Nineteen hundred and Sixty-nine, between WILLIAM B. MAY, JR.,
and JEANNE A. MAY his wife, both residing at Ardaley Avenue
(nostreet number Irvington, New York, hereinafter called
the Grantors, parties of the first part, and KENT RHODES, re-
siding at 233 South Greely Avenue, Chappaqua, New York, here-
.nafter called the Grantee, party of the second part:
A WITNESSETH, that the parties of the first part, in
r 1�conslderation of One Hundred Dollars ($100.00), lawful money
p of the United States, and other good and valuable considers-
`d tion paid by the party of the second part, do hereby grant
and release unto the party of the second part, his heirs and
assigns forever,
ALL that certain lot or parcel of land at
Fishers Island in the Town of Southold, Suffolk
County, New York, bounded and described as follows:
BEGINNING at a point In the division line
between the property of the Grantors and the lands,
now or formerly of the United States of America,
known as the Communications Antenna Site, adjoining
the property of the Grantors on the southwest, said
Point of Beginning being 31.34 feet North 29 degrees
46 minutes East from a lag screw set at the most
northerly tip of a private road of the Grantors
known as Reservoir Road, said lag screw being 1295.04
feet North of a point which is 5693.40 feet West
of a monument marking the United States Coast and
Geodetic Survey Triangulation Station "Pros", and
from said Point of Beginning (which is also the
southwesterly corner of the parcel hereby described)
running northeasterly on a curve to the right having
a radius of 208.00 feet, the direction of which
radius at that point IS South 60 degrees 14 minutes
East, an arc distance of 87.73 feet to a point;
thence northeasterly on a curve to the left having
a radius of 181.17 feet, the direction of which
radius at that point is North 36 degrees 04 minutes
West, an are distance of 108.49 feet to a point;
thence North 19 degrees 25 minutes East 29.99 feet
to a point, said last three courses being along the
northerly side of the right of way hereafter described;
thence leaving Bald right of way and running the
following four courses along land heretofore conveyed
by Grantors to George K, Conant, Jr. anu Ellen R.
Conant, his wife (1) North 53 degrees 41 minutes
50 seconds West, 87,98 feet to an iron pipe, (2)
North 39 degrees 26 minutes West, 73.64 feet to a
point, (3) North 50 degrees 38 minutes West, 160.46
feet to an iron pipe and (4) North 50 degrees 38
minutes West, 72.0 feet, more or less to the shore
of Fishers Island Sound; thence follog the
meanders of said shoreline in a southwinterly direction.,
176.0 feet, more or less, to a point at the Intersection
of the Southwesterly line of the land of the Grantors
and the shore of Fishers Island Sound; thence South 50
degrees 38 minutes East, 95.0 feet more or less to a
cross in a rock; thence South 50 degrees 38 minutes
East, 82.70 feet to a brass plate which is 1483.03
feet North of a point which is 5767,89 feet West of
said "Pros" monument; thence Southeastwardly on a
curve to the left having a radius of 1;7.10 feet to

a breve plate; thence South 65 degrees 17 minutes
10 seconds East 14.99 feet to the Point of Begin-
ning, said last four courses being along the
division line of Grantors property and the Com-
munication Antenna Site adjoining on the south-
west; said parcel containing 1.59 acres, more or
lees;
TOGETHER with the riparian rights, if any, and th
right, title and interest of the parties of the first part,
'if any, in and to the lands now or formerly under water and
the Shores, beaches and uplands immediately in front of and
adjoining the premises above described;
SUBJECT, HOWEVER, to the rights, if any, of the
United States Government or New York State, to change or
alter the shore line of Fishers Island Sound adjoining the
above tract, to establish harbor, bulkhead or pierhead lines
and to take land now or formerly under water without compen-
sation;
TOGETHER, also, with a non-exclusive easement for
Ingress to and egress from the above described tract over a
Right of Way leading to Reservoir Road, said Right of Way
being bounded and described as follows:
BEGINNING at a point at the most Northerly tip of
a private road of the Grantors known as Reservoir Road, said
point being One thousand two hundred ninety-five and four
hundredths feet North of a point which is Five thousand six
hundred ninety-three and forty hundredths feet West of
said PROS monument; and running thence North 29 degrees 46
minutes East Thirty-one and thirty-four hundredths feet to
a point of curve to the right having a radius of Two hun-
dred and eight feet, the direction of which radius at that
point is South 60 degrees 14 minutes East, said point being
also the point of beginning of the 1.59 acre parcel of land
above described; thence following the are of said curve a
distance of Eighty-seven and seventy-three hundredths feet
to a point of curve to the left having a radius of One hun-
