HomeMy WebLinkAboutL 6083 P 264 Lw'LM83 P44ACZA LL&I.R.S.X6,5 THIS INDENTURE, made the 7th day of December, 1966, BETWEEN FISHERS ISLAND ESTATES, INC,, a New York corporation having its principal office at 14 East 52nd Street, New York n 21, New York, party of the first part, and FISHERS ISLAND s WATER WORKS CORPORATION, a New York corporation having its principal office at 1 Chase Manhattan Plaza, New York 5, New York, party of the second part, WITNESSETH: That the party of the first part, in consideration of Ten Dollars, lawful money of the United States, and other good and valuable consideration, paid by the party of the second part, does hereby grant and release unto the party of the second part, its successors and assigns forever, ALL those certain pieces or parcels of land, togethe with the buildings and improvements thereon, herein- after described under Item One hereof and all those certain easements and rights of way in land hereinafter described under Item Two hereof, all said lands being situate in the Town of Southold, County of Suffolk, State of New York, and being a part of that portion of Fishers Island (which portion is hereinafter called the "Park"), lying Easterly of the following line, viz,: BEGINNING at the southeasterly corner of land now or formerly owned by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect Tract, on the shore of Block Island Sound or the Atlantic Ocean (as said Tract was constituted prior to the extension thereof by the acquisition of addi- tional lands in condemnation proceedings instituted in 1942) and running thence northerly following the East boundary of the said tract of land now or formerly of the United States (as same was constituted prior to such extension thereof) to the southerly line of Fast End Road (sometimes called Oriental Avenue) and which point is the northeasterly corner of said tract of land now or formerly of the United States (as same was constituted prior to such extension thereof), thence crossing the East End Road and following the same course as the last to the shore of West Harbor or Fishers Island Sound; ITEM ONE ALL those certain pieces or parcels of land, togethe with the buildings and improvements thereon, described as follows: LI EP 00.3 aACF#L} c 2 Parcel A ALL the lands under the waters of Barlow Pond, bounds by the respective shore linea thereof, together with the waters thereof. Parcel B ALL that certain piece or parcel of land, together with the buildings and improvement: thereon, bounded and described as follows: BEGINNING at a point on the Westerly line of a privat road of the grantor, which point is one thousand four hun- dred seventy-one and thirty-five hundredths feet North of a point which is one hundred nineteen and fourteen hun- dredths feet East of a monument markin§ the U.S. Coast an Geodetic Survey Triangulation Station NIN" (which said NIN" monument is located near the Western end of a ridge overlooking the South shore of Fishers Island and on the highest point between Chocomount and Mount Prospect and lies South 45 degrees 17 minutes 26 seconds East of North Dumpling Light in Fishers Island Sound); and running thence Northerly on a curve to the left with a radius of one hundred thirty-six and thirty-eight hundredthe feet a distance measured along the are of thirty-nine and sixty- one hundredths feet to a point; thence North 14 degrees 24 minutes 40 seconds West two hundred thirty-eight and four hundredths feet to a point; thence Northerly on a curve to the right with a radius of four hundred ninety-nine and four hundredths feet a distance measured along the are of three hundred thirty-two and forty-three hundredths feet; thence North 23 degrees 45 minutes 20 seconds East one hun dred fifteen and forty-six hundredths feet to a point- thence Northerly on a curve to the left with a radius of one thousand one hundred eighty-two and thirty-three hun- dredths feet, a distance measured along the are of two bun dred eighty-two and sixty-six hundredths feet to a point. thence North 10 degrees 03 minutes 30 see ends East twenty- two and fourteen hundredths feet to a point; thence North- erly on a curve to the right with a radius of one hundred ninety-three and nineteen hundredths feet a distance mea- sured along the are of about thirty feet, the last seven courses following along the Westerly line of said private road of the grantor; thence North 81 degrees 28 minutes 00 seconds West about eighty-one and seven tenths feet; thenc North 43 degrees 34 minutes 00 seconds West fifty-six and fifty-nine hundredths feet; thence North 24 degrees 22 minutes 40 seconds West ninety-seven and five hundredths feet to a point, the last three courses bounding North- easterly on a parcel of land conveyed by Fishers Island Corporation to Albert G. Davis by deed dated January 30, 1933, recorded in the Office of the Clerk of Suffolk County on February , 1933 in Liber 1696 of Deeds, page 357; thence South 13degrees 00 minutes 40 seconds Went one hundred twenty feet more or less to the shore of Barlow Pond; thence generally Southerly along the Easterly shore of