four hundredths (1017. 94) feet northerly and forty-six
a hundred five and eight tenths (4605. 8) feet westerly of said

Together with a right of way over, upon and across a strip
of land thirty-five (35) feet wide lying next southwesterly

Together also with a right of way ten (10) feet wide extending
from the above described premises to the southerly shore of
the cove or harbor. The easterly line of this right of way
is the second line in the above description, produced northerly,
and the westerly line of said right of way is ten (10) feet
westerly from and parallel to the easterly line.
Together with the appurtenances and all the estate and
rights of the Party of the First Part in and to said premises.
Subject, however, to the right of the Party of the First
Part to use maintain, repair, and replace the pole line now
existing across the above described premises.
PARCEL 2
All that certain plot, piece or parcel of land, containing
0. 06 acres, more or less, situate, lying and being at Fishers
Island, Town of Southold, County of Suffolk, State of New
York, bounded and described as follows :
BEGINNING at a stone monument on the Southwesterly side of a
right of way 35 feet wide leading from the Northwesterly end
of Equestrian Avenue, said monumnet being 974. 30 feet North
of a point which is 4620 . 21 feet West of another monument
marking the U. S. Coast and Geodetic Survey Triangulation
Station "PROS" and thence running South 62026 ' West 50.0
feet, abutting Southeasterly on land of the United States of
American known as Fort Wright; thence North 31°18 ' West 50. 0
feet; thence North 62026' East 50. 0 feet to the Southwesterly
line of said right of way, these two courses abutting Southwester:
and Northwesterly on remaining land of Lila W. Wilmerding;
thence along said right of way line South 31018 ' East 50. 0
feet to the point of beginning.
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said premises.
To have and to hold the premises herein granted unto the
party of the second part, his heirs, executors, administrators
and assigns forever, SUBJECT, however, to the following
restrictive covenants.
The premises herein conveyed are bounded on the southwest
and the northwest by other lands (hereinafter called the
"adjoining lands")presently owned by Lila W. Wilmerding and
occupied by Lila W. Wilmerding and members of her family for
residential purposes. Said premises are conveyed to A. John
Gada for the sole and express purpose of erecting thereon a
private garage. The Grantee (A. John Gada) covenants and
agrees that for so long as the adjoining lands or any part
thereof shall be used for residential purposes, he shall not
build or cause to be built on said premises such garage or

PARCEL THREE l ��
All that tract, or parcel o land, situate on Fishers Island,
in the Town of Southold, County of Suffok and State of New
York, with any buildings or appurtenances thereon located,
bounded and described as follows:
BEGINNING at a point on the Easterly line of the right-of-way
which is an extension of Equestrian Avenue at the Westerly
corner of land of the Grantees, said point being located
1022. 38 feet north of and 4608. 50 feet West of United States
Coast & Geodetic Triangulation Station "PROS" and running from
said point North 31018 ' West thirty-five (35) feet; thence,
running North 420-45' -30" East one hundred, twenty-five and
00/100 (125. 0) feet; thence, North 8°-38 ' -20 ' West ninety-five
(95) feet, more or less, to the shore of the Cove; thence, in
a general Southeasterly direction about seventy-eight (78)
feet to land now or formerly of Martha F. Pendleton; thence,
South 8°-38 '-20" East about forty-eight (48) feet abutting
Easterly on Pendleton land; thence, South 420-45 ' -30" West
one hundred, eight-seven and 73/100 (187. 73) feet to the point
of beginning abutting Southeasterly on land of the Grantees.
TOGETHER with a right-of-way thirty-five (35) feet wide lying
next Southwesterly of and adjoining the first line in this
description.
The premises are sold subject to a ten (10) foot right-of-way
in favor of the Grantees extending from the Grantees present
land to the Cove as described in a previous deed.
These premises are sold with the distinct understanding that
the grantees, their heirs or assigns , will not erect, or
allow to be erected, on said premises any building or structure
more than twenty-five (25) feet in height.
Being and intended to be the same premises conveyed 'by Samuel
A. Salvage to Angelo J. Gada by deed dated August 30th, 1939 , an
recorded in the Suffolk County Clerk' s Office on September 6,
1939 in Liber 2061 of deeds at page 33.
