of Southold, the. County of Suffolk, and State of New York, EXCEPTING,
HOWEVER, that portion thereof and hereinafter called the excepted
parcel .
BEGINNING at a point located North 220 35' West 5-1/2 feet from the f
Northwest corner of the fog signal house situated on the excepted :
parcel and said point also being North 610 00' West, 26 feet from e
the Northeast corner of said fog signal house; thence running South -
700 00' East, 44 feet to a point; thence South 200 30 ' West, 26 feet
to a poi8t; thence North 700 00 ' West, 7 feet to a point; thence F
South 20 30 ' West, 22 feet to a point; thence North 70° 00 ' West,
37 feet to a point; thence North 20° 30 ' East, 48 feet to the point
or place of beginning.
BEING and intended to be the same premises conveyed to the party of [
the first part hereto by deed from Myron Marder, dated February 19 ,
1970, recorded in the Suffolk County Clerk' s Office February 24 , 1970 I

SUBJECT to the lien of a certain mortgage held by Edgar B. Burchell ,
Jr. and Paul Bianco, dated January 8, 1970 and recorded in the Suffolk
County Clerk' s Office on January 22, 1970 .

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of

the party of the second part forever.
AND the party of the first part,in compliance with Section 13 of the Lien Law, hereby covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply tFtr
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word `party shall be construed as if it read "parties" whenever the sense of this indenture so requires.