said Barlow-s Pond about nine hundred thirty feet thence South 54 degrees 00 minutes 00 seconds East about one hundred ninety feet; thence South 78 degrees3p minute 00 seconds East one hundred thirty and no hundredths feet to the Point of beginning; containing four and eighteen hundredths acres, more or less. - 3 - I ------------ - Parcel C ALL the lands under the waters of Middle Farms Pond, bounded by the respective shore lines thereof, together with the waters thereof; TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed twenty feet in width connecting the Easterly portion of Middle Farms Pond with the private road of the party of the first part which lies a short distance to the East of Middle Farms Pond, said easement to be limited to the purposes of access to and from Middle Fame Pond from and to said private road and for the construction, maintenance, repair, use and removal of underground j pipe lines or conduits for the supply or distribution or use of water and equipment and accessories connected therewith; and TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed twenty feet in width connecting the South- easterly portion of Middle Farms Pond with the Northwesterly portion of Treasure Pond, said ease- ment to be limited to the purposes of access to and from Middle Farms Pond from and to Treasure Pond and of the construction, maintenance, repair, use and removal of underground pipe lines, or conduits for the supply or transmission or use of water and equipment and accessories connected therewith. Parcel D AIL the lands under the waters of Treasure Pond, bounded by the respective shore lines thereof, together with the waters thereof; TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed twenty feet in width connecting Treasure Pond with the nearest private road of the party of the first part, said easement to be limited to the purposes of access to and from Treasure Pond from and to said private road and for the construction, maintenance, repair, use and removal of underground pipe lines or conduits for the supply or trans- mission or use of water and equipment and accessor- ies connected therewith. Parcel E ALL that certain piece or parcel of land, together with the buildings and improvements thereon, bounded and described, as follows: to4083 P [I20 - 4 - BEGINNING at a point on the Westerly line of a private road of the grantor,forty-five feet In width, which point is three hundred thirty-one and forty-nine hundredths feet South of a point which is two hundred six and twenty-five hundredths feet East of another monument marking the U.S. Coast and Geodetic Survey Triangulation Station "Chocomount 2" (which said "Chocomount2" monument is located on the summit of the highest hill on Fishers Island, N.Y., about two and one-quarter miles West of the Eastern end of Fishers Island and lies South 79 degrees 29 minutes 46 seconds East of North Dumpling Light in Fishers Island Sound); and run- ning thence North 75 degrees 39 minutes 00 seconds West one hundred fifty-three and twelve hundredths feet to a point; thence South 69 degrees 39 minutes 20 seconds West one hundred forty-six and thirty- six hundredths feet to a point; thence due North four hundred and sixty feet to a point; thence North 86 degrees 52 minutes 20 seconds East one hundred ninety-nine and sixty-five hundredths feet to a point on the Southerly line of said private road of the grantor; thence South 84 degrees 46 minutes 10 seconds East twenty-six and forty-five hundredths feet to a point; thence on a curve to the right with a radius of sixty-three and sixty-five hundredths feet, a distance measured along the arc ofeighty and fifty-four hundredths feet; thence South 12 degrees 16 minutes 20 seconds East two hundred fifteen and twenty-eight hundredths feet; thence on a curve to the right with a radius of one hundred eighty-two and thirty-two hundredths feet, a distance measured along the arc of one hundred seven and fifty-seven hundredths feet; and thence South 21 degrees 32 minutes 00 seconds West ninety-six and sixty-three hundredths feet to the point of beginning; the last five lines following along the Westerly line of said private road of the grantor; containing three and ten hundredths acres, more or less. - 5 - Parcel F ALL the lands under the waters of Clay Pits Pond, bounded by the respective shore lines thereof, together with the waters thereof; TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed twenty feet in width connecting Clay Pits Pond with the private road of the grantor sometimes called "Cents r Island Avenue," said easement to be limited to the purposes of access to and from Clay Pits Pond from and to said Center Island Avenue and for the construction, maintenance, repair, use and removal of underground pipe lines or conduits for the supply or transmission or use of water and equipment and accessories connected therewith. ITEM TWO ALL those certain easements and interests and rights in lands, as follows: Parcel A A perpetual and exclusive easement to be limited to the purposes of the construction, maintenance, repair, use