Hoffman Property Location: 1275 Ruch Lane (and Wild Cherry Way), Greenport CTM 52-3-14.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further SEQRA steps as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property contains 21,678 square foot of land area and is improved with a single-family, one family residence. BASIS OF APPLICATION: Request for a Variance under Section 100-33 (280-15), based on the Building Inspector's March 22, 2006 Notice of Disapproval, amended March 24, 2006 and June 7, 2006, concerning an accessory garage proposed in a front yard instead of the code-required rear yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant proposes to locate a 20 ft. x 26 ft. one-story accessory garage in a front yard, at a minimum of five (5)feet measured from the most easterly (front) lot line adjacent to Wild Cherry Way and a minimum of 27 feet measured from the southerly (front) lot line adjacent to an unopened 25 ft.wide private road. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Most houses on Ruch Lane have accessory garages and the location of the proposed accessory garage will be in the architectural rear yard of the subject property. Ruch Lane is a private dead end street, and the applicant is the owner of the adjacent unopened right-of-way at the dead end of Ruch Lane, as well as an owner of improved lots to the west and south. The proposed accessory garage will therefore have no impact on other neighbors. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the relief requested. The relief requested is not substantial. The road to the east of the subject property is an unopened portion of Ruch Lane and is fenced off from the dead end. Wild Cherry Way to the North is also fenced, heavily vegetated with brambles and inaccessible from the subject property. The proposed one-story accessory garage is modest with dimensions of 20'x26'. 4. The difficulty has not been self-created but is caused by the shape of the subject property. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Goehringer, and duly carried, to DENY the variance as applied for, and to GRANT alternative relief as noted below, and as shown on the construction diagram (Sheet 2) prepared 6/12/2006 by Samuels & Steelman,Architects, subject to the following conditions: 1. That the accessory garage may be located at a minimum of seven (7)feet from the (north/east) boundary line fronting on Wild Cheery Way, and may be located 27-0.7 ft.from the south/east property boundary adjacent to the unopened right-of-way; and 2. That the garage shall be used as a non-habitable accessory building, and used for storage and garage purposes only, without the installation of plumbing or heating facilities; and 3. That the use of electricity and an automatic garage door open is permitted as requested; and 4. That a water spigot may be added, attached to the outside of the building only; and 5. That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. " Hoffman Appeal Application • BACKGROUND The subject parcel was created as a result of the determination of the Southold Board of Appeals dated October 23, 1969 whereby the northern 6,000 square feet was set off into a separate parcel. The subject parcel (that is, the southern lot n/k/a #14.1) consists of 21,678 square feet and improved by a single family dwelling. The living space in the ranch house is 1,452 square feet and the attached garage is 660 square feet. Applicant wishes to convert the attached garage into habitable space and build a detached garage. The parcel is surrounded on three sides by public or private roads resulting in the parcel having three front yards. On the west is a traveled dead end of Ruch Lane (a private road). The southern boundary of the property adjoins an unopened and untraveled section of Ruch Lane. On the east is Wild Cherry Way which is a public road serving the adjacent subdivision, which does not have access over Ruch Lane. The Building Department denied applicant's request to place a detached garage in the northeast corner of his property ("the triangle") on the grounds that the Code requires that accessory structures or other accessory uses be located in the rear yard. The proposed structure either will be a newly constructed garage or the garage from relocated adjoining lot #13. Applicant requests a variance from the Board approving the proposed location of the garage in the northeast corner of the premises. ANALYSIS 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) Because the neighborhood was originally a colony of summer homes, most of the dwellings and accessory structures on Ruch Lane do not conform to the Town Code. Nonconformity is the norm in the area. (b) The surrounding parcels will not be negatively burdened by the proposed location of the garage. To the south is an unopened right of way, to the east is a public road, and to the west is the dead end of a traveled private road. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because other permissible locations are unreasonable in light of the shape and size of the subject parcel. For example, a garage located in the northwest corner would be near the bedrooms and far from the kitchen and living areas. That location would result in (a) the driveway being outside bedroom windows, and (b) people having to traipse through the existing garden in order to reach the garage. A location to the northwest of the house would mean only that all of the structures would be crammed together in one portion of the property while leaving the triangle barren and unused. 3. The amount of relief requested is not substantial because, if a variance were not granted, the triangle will effectively be sterilized given that no structure (be it a garage, swimming pool, tool shed, etc.) could be placed in that portion of the premises. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the triangle is the logical (and almost only) location for an accessory structure. Moreover, the proposed site for the garage would result in an improvement to the unused triangle. 5. Has the alleged difficulty been self-created? ( ) Yes. Hoffman Appeal Applicati, BACKGROUND The subject parcel was created as a result of the determination of the Southold Board of Appeals dated October 23, 1969 whereby the northern 6,000 square feet was set off into a separate parcel. The subject parcel (that is, the southern lot n/k/a #14.1) consists of 21,678 square feet and improved by a single family dwelling. The living space in the ranch house is 1,452 square feet and the attached garage is 660 square feet. Applicant wishes to convert the attached garage into habitable space and build a detached garage. The parcel is surrounded on three sides by public or private roads resulting in the parcel having three front yards. On the west is a traveled dead end of Ruch Lane (a private road). The southern boundary of the property adjoins an unopened and untraveled section of Ruch Lane. On the east is Wild Cherry Way which is a public road serving the adjacent subdivision, which does not have access over Ruch Lane. The Building Department denied applicant's request to place a detached garage in the northeast corner of his property ("the triangle") on the grounds that the Code requires that accessory structures or other accessory uses be located in the rear yard. The proposed structure either will be a newly constructed garage or the garage from relocated adjoining lot #13. Applicant requests a variance from the Board approving the proposed location of the garage in the northeast corner of the premises. ANALYSIS 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) Because the neighborhood was originally a colony of summer homes, most of the dwellings and accessory structures on Ruch Lane do not conform to the Town Code. Nonconformity is the norm in the area. (b) The surrounding parcels will not be negatively burdened by the proposed location of the garage. To the south is an unopened right of way, to the east is a public road, and to the west is the dead end of a traveled private road. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because other permissible locations are unreasonable in light of the shape and size of the subject parcel. For example, a garage located in the northwest corner would be near the bedrooms and far from the kitchen and living areas. That location would result in (a) the driveway being outside bedroom windows, and (b) people having to traipse through the existing garden in order to reach the garage. A location to the northwest of the house would mean only that all of the structures would be crammed together in one portion of the property while leaving the triangle barren and unused. 3. The amount of relief requested is not substantial because, if a variance were not granted, the triangle will effectively be sterilized given that no structure (be it a garage, swimming pool, tool shed, etc.) could be placed in that portion of the premises. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the triangle is the logical (and almost only) location for an accessory structure. Moreover, the proposed site for the garage would result in an improvement to the unused triangle. 5. Has the alleged difficulty been self-created? ( ) Yes.
