ordinance.---Councilwoman Oliva reported on the receipt of the two $25,000 grants for the Harbor Management Plan and the Local Erosion Management Plan under the Local Waterfront Revitalization Program. 11:55 A.M. - Recess for lunch. 1:45 P.M. - Finance: Town Board discussed with Executive Assistant James McMahon the possible purchase of a parcel of property in the Greenfield subdivision, Southold, which is to be sold by the County at auction. The Town can obtain the parcel for approximately $700. Board agreed to acquire (see resolution no. 27).--- The Board also discussed with Mr. McMahon his memorandum concerning a new parking permit fee at Klipp Park for non-residents. Almost twenty-five years ago funds were provided by the State of New York for improvements at the park. They have been trying for several years to get the town to lower the entrance fee to Klipp Park for non-residents. Mr. McMahon suggests an annual permit for non- residents of $12.00. Town Attorney Dowd will draft a local law to cover this new permit fee in the Code.---ReceiPt of letters from Osprey Dominion Co. and Corey Creek Vineyards asking for refunds of filing fees to the Board of Appeals. The Board of Appeals, aware of the requests, recommended refund of one half of the fee · due~_.to~_the _fact_._the applications were processed right up to a determination (see resolution no.. 28),---Report from Parnel Wickham-Searl, President of The League of Women Voters Riverhead-Southold, on the printing costs for a proposed community directory for Southold Town. A question on costs of $.85 and $.70 per copy was brought u'p. Supervisor Wickham said his office would prepare a mock-up of the brochure for the Board's consideration.---Letter from Receiver of Taxes George Sullivan proposing increased hourly rates for the clerks in his office. Those employees received 4% raises at the January 3rd organizational meeting, and the Board unanimously agreed not to increase the rates further. 2:25 P.M. Board reviewed proposed resolutions for a Conditioned Negative Declaration and a Salvage Center Permit for Roy & Joanne Schelin (see resolutions 29 & 30).---Supervisor updated l~he Board on East End Economic and Environmental Institute meeting; on-going discussions on a Peconic County study; Town Board member for the North Fork Promotion Committee (Councilwoman Oliva or Councilman Lizewski will atten~l); 'and finally, Agricultural District reviews. 2:45 P.M. Supervisor Wickham presented to the Board a proposed floor plan for reorganization of offices at the east end of Town Hall. Numerous Town Hall employees were' present, and a petition was presented to the Board, signed by thirteen employees in Town Hall, stating they are "not in favor of the new floor plans, Whethe~ it be Plan "A" or Plan "E~". We feel that the offices as they are now are more beneficial to the public and to the employees."- Supervisor Wickham said h'e feel-~'his ~l~'r~---(1)'would bring closer integration of the Planning Board, Building Department and Board of Appeals, and (2) provide one-stop-shopping. At the conclusion of the discussion, it was agreed that before taking any further action the Town Board would find out how other Town Halls are laid out. 3:25. P.M. Town Board reviewed resolutions to be voted on at the 4:30 P.M. Regular Meeting. 3 5 6 JANUARY 24, 1995 EXECUTIVE SESSION 3:50 P.M. - On motion of Councilwoman Oliva, seconded by Councilman Townsend, · it was Resolved that the Town Board enter into Executive Session to meet with Chief of Police Droskoski for a discussion on personnel matters. We have today in addition work at the beginning, we have a number of resolutions, and we have two public hearings, one on the Code of Ethics, and one on Bed and Breakfast, They are at 5:00 o'clock. SUPERVISOR WlCKHAM: We have in front of us a group of about thirty resolutions. I think you have the agenda on those resolutions, and this is an opportunity for anyone, who would like to address the Board on any one of these resolutions for up to five minutes. At the end of the resolutions, ~there* witt-an-additional opportunity for anyone in the audience to address the Board on any matter of their interest, and at five o~clock we have the two hearings, that people can also speak to. If there's no one who wants to address the Board on these resolutions before us. (No response.) I turn to the Board, and see if someone would like to begin with the first resolution. 1.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby promotes Karen McLaughlln to the position of Neighborhood Aide for the Human Resource Center, effective immediately, at a salary of $20,620.00 per annum. 1.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewskl, Supervisor Wickham. This resolution was duly ADOPTED. 2.-Moved by Councilwoman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby rescinds resolution no. 5, adopted on January 10, 1995, accepting the resignation of Marie D. Helinski, whereas it is not appropriate for Mrs. Helinski to resign as she is retiring from her position with the Town. 2.._-_Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman' Townsend, Councilwoman Hussie, Councilman Lizewskl, Supervisor Wickham. This resolution was duly ADOPTED. 3.