and removal of a well (herein called the 'No. 1 Well"), designated 5-28517T at a location approximately one hundred and fifty feet East of the Easterly line of said Center Island Avenue and approximately seven hundred and fifty feet West of the Westerly shore of Middle Farms Pond and of a pump house structure and equipment and accessories connected with said No. 1 Well or said pump house and of a well (herein called the 'No. 2 Well"), designated S-28546T, at a location approximately one hundred feet North of said No. 1 Well and of a pump house structure and equipment and accessories connected With said No. 2 Well, any of which structures, equipment and accessories may be on, above or under the ground, as the part of the second part may determine, and to the purpose of taking water through the operation of said wells, the land affected by such easement being an area bounded on the Northerly side thereof by a line having a radius of fifty feet measured from the center of said No. 2 Well and on the Southerly side thereof by a line having a radius of fifty feet measured from the center �fi083 :,+�r 26.7 6 - of said No. 1 Well and on the Easterly and Westerly sides thereof by lines which are parallel to a line connecting the center of said No. 1 Well and the center of said No. 2 Well and which are fifty feet therefrom, measured at right angles to said connecting line Easterly and Westerly therefrom respectively; TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed twenty feet in width connecting said easement area with the Easterly line of Center Island Avenue, said easement to be limited to the purposes of access to and from the land affected by said easement from and to Center Island Avenue; and TOGETHER with a perpetual but non-exclusive easement In, to, over and under a right of way to be laid out by the party of the second part not to exceed ten feet 1n width connecting said easement area with the right of way, hereinafter described under Parcel D hereof, said easement to be limited to the purpose of access to and from said wells from and to said right of way last mentioned and of the construction, maintenance, repair, use and removal of an underground pipe line or conduit for the supply and transmission and use of water and equipment and accessories connected therewith. Parcel B A perpetual and exclusive easement to be limited to the purposes of the construction, maintenance, repair, use and removal of a well (herein called the No. 3 Well ) in, to, over and under a plot of land one hundred feet long by one hundred feet wide located north of the main private road of the grantor leading to the East End and west of the private road of the grantor leading from said main road to Chocomount Reservoir and of a pump house structure and equipment and accessories connected with said No. 3 Well or said pump house, any of which structure, equipment and accessories may be on, above or under the ground, as the party of the second part may determine and to the purpose of taking water through the operation of said No. 3 Well; TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed twenty feet in width connecting the land affected by the easement for the No. 3 Well with the Northerly line of said main private road of the grantor, said easement to be limited to the purposes of access to and from said easement area from and to said main road and of the construction, maintenance, repair, use and removal of an underground pipe line or conduit for the supply and transmission and use of water and equipment and accessories connected therewith; and TOGETHER, with a perpetual but non-exclusive easement in, to, over and under a right of way to be laid out by the party of the second part not to exceed ten feet 1n width connecting said easement area with Chocomount Reservoir, said easement to be limited to the purpose 1 �PME270 - 7 - of access to and from said No. 3 Well from and to Chocomount Reservoir and of the construction, mainten- ance, repair, use and removal of an underground pipe line or conduit for the supply and transmission and use of water and equipment and accessories connected therewith; PROVIDED, HOWEVER, that, notwithstanding the grant hereunder, the easements granted in and by this Parcel B shall automatically terminate on December 1, 1971, without notice to the party of the second part or its successors or assigns in the event said No. 3 Well shall not have been constructed and be in use by said date and the grant of such easements is hereby limited accord ! ingly and the party of the second part, for itself, its successors and assigns hereby waives all notices and proceedings now or hereafter provided by law and coven- ants and agrees, upon the written request of the party of the first part or its successors or assigns, to execute and deliver, in proper form for recording, an instrument acknowledging the termination of such ease- ments. Parcel C a A perpetual and exclusive easement in�Certain right of way ten feet wide now in use for the infiltration galleries system", which consists of manholes, gate valves, a line of solid and