PROPERTY FACTS/DESCRIPTION: The applicant's 21,279 square foot parcel is improved with an existing two-story frame house with garage and a two bedroom accessory cottage, as shown on September 29, 2004 amended December 10, 2004 survey prepared by John C. Ehlers, Land Surveyor. BASIS OF APPLICATION: Building Department's February 10, 2006 amended March 23, 2006 Notice of Disapproval, citing Section 100-244, in its denial of an application for a building permit to demolish an existing single family dwelling and construct a new single family dwelling. The reason stated by the Building Inspector in the denial is that the'newly constructed single-family dwelling will have a front yard setback of+/-23 feet.' FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 25, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new single family dwelling after demolishing the existing two-story, single-family dwelling, measured at its closest points, 25'6" from the new deck, 23 feet to the circular steps), and 32 feet from the dwelling, to the front yard lot line at South Lagoon Lane. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to reconstruct the present dwelling, rather than to renovate the existing home which would require significant financial expenditures. The proposed setback is from a private right-of-way (presently a grass path and driveway for access), rather than a public road. The right-of-way is accessible by only four owners 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is uniquely shaped, in that it is very narrow (54 feet) along the west side along a dredged canal and with 73.95 feet along East Side Avenue to the east, and 174.22 feet in length along the northerly property line. , Page 2—June 8,2006 • Zt3 File No. 5860—Andrew Lowry/3 East 18th LLC CTM No.99-3-19 3. The variance granted herein is substantial. The setback reduction is the maximum that the Board will grant. 4. The difficulty has been self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a setback in order to construct a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Oliva, and duly carried, to GRANT the variance as applied for, as shown on survey site map dated September 29, 2004 amended 2-15-2006 by John C. Ehlers, Land Surveyor and 5/19/2006 construction diagrams prepared by Peter B. Cooper&Associates. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property is located adjacent to NYSDEC owned land along Mattituck Creek. The parcel and homes on the parcel are all pre-existing nonconforming. The owner can not renovate the existing home without significant financial expenditures, Therefore, the owner has decided to demolish the existing principal house and rebuild it. The setbacks have been made more conforming with regard to the distance to the creek (bulkhead) . The setback to South Lagoon Lane is the maximum practical . The lot tapers along the water, South Lagoon Lane is not a traveled road and only four surrounding parcels have preexisting rights in their deed to enter onto DEC (State Land) . Enclosed is a copy of the acquisition (takings description) and letter from the DEC. Only the 4 owners, Mr. Lowry' s property being one of the four, have right of access onto Lagoon Lane . South Lagoon Lane while legally a right-of-way, is a paper road, severely restricted by vegetation and is limited access . The land is open space and equal to a side yard not a front yard. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The house can not be renovated economically. The new house is designed to enjoy the views to the water. Since Lagoon Lane is part of the DEC open space (State Owned Land) and not a road the side yard setbacks and not front yard setbacks would be more appropriate. The Zoning Code was revised to make accommodations for right-of-ways which are not "streets" , however, because Mr. Lowry' s parcel is one of the listed owners with a legal right of access onto the open space the exception does not apply in this case. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The setback is 25 feet from the deck and 32 feet from the house. The DEC property is inaccessible by car, limited access by deed, • • and used as open space. The balancing test weighs in favor of the variance. 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct a new single family dwelling after demolishing the existing two-story, single-family dwelling, measured at its closest points, 25'6" from the new deck, 23 feet to the circular steps), and 32 feet from the dwelling, to the front yard lot line at South Lagoon Lane. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal - -- inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to reconstruct the present dwelling, rather than to renovate the existing home which would require significant financial expenditures. The proposed setback is from a private right-of-way (presently a grass path and driveway for access), rather than a public road. The right-of-way is accessible by only four owners 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue, other than an ` area variance. The property is uniquely shaped, in that it is very narrow (54 feet) along the west side along a dredged canal and with 73.95 feet along East Side Avenue to the east, and 174.22 feet in length along the northerly property line.
