THIS INDENTURE, made the day of November, 1973,

WILLIAM B. MAY, JR. , and JEANNE A. MAY, his wife, both residing at
Ardsley Avenue (no #), Irvington, New York, hereinafter called thg Grantors,
parties of the first part, and

Manhattan, City, County and State of New York, hereinafter referred to as

WITNESSETH, that the parties of the first part; in eonsidera-
tion of ONE HUNDRED ($100. 00) Dollars, lawful money of the United States,
and other good and valuable consideration paid by the party of the second part, i
I do hereby grant and release unto the party of the second part, her heirs and

along lands now or formerly of John C. and Valerie H. Evans, recently conveyed

(2) North 19 degrees 25 minutes East a distance of 75, 13 feet to the
E� monument set at the point or place of BEGINNING,
TOGETHER WITH all right, title and interest, if any of the Grantors in
and to any land lying in the bed of the right of way in front of and adjoining
the above described premises on the Southwest, to the center line thereof,
said right of way being more particularly described below. SUBJECT
however, to the rights of others to use said right of way for the purpose of
tt ingress or egress by foot or vehicle, and for the installation and maintenance i
i of public service utilities.

i TOGETHER WITH a non-exclusive easement of ten (10) feet along the
Southwesterly boundary line of property heretofore conveyed by the Grantors
to Kent Rhodes, together with others and subject at all times to the terms,
covenants and conditions of the easement heretofore reserved by the Grantors
over the property conveyed to Kent Rhodes, said easement intended being the
�i Southwesterly ten (10) feet of said property of Kent Rhodes and which said
f! easement extends from a certain right of way on the Northerly property line
of the subject premises to Fishers Island Sound.
TOGETHER, also, with a non-exclusive easement for ingress to and egress
from the above described tract over a right of way leading to Reservoir Road,
said right of way being bounded and described as follows:

point which is 5693. 40 ft. West of said "PROS" monument; and running thence

having a radius of 208 feet, the direction of which radius at that point is

j of the 1. 59 acre parcel of land heretofore conveyed by the Grantors to Kent

point of curve to the left having a radius of 181. 17 feet, the direction of which

from said right of way over the private road of the Grantors known as
(' Reservoir Road extending From the Southerly line of the above described right

SUCH EASEMENTS in said right of way and in Reservoir Road to constitute
�I appurtenances only of the premises hereby sold and to be limited until such
j� time as said right of way or said Reservoir Road, as the case may be, shall
! be dedicated to public road or highway purposes and accepted by a Town of
11 Village or other public authority for such purposes,

parties of the first part and Race Point Corporation,

PROVIDED, however, that this conveyance is made subject to the following
covenants and restrictions which are hereby entered into by the Grantee for
!i herself, her heirs, legal representatives and assigns, as a part of the
!' consideration therefor;
THAT the premises hereby conveyed shall not be divided or subdivided for
any purpose whatsoever,

�} That the premises hereby conveyed shall be occupied and used by the Grantee,
i her heirs, legal representatives and assigns, for private residential purposes"
dl and not otherwise and there shall be erected and used thereon only one
private residence for the use of only one family, together with the accessory
outbuildings appurtenant thereto.
iAll the covenants and agreements herein expressed shall be binding upon the
; Grantee, her heirs, legal representatives and assigns, and shall be held to
jrun with and bind the land and premises hereby conveyed and all subsequent 1
owners and occupants thereof,