dred eighty-one and Seventeen hundredths feet, the direction
of which radius at that point is North 36 degrees 04 minutes
West; thence following the arc of said curve a distance of
One hundred eight and forty-nine hundredths feet to a point;
thence North 19 degrees 25 minutes East Twenty-nine and
ninety-nine hundredths feet to a point, which point is One
thousand five hundred one and sixty-two hundredths feet North
of a point which is Five Thousand five hundred forty-five and
fifty-six hundredths feet West of said PROS monument; thence
North 19 degrees 25 minutes East One hundred ninety-two and
seventy-one hundredths feet; thence North 39 degrees 24 min-
utes 10 seconds West Thirty-two and fifty-eight hundredths
feet to a point; thence North 43 degrees 02 minutes East One
hundred feet to a point on the Northeasterly line of the land
of the Grantors; thence along said Northeasterly line South
46 degrees 58 minutes East Thirty-five feet to a monument;
thence continuing along said Northeasterly line South 35
degrees 24 minutes East Sixty-six feet to a point; thence
leaving said Northeasterly line South 43 degrees 02 minutes
West One hundred feet to a point; thence North 39 degrees
24 minutes 10 seconds West Nine and fifty-one hundredths
feet to a point; thence South 19 degrees 25 minutes West
One hundred ninety-two and forty-eight hundredths feet to a

which radius at that point is North 70 degrees 35 minutes
West; thence following the aro of said curve a distance of
One hundred thirty-eight and forty-three hundredths feet
to monument, being One thousand three hundred forty-six
and seventy-one hundredths feet North of a point which 1s
Five thousand five hundred ninety and thirty hundredths feet
West of said PROS monument; thence following the aro of a
curve to the left having a radius of One hundred fifty-eight
feet, the direction of which radius at that point Se South
36 degrees 04 minutes Hast, a distance of Sixty-six and sixty
four hundredths feet; thence South 29 degrees 46 minutes
Went thirty-one and thirty-four hundredths feet to a point
of curve to the left having a radius of One hundred fifty-
seven and fifty hundredths feet, the direction of which
radius at that point to South 60 degrees 14 minutes Best;
thence following the arc of said curve a distance of Forty-
seven and ninety-one hundredths feet to a point 1n the and
line of Reservoir Road; and thence along said end line of
Reservoir Road North 20 degrees 44 minutes West Seventy-four
and seventeen hundredths feet to the point of beginning.
TOGETHER, also, with a non-exclusive easement for
ingress to and egress from said right of way over the private
road of the Grantors known as Reservoir Road, extending from
the Southerly line of the above described Right of Way to
Winthrop Drive;
SUCH EASEMENTS in said right of way and in Reservoir
Road to constibute appurtenances only of the premises hereby
sold and to be limited until such time as said right of way
or said Reservoir Road, as the case may be, shall be dedi-
cated to public road or highway purposes and accepted by a
Town or Village or other public authority for such purposes.
RESERVING, however, unto the Grantor for the benefit
of the remaining property of Grantor and each and every part
thereof, a perpetual easement and right of way ten feet in
width, over, through and across the 1.59 acre parcel of land,
above described, from the southeasterly line of said parcel
to the waters of Fishers Island Sound at the northwesterly
boundary of said parcel, which easement and right of way
shall be located either contiguous with the southwesterly
boundary line of said parcel, in which case such southwest-
erly line shall be the southwesterly boundary of said ease-
ment, or contiguous with the the northeasterly boundary line
of said parcel, in which case such northeasterly line shall
be the northeasterly boundary of said easement, which ease-
ment and right of way shall be for the purpose of providing
said remaining property of Grantor and each and every part
thereof with access by foot or bicycle, to and from said
waters of Fishers Island Sound and to and from the beach
lying at the end of said easement and right of way. The
Grantee may by written instrument recorded in the Office of
the Clerk of the County of Suffolk within one year from the
date of this instrument, permanently fix the location of said
easement at one of the alternative locations above specified.
In the event that Grantee shall fail to make the designation
aforesaid (and during any period after the date hereof and
before the making of such designation or the expiration of
one year from the date hereof, whichever first occurs) the lo-
cation of said easement shall be deemed for all purposes and
for all time to be located along the southwesterly boundary
line of said parcel.
TO HAVE AND TO HOLD the premises hereby conveyed
unto the Grantee his heirs legal reresentalves and assigns,
