Hussie, Councilman Joseph L. Townsend, Jr., Councilwoman Ruth D. Oliva, Justice Louisa P. Evans, Town Clerk Judith T. Terry, Town Attorney Laury L. Dowd. 1:30 P.M. The Town Board met to review and finalize the resolutions to be voted on at the 4:30 P.M. Regular Meeting.----Supervisor Wickham then discussed with the Board his proposal for a management analysis of the Southold Town Police Department which he has discussed at length with Chief of Police Droskoski. Supervisor Wickham advised that he would like the Board to consider the appointment of individuals with expertise to carry out the analysis, or perhaps to engage a consultant to carry out the task. A final decision was not reached at this time. 3:30 P.M. - Work Session adjourned. ORGANIZATIONAL' MEETING The Organizational Meeting of the Southold Town Board was held on January 3~ 1995 ,at the Southold Town Hall, Main Road, Southold, New York; Sup.ervisor Wickham opened the meeting at 4:30 P.M., with the Pledge of Allegiance to the Flag. Evans Town Clerk Judith T. Terry Town Attorney Laury L. Dowd SUPERVISOR WICKHAM: The Organizational. Meeting is an opportunity to get ourselves in place as a Board, to make a number of the appointments, and the setting of salaries, and it's interesting, if there's one aspect of .... .Town .goYer_nment that has been consistent over hundreds and hundreds of years here, Eastern Long Island, it's the Organizational Meeting, where dating back even to the 1600's these same kinds of. decisions were made at that time, as are made today. We aren't enacting any other resolutions. They've all been prepared, thanks to our Town Clerk, who's basically got a handle on most of these same resoJutior~s, that we've conducted in previous years with a few minor variations for tl~is year. So, I think we're ready to just start off the first resolution. 32O JANUARY 3, 1995 TOWN CLERK TERRY: The first thing, Tom, is you have two appointments to make. SUPERVISOR WICKHAM: The Supervisor has the opportunity to do a few things, not very many, without the restrictions, and support, and involvement of the Town Board, and it's my pleasure to appoint Ruth Oliva as the Deputy Supervisor of the Town for a term of one year through December 31st of this year. Ruth has been a great help. The first time that I've been involved in Town government were the Deputy Supervisor has been a real presence, and has added a great deal on a day by day basis through the whole year, so it's great pleasure, Ruth. I~- SUPERVISOR'S APPOINTMENT Supervisor Thomas Wickham hereby appoints Ruth D. Ollva as Deputy Supervisor Of the Town of Southold for the term of'January 1, 1995 through December 31, 1995. SUPERVISOR WICKHAM: I'm also pleased to appoint Lauren Grant as a Confidential Secretary to the Supervisor, also, for 1995. I guess you all know Lauren. It' just a tremendous help to have her in the office. Those are the two things, that I can do each year without worrying about all the rest of the Board. 2.- SUPERVISOR~S APPOINTMENT Supervisor Thomas Wickham hereby appoints Lauren Krug Grant as Confidential Secretary to the Supervisor, effective January 1, 1995 through December 31, 1995. 3.-Moved by Supervisor Wickham, seconded by Councilwoman Oliva, WHEREAS, Section 6[~ of the Town Law requires the Town Board to designate, by resolution, banks in the State in which the Supervisor or other officers of the Town shall deposit all moneys coming into their hands by virtue of their office; and .WHEREAS,__the _Town Board may require any bank, so designated, to deposit with such Board bonds or certificates of the United State, of the State of New York, or any county, town, city, village or school district of the State of New York, such security for such funds so deposited, but such bond or certificate shall be subject to the approval of the Town Board and shall be deposited in such place and held under such conditions as the Town Board may determine; now, therefore, be it RESOLVED that the following banks are hereby designated for fiscal year 199/4 as depositories, and the following securities are hereby required as collateral for such cash balances in said banks: Bridgehampton National Bank $1,000,000.00 Fleet Bank $1,000,000.00 North Fork Bank $1,000,000.00 Shawmut Bank $ 100,000.00 (no collateral required) Suffolk County National Bank $5,000,000.00 Suffolk County National Bank $5,000,000.00 (Tax Receiver's Account only) AND BE IT FURTHER RESOLVED that the Town Board hereby authorizes Supervisor Thomas Wickham to execute Collateral Agreements between the Town of Southold and the above designated banks and their Third Party Custodial i. nstitutions, all in accordance with the approval of the Town Attorney; and be it FURTHER RESOLVED that authorization for increase and decrease of s&c~i-rities shall' b~-subject to the approval of the Supervisor. This resolution was duly ADOPTED. ~.-Moved by Councilwoman Hussle, seconded by Supervisor. Wickham, WHEREAS, Section 11 of the General Municipal Law requires that the Town Board may authorize the Supervisor, the chief fiscal officer of the Town, to invest moneys not required for immediate expenditure; now, therefore, be it RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys not required for immediate expenditure in special time deposit accounts, or certificates of deposit issued by a bank or trust company located and authorized to do business in this State, provided, however, that such time deposit accounts or certificates of deposit shall be payable '/~ANUARY 3, 1995 321 within such time as the proceeds shall be needed to meet expenditures for which such moneys were obtained, and provided further that such time deposit 'accour{ts or certificates of deposit be secured in the manner provided in Section 11 of the General Municipal Law. q.