-Moved by Justice Evans, seconded by Supervisor Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby accepts and approves the United States Fidelity and Guaranty Company Maintenance Bond of Bourgeois & Shaw, Inc., in the amount of $61,421.20, guaranteeing the Fishers Island Airport, Elizabeth Field, Runway 7-25 and 12-30 Overlay project is free from defects caused by faulty workmanship and materials for a period of one (1) year, general wear and tear excepted; said Maintenance Bond has been approved as to form and content by the Southold Town Attorney. 3.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 4.-Moved by Councilwoman Hussie, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the refund of $2,000.00 to Peconic Properties Management Corp., which amount is paid in lieu of Park and Playground, and this represents the final ~efund.--(Southold Villas, Section II 16 lots, 15 committed to affordable housing, 1 reserved for family of developer George Weiser. $32,000 was paid to Park & Playground Fund in July, 199~, - 16x$2,000=$32,000. $16,000 for the development of 8 lots was refunded in October, 1993, and $12,000 for the development of 6 lots was refunded in December, 1993. Avey Electric Inc., Lighting, $250, Town Hall Avey Electric Inc., Lighting, $1,190, Human Resource Center, Police Headquarters, and Town Hall. 10.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 11.-Moved by Councilwoman Oliva, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to release the $111,u,50.00 bond ($55,725.00 passbook in the name of Charles Simmons, and $55,725.00 Letter of Credit in the name of- A.E. Nicholas), which represents the guarantee for completion of roads and improvements (including the submersible fire well) which have been installed and accepted, all in accordance with the recommendation of the Southold Town Planning Board and Engineering Inspector James A. - Richter-~ ............ 11.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham, This resolution was duly ADOPTED. 12.-Moved by.Supervisor Wickham, s~conded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission_..to.-Plainview Old Bethpage Road Runners Club to use the following Town Roads for their 1st Annual Long Island Endurance Challenge, on Saturday, May 20, 1995, beginning at 12:00 Noon at Orient Point, provided they file with the Town Clerk a One Million Dollar Certificate of Liability Insurance naming the Town of Southold as an additional insured: Southold Town Beach and Sound View Avenue, Southold, Mill Lane and Peconic Lane, Peconic, New Suffolk Road, New Suffolk Avenue, New Suffolk and Mattituck, and Sound Avenue, Mattituck. 12.- Vote of the Town Board: Ayes: Justice EvanS, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. Moved by Councilman Townsend. seconded by Councilwoman Oliva, WHEREAS, the Town Board of the Town of Southold, on the 15th day of November, 199~, accepted the proposal of Dunn Engineering Associates, at .a cost not to exceed $3,200.00, to prepare a detailed Scope of Services which enumerates the specific work efforts that a consultant will undertake as part of the Southold Transportation Corridor Stud;y; now, therefore, be it RESOLVED that the Town Board hereby authorizes and directs Supervisor Thomas Wickham to execute an agreement between the Town of Southold and Dunn Engineering Associates to accomplish the aforesaid tasks, all in ~acco~da.n.¢e with~_the _approval of the Town Attorney. SUPERVISOR WICKHAM: The Town of Southold anticipates receiving a subs.tantial grant from the State of New York to undertake a comprehensive traffic study, or transportation study in the town. In order to access that money, and get the whole system moving, we need to prepare a so-called scope of services, as to exactly what this study would involve. Dunn Engineering has been engaged for $3,200. The Town would prime the pump in order to get the whole process started in that matter. 13.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor WiCkham. This resolution was duly ADOPTED. 14.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby modifies the General Fund Whole Town 1995 Budget which erroneously appropriated the 1994-95 Records Management Grant for personal services: To: A1t~10.4.500.200 Town Clerk Fees for Services, Non-Employees, Record Preservation Consultants $ 8,316.00 From: ..... A199-0.4;000.000 Contingencies, unspecified $ 8,316.00 $ 6,670.00 Hire contractor for preservation of microfilming and conservation of early 17th century records. $ 1,396.00 Hire Archival Consultant. $ 250.00 Hire Environmental Consultant. 14.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussle, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. 15.-Moved by Councilman Lizewski, seconded by Justice Evans, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes Assessors Robert I. Scott, Jr. and Darline J. Duffy to attend the Association of Towns, at the New York Hilton, New York, N.Y., on February 21 and 22, 1995, and the necessary expenses for registration, travel and meals shall be a legal charge to the'Assessors' 1995 Budget. 15.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Su pervlsor Wickham. Drum storage of toxic or hazardous materials as defined by Article 12 of the Suffolk County Sanitary Code shall be limited to no more than 250 gallons on site at any one time, unless a proper Article 12 drum storage facility rs applied for and permitted. ........ (1.4) The _facility operator shall establish a contract with a licensed industrial waste scavenger and a waste oil hauler to ensure that liquid chemicals stored on site are removed as necessary and disposed of properly. (15) The facility shall be operated in a manner which will eliminate or control nuisances such as vectors, odors and noise at all times. (16) The facility shall be operated in a manner which will minimize fugitive dust at all times. Yard surface material and need for drainage requirements can be addressed by the Planning Board at the time of site plan review. It is also recommended that a water source be established on site for emergency purposes, and in order to wet excessively dry soils if a stone or shell blend storage yard surface is utilized. (17) The facility operator agrees to allow access to the site and facilities by Town Officials and/or legitimately designated Town representatives for the purpose of ensuring compliance with above conditions. (!8) The facility operator shall establish an emergency response plan that will provide procedures for responding to an emergency situation on the subject site. The plan should consider receipt or release of toxic or hazardous materials and asbestos insulation. The plan should consider fire response and provide a notification network and contingencies for dealing with .emergency situations that may arise. The plan should be submitted to appropriate authorities, including the Town Board/Town Clerk for dissemination to appropriate Town offici.als. This salvage center is basically a transfer station to take into account two types of materials. "It's not to directly compete with all of the different recyclable stuff that comes out of our homes, but rather the C&D construction type, and demolition material, and also used car, and metal junk of that kind. Itls not intended to be a junk yard. Mr. Capon? GEORGE CAPON: George Capon, Greenport, but not living in the Village of Greenport. I have three things I'd like to ask the Town Board. One is, what are you going to do with the Police Department? I talked to one of our local Southold Town Police Officers, and since the Town took over 'the Village of Greenport, he told me that he had made over $12,000. in overtime pay.:l think the Town is paying a lot of overtime to our Police Department, which I think, we got to have them on there, and I got one other thing to bring up on this here case. Number two was, I hear, I hope it's not true, ! hope it's not true that the Town is thinking about hiring two of the Village Police Officers, one as a Detective, and one as a Sergeant. I've been hearing for the last six months the Chief of Police in the Town of Southold has said, that he needs Patrolmen. He don't need sergeants. He don't need detectives. He needs patrolmen. He's been hollering for eight patrolmen for 'the ---past -- s[x. - months , way before the Town took over the Village of Greenport. I think right now, that the Town should think about hiring six or seven right off the bat, right now. If they have to go out, and float a bond, or what they have to do. Co through the Civil Service test. You know right now that Village, right now have got six or seven policeman, well-qualified, to take over. If you go out, and hire three, down the road you're going to say, well, we're going to need three more, four more. These here policemen through the village, that might go out and get a job. I know two of them, right now, have been over in Southampton looking for a job. They took a couple of tests. I mean two are gone. The Town will have to go then, and hire two more rookies out of the Police Academy, send them to school. Who will pay for this? The people of Southold Town will pay for it. Right: now, you've got six or seven, that have been laid off from the Village of Oreenport. I think they can be hired. You'll have no schooling, and they will be right in shape to right go on to duty call. ! guess that's about it. Thank you very much. SUPERVISOR WICKHAM: Maybe I could just very briefly respond, and say, that tl~e Board is very cognizant, and I would say, deeply concerned about the overtime implications of our Police Force. We are very much concerned about it, and we're moving towards your final recommendation of hiring more police officers. We've already set times to interview them, and we expect .tO m0~ve_f~o~.w~rd, expeditiously with that. Regarding the rumor of hiring detectives, and sergeants, and what not, there has been no movement in that direction, that I'm aware of. There's a lot of rumors, a lot of talks about it, but there's nothing, that I know of. GEORGE CAPON: I went downstreet yesterday, and I heard it. I was down the post office today, 'SUPERVISOR WICKHAM: I hear a lot of that, too. GEORGE CAPON: Well, one police officer, I should say a police officer's relation, said, well, my relation is going to be hired by Southold Town as detective. I said, oh yeah? How did that come by? I mean, as I said, rumors are floating around, and I think something should be put in the paper about what is going on. .SUPERVISOR WICKHAM: Maybe the newspapers are listening to this. Is there anyone else who would like to address the Town Board on any matter of the~ interest this afternoon? I'd like to say that the New York State Department of State has awarded the Town two $25,000. grants, one for a harbor management plan, and one for an erosion study plan. We are having a meeting of this group, and the Local Waterfront Revitalization Committee on February 2, which is a Thursday at 7:30, and I'm really interested in asking anybody out there, that has any historical knowledge of the erosion, that has taken place in front of their property, whether it be on the Sound, or the Bay, We would muchly appreciate their information at this meeting.