open Joint terra cotta pipe and open ditches whlcp.yy�y�cy y�,qe�¢ west of Brick Yard Pond in a Norther y/ rec on o the private road of the grantor, known as Barlow Hill Road and thence in a Southeasterly direction to Barlow Pond, into which ditches water flows by gravity and is transmitted into Barlow Pond, said easement, insofar as said right of way is now owned by the grantor to be limited to the purpose of the construction, maintenance, repair, use and removal of an open ditch and a pipe line or conduit therein, and the equipment and accessories connected therewith, for the transmission of water into Barlow Pond over, under, in and along said right of way and said easement, insofar as said right of way is owned by a person or persons other than the grantor, to be limited only by the limitations of the easements reserved by Fishers Island Corporation or by the party of the first part in and by deeds made by Fishers Island Corporation or the party of the first part to purchasers of such lands; Bald right of way, with respect to property now owned by the party of the first part, being IIve feet wide on e6ther side of the center line of such infiltration line as now existing, and with respect to property of others being as described in such deeds. Parcel D A perpetual and exclusive easement in to, over and under a parcel of land at the Northeast shore of Island Pond, on which there is now constructed a pumping station, to be limited to the purpose of the maintenanc , repair, use and removal of said pumping station and the equipment and accessories connected therewith, any of which structure, equipment and accessories may be on, above or under the ground, as the party of the second part may determine, the land affected by such easement being an area having a radius of fifty feet measured from the center of such pump house; TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way ten feet wide leading from Middle Farms Pond to such pumping station, the center line of which right of way is the center line of said pipe line, as now existing, such easement to be limited to the purpose of the construction, main- tenance, repair, use and removal of an underground pipe line and the equipment and accessories connected there- with, for the transmission of water from Middle Farms Pond to such pumping station; and TOGETHER with a perpetual but non-exclusive easement in, to, over and under a right of way ten feet wide, leading from such pumping station to Barlow Pond, the center line of which right of way is the center line of such pipe line, as now existing, such easement to be limited to the purpose of the construction, maintenance, repair, use and removal of a pipe line and the equipment and accessories connected therewith, any of which may be on or over or under the ground, for the transmission of water from such pumping station to Barlow Pond. Parcel E A perpetual but non-excluelve easement in, to, over and under all private roads of the grantor within the Park which are now in use and all private roads of the grantor, or its successors or assigns within the Park which may be hereafter established, to be limited to the purpose of the construction, maintenance, repair, use and removal of underground pipe lines or conduits for the supply and transmission and use of water and equipment and accessories connected therewith and of fire hydrants and water connections connected therewith and to the purposes of access to and from the lands hereby conveyed and exclusive easement areas herein described from and to the public highway, said easement to extend for the full width of such roads, as now or hereafter established; TOGETHER with all rights,easements and franchises owned by the party of the first part in, to, over and under all public roads within the Park to the extent but only to the extent of the operation of a water system and the construction, maintenance, repair, use or removal of pipe lines or conduits for the supply and transmission and use of water and the equipment and accessories connected therewith and of fire hydrants and water connections and other facilities whatsoever connected with the operation of a water system. EXCEPTING, HOWEVER and RESERVING to the grantor for itself, its successors and assigns, the right, at any time or from time to time and without notice to the grantee or its successors or assigns, to change the location, route or grade of any road or road, or to i - PAGE -_.