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervi_sqr_..W~ickham. This resolution was duly ADOPTED. 5.-Moved by Councilwoman Oliva, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes -the use of a facsimile signature to pay all checks, drafts and other instruments for payment of money drawn upon the accounts of the Town of Southold by .Supervisor Thomas Wickham except those third party checks, drafts or other instruments in amounts in excess of $5,000.00, drawn upon the following banks: Bridgehampton National Bank Fleet Bank North Fork Bank Shawmut Bank Suffolk County National Bank 5.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. Resolution #6, a resolution advancing funds from the General Fund Wl~ole Town Account to Human Resource Programs, when needed for payroll/f~nd operation expenses, is out. .J 7.-Moved by Justice Evans, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Supervisor Thomas Wickham to travel within New York State on Town business, as required throughout the year, and necessary expense for travel, meals and lodging shall be a legal charge to the 1995 Budget. 7.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor. Wickham. This resolution was duly ADOPTED. 8.--Moved by Supervisor Wickham, seconded by Councilwoman Oliva, it was · RESOLVED~ that The Suffolk Times, a newspaper regularly published in the Town of Southold, which has been entered 'as a second class mail matter, be and the same is hereby designated, effective February 1, 1995, as the official newspaper of the Town of Southold, for the publication of all notices, resolutions, ordinances and other matter required to be published. 8.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilwoman Hussie, Supervisor Wickham. No: Councilman Townsend, Councilman Lizewski This resolution was duly ADOPTED. -COUNCILMAN TOWNSEND: A point of explanation, Tom. It's my opinion, that both papers should carry the legals of the town. I know that prior to our election it was just the Mattituck Traveler, and ! took that position then. I think if two papers are published in the town, and have two separate readerships, as in this instance they probably do, I believe they should both ge.t the benefit of the legals, and the people should have the benefit of having legals pub ished in both. It's always been that way, as long as I've been invOlved in local government, and I think it's a tradition I'd like to see maintained. That's why I voted against the single designation. SUPERVISOR WICKHAM: Joe, this is the vote' on the newspaper issue. Do you want to make a comment? COUNCILMAN LIZEWSKI: I feel that if it's to-go through it should be clear ~that, somewhere in writing, that this Board would support the fact that it would be done on an alternating basis, if it did get done that way. Since we're not going to put it in writing, I really don't like it just to left up in the air. If it's going to go.to two newspapers next year, that's probably the way it would belong, but I think that unless it's completely COUNC'ILMAN LIZEWSKI: I f~el that if it's to go through it should be clear that, somewhere in writing, that this Board would support the fact that it would be done on an alternating basis, if it did get done that way. O' Since we're not g lng to put it in writing, I really don't like it just to left-up·in--the--air. If iris going to go to two newspapers next year, that's probably the way it would belong, but I think that unless it's completely clear that the intent is to make sure that it goes on alternating years, I don't want to support it. SUPERVISOR WICKHAM: I think this is a matter where the Board has two rather conflicting objectives. On the one hand, there's a clear understanding of the Board to deal equally with the papers. On the other hand, there's also a wish to save $7,000., or $8,000. by designating just one of them, and as you recall, the budget calls for .lust $7,500. for 1995, and today we wrestled with that question, and have nominated one paper. Two years ago we nominated the other one, the other local papers. 9.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty cash fund is hereby established in the following amounts for the following individuals: Supervisor Thomas Wickham Town Clerk Judith T. Oliva be and hereby is designated to act as the alternate designate, to cast the vote of the ToWn of Southold at the annual meeting of the Association of Towns in the absence of Supervisor Thomas Wickham. 10.: Vbt&- -Of --the'- -T0-wn Board: Ayes: Justice Evans, Councilwoman Ol|va, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wic kham. This resolution was duly ADOPTED. 11 .- Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that those officers and employees of the Town of Southold attending the annual meeting of the Association of Towns of the State of New York be and hereby are allowed to maximum of $600.00 per officer and employees for the actual and necessary expenses for registration, travel, .meals, and lodging incurred while attendin9 said meeting. COUNCILMAN LIZEWSKI: That number, by the way, I don't think will .be reached by any member of this Board. It's just a figure. I don't thi!nk we've done it in many, many years, but it's certainly a top. It's not what is spent by any member. 11 .- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. ; 12.-Moved by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that any-Town official, eleE~ed or appointed, who is required to use his own automobile in the performance of his duty, shall be compensated for travel expenses necessarily and actually incurred in carrying out the duties of his office, at a rate not to exceed 'twenty cents ($.20) per mile. .