That the said party of the first part,for and in consideration of ONE HUNDRED($100.00)- DoILu's, lawful money of the United States of America,to it in hand well and truly paid by the said party of the second part,at or before the sealing and delivery of these presents,the receipt whereof is hereby acknowledged,and the said party of the fire part being therewith fully satisfied,contented and paid,ha s given,granted,bargained,sold,aliened,released,eNeoffed,conveyed and confirmed and by these presents does give,grant, bargain,sell,alien,release,enfeoff,convey and confirm unto the said party of the second part,and to its successors and assigns,forever, �Il that tract or parcel of land and premises, hereinafter particularly described, situate, lying and being in the Town of Southold County of Suffolk and State of New York, being a part of that portion of Fishers Island belonging to the grantor (which portion is hereinafter called the"Park") lying easterly of the following line, viz .IIS BEGINNING at the southeasterly corner of land owned by the United States, known as the Fort H. G. Wright Military Reservation, Mount Prospect'Tract, on the shore of Block Island Sound or the Atlantic Ocean(as said Tract was constituted prior to the extension thereof by the Acquisition of additional lands in condemnation proceedings instituted In 19 12f and running thence northerly following the East boundary of the said tract of land of the United States (as same was constituted prior to such extension thereof)to the southerly line of East End Road (sometimes called Oriental Avenue) and which point is the northeasterly corner of said tract of land of the United States (as same was constituted prior to such extension thereof), thence � crossing the East End Road and following the same course as the last to the shore of West Harbor or Fisher$Island Sound; Said lot or parcel of land being bounded and described as follows: BEGINNING at a drill hole in a boulder on the Northeasterly side of a road 40 feet wide, said drill hole being 5456.79 feet North of a point which is 18.93 feet West of a monument marking the U.S. Coast and Geodetic Survey Triangulation Station"MN" (which said"NTN" monument is located near the Western end of a ridge overlooking the South shore of Fishers Island and on the highest point between Chocomount and Mount Prospect and lies South 45 degrees 17 minutes 26 seconds East of North Dumpling Light in Fishers Island Sound); and running thence Northwestwardly along said road line(and following the are of a curve to the right _1 OEAlhX7a) mom R whose radius is 178.0 feet and the direction of whose radius at that point is North 29 degrees 10 minutes 30 seconds East) 163.93 feet to a stake marking the point of beginning of the herein conveyed tract, said stake being 5587.26 feet North of a point which is 108.40 feet West of said"NIN"monument; and thence from said point of beginning running North 5 degrees 16 minutes 30 seconds East 103.46 feet; thence North 9 degrees 03 minutes East 140.0 feet to the shore of Fishers Island Sound; thence with the meanders of said shore South 65 degrees 33 minutes West 90.0 feet and North 66 degrees 39 minutes West 68.98 feet; thence South 17 degrees 22 minutes 40 seconds East 248.36 feet W the Northerly end of said road; thence along the northerly end of said road North 81 degrees 56 minutes 30 seconds East 40.0 feet W the point of beginning; containing 0.45 acre, more or less. TOGETHER with all right, title and interest of the parties of the first part in and to all hold which may lie between the respective meander lines above described and the actual high water mark of F7shers Island Sound and in and to the shores and beaches of Fishers Island Sound in front of and adjoining said premises. TOGETHER with an easement to the grantees, their heirs and assigns, for ingress to and egress from the premises hereby conveyed over and along such private roads as now or mac hereafter exist connecting the premises hereby conveyed with the public highway;provided, however, that Fishers Island Estates, Inc., reserves the right to change the location, route or grade of said roads from time to time, provided that such change shall not pre- vent adequate access to the premises hereby conveyed. I RESERVING to Fishers Island Estates, Inc., its successors or assigns, from the grant of the premises hereby conveyed, an easement and right of way within a strip of land five feet wide along the fifth course of the boundaries of said premises as above described for the purpose of laying, erecting, maintaining, improving and operating a culvert, which right of way shall run from the road above mentioned to the waters of Fishers Island Sound. RESERVING, also, to Fishers Island Estates, Inc., its successors and assigns from the grant of the premises hereby conveyed, an casement and right of way within a strip of land five feet wide along the last course of the boundaries of said premises as above described for the erection thereon of poles to support wires for the transmission of electricity-for light, heat, telephone and other purposes, and for the construction, operation and main- tenance of pipelines or conduits under the surfact of said reservation for any law tul Pei pose whatsoever, but Fishers Island Estates, Inc. shall have the tight to release the premises hereby conveyed from these particular easements and rights of way provided, I however, that whenever the surface of the ground shall be disturbed by Fishers Island Estates, Inc. Its successors and assigns, for the purpose of constructing or repair fing any such pole line, pipeline or conduit, it shall become the duty of Fishers Island Estates. Inc., or its successors or assigns, forthwith, at its or their own expense, to repair and restore the surface of the ground so disturbed w substantiafl_v the same condition as Shall have existed before the time of such disturbance. BEING the same premises conveyed by George A. Braga and Giofa M. Braga, his wife, to the grantor by deed dated October 14, 1968 and recorded in the Suffolk Counts Clerk's office on October 28, 1963 in Book 5441 of Deeds at Pages 102 to 105.