--- - 9 - discontinue any road or roads or any part or parts thereof, provided, however, that reasonable access shall be afforded to the lands hereby conveyed and the exclusive easement areas herein described and that, in the event there shall be than installed In the particular road, at the time of such change or discontinuance, a pipe line or conduit of the grantee or its successors or assignsthe G6rantor or its successors or assigns shall either (1) pay the expense of relocating such pipe line or conduit and the equipment and accessories connected therewith to a private road of the grantor or its successors or assigns, if nearby, or a public road, if nearby, or (11) shall grant to the grantee, its successors or assigns a perpetual but non-exclusive easement in, to, over and under a right of way ten feet wide for the construction, maintenance, repair, use and removal of an underground pipe line or conduit for the supply and transmission and use of water and equipment and accessories connected therewith and of fire hydrants and water connections connected therewith, the center line of which right of way shall be the then existing pipe line or conduit (said right of way to be further limited, notwith- standing anything in the foregoing to the contrary, to the land at that time constituting a part of the respective road being changed or discontinued). Parcel F A perpetual but non-exclusive easement in, to, over and under certain rights of way in land, hereinafter described and now ownedby the grantor, (but only to the extent same are not within the lines of any private road of the grantor or of any public road, in respect of which the party of the second part, its successors or assigns shall have the easements granted under Parcel E of Item Two of this deed), in which rights of way there are now installed and maintained and in use mains for the supply or transmission or use of water, each such right of way to be limited to ten feet in width, such easement to be limited for the purpose of the construction, maintenance, repair, use and removal of an underground pipe line or conduit for the supply or transmission or use of water and the equipment and accessories connected therewith, which rights of way are as follows: 1. Rights of way within the boundaries of, or bordering, the golf course and extensions of such rights of way through other property now owned by the grantor, the center lines of which are the center lines of the pipe lines or conduits for water now existing within the boundaries of, or bordering, the golf course and extensions of such rights of way through other property now owned by the grantor. 2. Right of way within the boundaries of property owned by the grantor which commences on the Northerly side of the private road of the grantor sometimes called "Center Island Avenue" and extends in a Northerly direction to the Southeasterl _ . 1__,,w6083 ct 73 - 10 - side of the private road of the grantor, sometimes called "Brooks's Point Road," the center line of which is particularly described in deede made by Fishers Island Corporation to Irving W. Bonbright, dated June 21, 1926 and recorded in the Office of the Clerk of Suffolk County on July 25, 1928 in Liber 1363 of Deeds, pages 391 and 411. 3• Right of way within the boundaries of property owned by the grantor which right of way commences at the intersection of the private roads of the j grantor known as "Center Island Avenue" and Clay Point Road and runs in a Northerly direction approx- imately two hundred feet to a fire hydrant, the center line of which right of way is the pipe line or conduit for water now existing at such location. 4. Right of way within the boundaries of property owned by the grantor which right of way begins at a point on the Northerly side of Center Island Avenue where the water main leaves Center Island Avenue and runs in a Northeasterly direction to the Southeasterly line of Brooks's Point Road, following four courses, as follows: (i) North 47 degrees 10 -two and ninety-six West fifty-two minutes 10 seconds Y hundredths feet; (ii) North 38 degrees 15 minutes 00 seconds West sixty-one and seventy-six hundredths feet; (111) North 39 degrees 04 minutes 00 seconds West seventy-four and twenty-four hundredths feet; and (iv) North 39 degrees 31 minutes 40 seconds West seventy-two and twenty hundredths feet to the Southeasterly line of Brooks's Point Road, the center line of which right of way is the line of the four courses above mentioned. 5. Rights of way within the boundaries of property owned by the grantor In which are located, respect- ively, the housings for the master meter which measures the water distributed to the area of Fishers Island to the West of the Park and for the meter which measures the water distributed to the golf course in the Park, said respective meters, and the equipment and accessories connected therewith and in which are located the pipe lines or conduits for water with which said meters are connected, the center lines of which rights of way are said pipe lines or conduits for water now existing. 