ALL that lot or parcel of land, situated on Fishers Island in
the Town of Southold, County of Suffolk and State of New York being
a portion of the tract developed on the easterly portion of said
Island by Fishers Island Corporation, a New York corporation, which
lot or parcel is more particularly bounded and described as follows :
BEGINNING at a stone monument set on the northeasterly side of
a road 40 feet wide, said monument being located 1061. 85 feet North
of a point which is 2528.34 feet East of another monument marking
the U . S. Coast and Geodetic Survey Triangulation Station "Chocomount
2" (which said "Chocomount 2" monument is located on the summit of
the highest hill on Fishers Island, New York, about 2-1/4 miles West
of the Eastern end of Fishers Island and lies South 79 degrees

of Shepard B. Palmer, 4. 04 acres more or less.
BEING AND INTENDED TO BE the same parcel as conveyed to the party of
the first part by deed from Helen Campbell Cheney dated September 16 ,
1952 ; said deed recorded at Liber 7244 , cp 140.
TOGETHER WITH all improvements on the above described parcel, in-
cluding a dwelling, guest house and garage.
TOGETHER WITH all right, title and interest, if any, of the party of
the first part in and to any land lying under the waters of Fishers
Island Sound adjacent to the premises above described lying between
the high and low water marks.
TOGETHER with the appurtenances, and all the estate and rights of
the party of the first part in and to said premises , including all
appurtenances , estate and rights created or conveyed by a certain
deed from Fishers Island Corporation to Philip Cheney dated May 20,
1929 and recorded in the office of the Clerk of Suffolk County,
Liber 1435 , page 585 and Declaration and Agreement dated January 22 ,
1965 and recorded in Liber 5728 at page 412 , to which reference is
hereby made.
SUBJECT, HOWEVER, to all easements and rights of way established by
the aforesaid deed from Fishers Island Corporation to Philip Cheney
as such are renewed in the aforesaid Declaration and Agreement, and
to each and all the covenants, restrictions, reservations and
::0 agreements of every name and nature either contained in said deed
rrn and in the aforesaid Declaration and Agreement, all of which the
