GERRY, now residing at 3825 Miremr Avenue, Dallas, Tema Party of the second part WITNESSETH, that the party of the first part, in conelderation of TEN AND M/100 (110.00) dollars, lawful money of the'United States, and other good and valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land with buildings and improvements thereon erected, situate, lying and being in the Town of Southold, CountyF Suffolk, State of New York, being a part of that portion of Fishers Island (hereinafter called the "park"), lying easterly of the following line, viz.: BEGINNCNG at the southeasterly corner of land now or formerly owned by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island Sound, or the Atlantic A Ocean, and running thence Northerly following the East Boundary of the 4f' said land now or formerly of the United States to the southerly line of East End Road (sometimes called Oriental Avenue) and which point is the e northeasterly comer of land now or formerly of the United States, thence crossing the East End Road and following the same course as the last, to the shore of West Harbor, or Fishers Island'Sound; N Said lot or parcel of land being bounded and described as follows: d BEGINNING at a stone monument set on the westerly side of a road 40 feet wide, said monument being 203.85 feet South of a point which is 3193.60 feet West of another monument marking the U. S. Coast and Geodetic Survey Triangulation Station "CHOCOMOUNT 2", (which said "CHOCOMOUNT 2" monument is.located on the summit of the highest hill on Fishers Island, N.Y., about two and one-quarter miles West of the Eastern end of Fishers Island, and lies South 79 degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island Sound); running thence southerly along the westerly side of said road (following the are of a curve to the left whose reebis is 174.25 feet and the di- rection of whose radius at that point is South 58 degrees 05 minutes and 30 seconds Est), 122.81 feet to a stake; running thence, still along the westerly side of said road, South 8 de- grees 28 minutes 30 seconds East, 13.68 feet to a stake marking a point of curve to the right whose radius is 68.66 feet and the direction of whose radius at that point is South 81 degrees 31 minutes and 30 seconds West; running thence southwardly, still along the westerly side of said road (and following the are of said curve) 158.31 feet to a stake set at its intersection with the northerly side of another road 40 feet wide; running thence westwardly along the northerly side of said road (followin the arc of a curve to the left whose radius is 221.05 feet and the direct- ion of whose radius at that point is South 33 degrees 37 minutes 50 secon s West) 239.85 feet to a stake; running thence, still along the northerly side of said road, South 61 degrees 27 minutes 40 seconds West, 67 feet to a stake marking a point of curve to the right whose radius is 34.67 feet and the direction of whose radius at that point is North 28 degrees 32 minutes 20 seconds West; LPIER IIJ'�� rc5v PAGE 2 running thence westwardly (following the arc of said curve) 48.30 feet to a stake; running thence northwardly (following the arc of a curve to the right whose radius is 104.99 feet and the direction of whose radius at that point is North 51 degrees 16 minutes 40 second East) 77.79 feet to a stake; running thence North 03 degrees 43 minutes 50 seconds East, 161.60 feet to the shore of Fishers Island Sound; running thence, with the meanders of said Sound, North 55 degrees 05 minutes 40 seconds East, 71.74 feet, North 69 degrees 07 minutes 50 seconds Fast, 171.23 feet and North 21 degrees 11 minutes 50 seconds Fast, 100.67 feet to a stake, and; running thence South 44 degrees 44 minutes 10 seconds East, 306.85 feet to the place of begioningo containing 3.06 acres, more or less. SUBJECT HOWEVER TO THE FOLLOWING RESERVATIONS AND RESTRICTIONS Imposed by Fishers Island Corporation in a certain deed to Alfred L. Ferguson, dated the 14th day of December, 19279 and recorded in Suffolk County Clerk's office in liber 1412 of deeds at page 5009 on the 28th day of February, 1929, and in which references to the grantor are references to Fishers Island Corporation, not to the Grantor herein: RESERVING to the grantor herein from the grant of the land and premises hereby convenyed easements and rights of way within a strip of land five feet wide along the first six courses of the boundaries of said premises as above described for the erection thereon of poles to support wires for the transmission of electricity for light, heat, telephone and other pur- poses, and for the construction, operation and maintenance of pipe lines or conduits under the surface of said reservation for any lawful purpose whatsoeverg but the grantor shall have the right to release the premises above described from these particular easements and rights of way; PROVIDED, HOWEVER, that whenever the surface of the ground shall be dis- turbed by the grantor, its successors or assigns, for the purpose of constructipg or repairing any such pole line, pipe line or conduit, it shall become the duty of the grantor, its successors or assigns, foryh- ihehgraoundits so disturbedwtoes bstantially the samerestore condition asushall face of have existed before the time of such disturbance.