-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, -Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. This resolution was duly ADOPTED. SUPERVISOR WICKHAM: The next resolution is the resolution which sets the annual salaries of the elected officials of the Town of Southold. Those salaries that are fixed were noticed in your Budget, that was adopted back a month or two ago. They basically call for the same salaries of 1995 compared to 199u, for all elected officials with the exception of the Town Clerk, and the Highway Superintendent, and the Assessors, all of whom have been increased by u,%. The rationale being that those people work full-time. 13.-Vote of the Town Board: Ayes: Justice Evans, Councilman Townsend, Councilwoman Hussie, Supervisor Wickham. · This resolution was duly ADOPTED. 13.-Moved by Supervisor Wickham, seconded by Councilwoman Hussie, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law, that the Town Board fix, from time to time, the salaries of all officers and employees, of the town, whether elected or appointed, and determine when the same shall be.payable, and that the salaries of the members of the Town Board, the elected Town Clerk and the elected Superintendent of Highways shall not be fixed in an amount in excess of the amounts respectively specified in the notice of hearing on the preliminary budget published pursuant to Section 108 of the Town Law; now therefore, be it RESOLVED that the annual salaries of the following elected Town officials shall be as follows, to wit: Supervisor Thomas Wickham ............................ $54,709.00 Councilman Joseph J. This resolution was duly ADOPTED. 15.-Moved by Councilwoman Hussie, seconded by Justice Evans, it was RESOLVED that pursuant to Section 1~2(1-A) of the Highway Law, the SoUthold Town Superintendent of Highways be and he hereby is authorized to purchase equipment, tools, snow plows and other implements and devices without prior approval of the Town Board in an amount not to exceed $1'0,000.00 for any one item during the period from January 1, 1995 through December 31, 1995. 15.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. --This resolution was duly ADOPTED. 16.-Moved by Councilman Lizewski, seconded by Councilwoman Oliva, it was RESOLVED by the Town Board of the Town of Southold that the Commissioner of Public Works be and he hereby is authorized to purchase necessary supplies and equipment, without prior resolution of the Town Board, ~n an amount not to exceed $10,000.00 for any one item during the period from January 1, 1995 through December 31, 1995. 16.- Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussie, Councilman Lizewski, Supervisor Wickham. Oiiva, Lizewski, 18.-Moved by Councilwoman Hussie, seconded by Supervisor Wickham, WHEREAS, Section 22B of the Town Law allows the 'Town Board of any town having more than one Assessor to establish the office of Chairman of the Town Assessors, who, in addition to his regular duties, shall perform such services in connection with assessment and taxation of property for state, county and town purposes as the Board shall direct; now, therefore, be it RESOLVED that Assessor Scott A. This resolution was duly ADOPTED. SUPERVISOR WICKHAM: Resolution #19 deals with the appointment of the Chairman of the Planning Board. As you may know, that position is currently open. We are interviewing candidate for that position in the next week, and we will continue to have the current Chairman carry on in the holdover, capacity.. We're _goincl_ to hold Resolution #19, and take it up after those ~nterweWs, and appointments are made. 20.-Moved by Councilman Townsend, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Section 267(1) of the Town Law, Gerald P. Goehrincjer is hereby designated Chairman of the Southold Town Board of Appeals for the term of January 1, 1995 through December 31, 1995; and be it FURTHER RESOLVED that the Chairman of the Board of Appeals shall be responsible for furnishing to the Town Board a detained monthly report of activities with|n his department; and be it FURTHER RESOLVED that the Chairman of the Southold Town Board of 'AP'i~&als~ gl~ll~'-/~ 'paid a salary of $2,000.00 per annum, in addition to his regular salary, effective January 1, 1995 through December 31, 1995, and the same shall be paid in regular bi-weekly payments. 20.-Vote of the Town Board: Ayes: Justice Evans, Councilwoman Oliva, Councilman Townsend, Councilwoman Hussle, Councilman Lizewski, Supervisor Wickham. I have just a couple of comments I'd like to make to the Board, and I'd like to profess them. by saying, that this is the time of year when there are a lot of these State of the Town, and that kind of message. They sound to me rather pontifical in nature, and I'm not sure that we're in for that today. I don't think there's really a need for it. I do think there's a place for me to outline to the Board the direction that I'd like to see us take in the coming year, and I think it's particularly appropriate, since you can see from our Organizational meeting, we're really following pretty much in the same track, that we did in 1994. The appointments are largely the same. The committees are largely the same. The structure is largely the same. What have we learned in 1994, and where are we going in 1995, are some points that I'd like to leave briefly with the Board this afternoon, and! think the Organizational Meeting is an appropriate time to think about where we've come from, and where we're going. So, in the .