TOGETHER with all the estate and rights of the party of the first part, if any, in and to a right of way to said premises granted for motor vehicles, teams, the erection of poles for stringing wires and persons on foot to pass and repass as conveyed to Helen M. The westerly side of said right of way begins at a mere stone on the southerly side of East End Road which marks the northeast; corner of Alfred L. Ferguson's property; thence the westerly line runs S. 9-6' East a distance of 1060 feet, more or less to the above described premises. This right of way is 30 feet wide throughout its full length. BEING the same premises conveyed by Martha F. Green to Barbara Stoddard Rir'-land by deed dated November 11, 1954 and recorded in Liber 3793 of Conveyances at Page 71 on November 17,1954 in the Office of the Clerk of Suffolk County. ALSO BEING the samepremises conveyed by William R. Kirkland, Jr, to Richaru' E. T. Hunter and Elizabeth Christian Hunter, his wife, by deed dated October 1, 1970, and recorded in Liber 6821 of Conveyances at page 304, on October 9, 1970, in the Office of the Clerk of Suffolk County, New York. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises, TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. i SUBJECT TO: 1. State of facts disclosed by survey made by Chandler & Palmer dated September, 1954, redated September 23, 1970. 2. Telephone agreement recorded in Liber 2135 of Conveyances at page 433. 3. Covenants and restrictions contained in deeds recorded in Liber 967 of Conveyances at page 196; in Liber 1326 of Conveyances at page 206; in Liber 1946 of Conveyances at page 217 and in Liber 2437 of Conveyances at page 468, to the extent only the same may now be in effect. 5. Rights of others in any part of the premises lying below the highwater mark of Treasure Pond (Duck Pond) as the same now exists or formerly existed. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as. a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using -3- t.