6. Rights of way within the boundaries of properties in the Park owned by the grantor, whether or not hereinabove mentioned, in which are located existing pipe lines or conduits for water or machinery or equipment or other installations relating to the water system, the center lines of which rights of way are said pipe lines or conduits for water now existing. Parcel G Non-exclusive rights in, to, over and under certain rights of way in land within the Park, hereinafter described, now now owned by the grantor, in which rights of way there are now installed and maintained and in use mains for the supply or transmission or use of water, said rights to be limited to the purpose of the con struction, maintenance, repair, use or removal of pipe lines or conduits for the supply and transmission and use of water and the equipment and accessories connected therewith, said rights hereby granted being given by virtue of the easements in said rights of way reserved by Fishers Island Corporation and by the party of the first part in and by the following deeds: (a) Deed made by Fishers Island Corporation to Sarah Griffin Cheney, dated October 11, 1927, recorded in the Office of the Clerk of Suffolk County on October 25, 1927 in Liber 1312 of Deeds, page 351• (b) Deed made by Fishers Island Corporation to William T. Reed, dated June 2, 1927, recorded in said Clerk's Office on June 15, 1927 in Liber 1277 of Deeds, page 41a. (c) Deed made by Fishers Island Estates, Inc. to Remington Rand, Inc., dated September 20, 1948, records in said Clerk's Office on September 24, 1948 in Liber 2876 of Deeds, page 403. W. (f) Deeds made by Fishers Island Corporation or Fishers Island Estates, Inc., whether or not above men- tioned, in or under which such rights or easements for water of any nature have been created. said rights of way being as described in said deeds, the center line of which rights of way are as described in said deeds. Parcel H A perpetual but non-exclusive easement in, to, over and under a certain right of way within the Park (but only to the extent same is not within the lines of any private road of the grantor or of any public road in respect of which the party of the second part, its successors or assigns shall have the easements granted under Parcel E of Item Two of this deed) in which right of way there is now installed and maintained and in use pipe lines or conduits for the supply or transmission or use of water, extending from the pump house on the parcel of land herein described as Parcel B of Item One hereof in Southwesterly and Westerly directions to the Westerly boundary of the Park, and branches and extensions of said right of way in which connecting pipe lines or conduits are installed and maintained, said easement, insofar as said right of way and its branches and extensions are now owned by the grantor, to be limited to the purpose of the construction, maintenance, repair, use and removal of underground pipe lines or conduits for the supply and transmission and use of Water and equipment and accessories connected theradth &VA Of - 6083 P��r275 12 _ fire hydrants and water connections connected therewith and said easements, insofar as said right of way and its branches and extensions are owned by a person or persons other than the grantor, to be limited only by the limitations of the easements reserved by Fishers Island Corporation or by the party of the first part in and by deeds made by Fishers Island Corporation or the party of the first part to purchasers of such lands; said right of way, with respect to property now owned by the party of the first part, being five feet wide on either side of the center line of such pipe line or con- duit, as now existing, and with respect to the property of others being as described In such deeds Parcel I All the right, title and interest of the party of the first part in and to any and all easements howsoever created, for the construction or maintenance or repair or use or removal of pipe lines or conduits for the supply or transmission or use of water in, to, over or under any rights or rights of way or roads contained in the area acquired by the United States of America in proceedings instituted in the United States District Court for the Eastern District of New York entitled "United States of America, Petitioner-Plaintiff, versus 94.42 acres of land, more or less, at Fishers Island, To" of Southold, County of Suffolk, State of New York and Fishers Island Estates, Inc." et al (Clerk's number C.P. 13)• Parcel J Non-exclusive perpetual rights in, to, over and under certain rights of way within the Park to be limited to the purpose of the construction, mainten- ance, repair, use and removal of underground pipe lines or conduits for the supply and transmission and use of water and equipment and accessories con- nected therewith, each of said rights of way being five feet wide, said rights hereby granted being given by virtue of the easements in said rights of way reserved for utility purposes by Fishers Island Corporation and by the party of the first part in and by deeds made to purchasers of land within the Park. Parcel K Non-exclusive perpetual rights in, to, over and under certain rights of way within the Park to be limited to the purpose of the construction, mainten- ance, repair, use and removal of underground pipe linea or conduits for the supply and transmission and use of water and equipment and accessories con- nected therewith, each of said rights of way to be five feet wide, said rights hereby granted being limited to the easements in said rights of way which may be hereafter be reserved for utility purposes by the party of the first part or its successors or assigns in and by deeds made to purchasers of land within the Park.