-nature .of_/ea¥ing the Board with my ~otions of where we'd llke to go, I'd 332 JANUARY ,3, 1995 ..... .like to_offer_J:hese comments, as a message to the Board. I'd like to begin by reviewing b. riefly 199u,. We began by taking up a number of matters left over frdm the previous year. We concluded that there were no longer benefits to the three year fight over solid waste, and we agreed to a package of practical, detailed measures that deal responsibly with the Townls solid waste. We were ready when Creenport residents decided that we should look after their police protection, and we have done it, so far, at no additional cost to the Town. These are just a few of things that welve done. We looked after the Town's future. We took up ten of the recommendations of the Stewardship Task Force, and we enacted five of them, including new sign, lighting, fast food, winery and B~,B ordinances. We started planning for an improved transportation system, and a TDR program. Most importantly, we moved ahead with open space and farmland initiatives, strongly endorsed by the voters, for additional authority to acquire properties on a voluntary basis. We adopted a budget with a tax increase higher than we wanted, but in the process we instituted new budgetary controls that give this Board the ability to contain spending during the year. From those improvements in our accounting capacity we gained the confidence that tax increases can be capped, as reflected in our recent policy resolution to that effect. These are just some highlights in a busy year. We accomplished actually considerably more that this. I should draw your attention to three features of 199[~, that made much of this possible. First is openness in government. We completed an altogether new 'iSl'0~0seid ~th[ES' code, and we formed new committees, committees on transportation, local taxes, and TDRs to help us address these issues because out time Ps limited, and there is a wealth of expertise available in the Town. This is professional government and it's cost-effective government. It brings new perspectives to help solve Town problems. The second feature is the stronger management of various offices of Town government. Everyone knows that some offices are highly efficient. I believe that all of us on the Board will be judged by how well managed all of Town government is. We do not have the luxury of a Town Manager or a business manager. Some of the towns, Southampton for example, has a business manager as part of the Town structure. We don't have that luxury. It is our first responsibility to see that every office of Town government is productive, it's efficient, it's courteous, in a work, that's it's tightly managed. The third feature of our government is it's connectedness with other municipalities. We ignore the needs of Oreenport Village at our peril. We find ways to unlock open space funds from Suffolk County, if we work hard at it. We take up landfill issues, and possible electric utility issues, jointly with other East End towns not because it=s fashionable, but because these issues are far more likely to prosper to benefit the town, if they are taken up jointly, and doing it jointly is cost-effective. So let me turn now to where I think our priorities are for 1995, and I have listed here just three key items. First, we must recognize that safeguarding the future of the town is of paramount importance. I do not intend the town to slip into suburban sprawl. Difficult decision lie ahead, difficult in part because we cannot be absolutely certaln of the outcomes of the future, but the Board must recognize that there is a high cost in not acting now to preserve the quality of Southold Town. Primarily this means preserving a vigorous agriculture, farms, vineyards, nurseries, and related enterprises, not just for the benefit of of those few families, but because this preservation is so important to the Town's future. We, as a Board, will deal with a number of measures to plan the future of the town in ways that preserve open space, and farmland, while promoting business and residential development in appropriate areas. Much of this will require legislative change, but that will not be enough. We'll continue to press the Board to enforce our ordinances in a fair and equitable manner. Second, we must continue to search for ways to close our landfills that do not break the bank.. The agreement we entered into with the New York State DEC · established a framework and a timetable for closure, a process that could easily cost ten million dollars, a sum equal to total annual taxes. It is absolutely essential that we continue to explore less costly ways to close landfills, while maintaining the cleanliness of groundwater, and I have no doubt that there are ways to do that, that can be done, maintaining that cleanliness in the environmental protection, and yet come in for substantially less cost than in what all of those regulations currently call for.- Thirdly, we will review and budget Town business in 1995 against the mandate we accepted last week, and that mandate is to stop the growth in taxes, in real terms. We can do this mainly by managing Town offices more tightly. It will take more time. The progress will be hard to measure, but .we made a beginning, and we made a commitment. More remains to be done. We now know where the improvements need to be made from this last year. Knowing that,' it's time to act on them decisively, l hope the Board can do ali of this, and more, in the spirit of bipar;tisanship and consensus that characterized our deliberations in 1994, but I should point out that the search for consensus will not deflect my commitment to these objectives. I hope that we can continue to enjoy dealing with each other and with important issues. I hope we can continue to attract people with little previous involvement with Town government to contribute their talents towards solving these problems. That's briefly where I'm coming, and I hope that it will be a continuing enjoyment. As I look back on my last few year, enjoyment, you have to have some fun, and some enjoyment in the business, and I hope we can continue to do that. That's briefly what I have to say.
