JOHN GADA, whose post office address is Equestrian Avenue, Fishers Island, Town of Southold, Suffolk County, New 3e*seyz X Joh'C F- art of the second art, g party P u WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and-imprevemente-tl ereos-greeted,-situate, lying andbeingAmllim at Fishers Island, in the Town of Southold, County of Suffolk, and State of New York, bounded and described as follows: BEGINNING at a point on the easterly side of a private road dis- tant 45. 70 feet northerly as measured along the easterly side of said private road from the corner formed by the intersection of. the easterly side of said private road and the northerly side of "The Gloaming" ; running thence northerly along the easterly line of said .private road 68 feet more or less to the southerly line of lands now or formerly of Constance Roderick; thence along lands last a- bovementioned north 71 degrees 45 minutes 00 seconds east 71.90 feet to other lands now or formerly of A. John Gada; ttmce along lands last mentioned in a southeasterly direction 52 .40 feet; thence south 51 degrees 48 minutes 00 seconds west 32 .55 feet; thence south 28 degrees 34 minutes 00 seconds west 44 .95 feet to the easterly side of said private road at the point or 'place of be- ginning. a part of BEING / saxx lands and premises conveyed by Charlotte A. Eldredge to Henry L. Eldredge and Nellie Eldredge, his wife , by Mr-ed dated October 10 , 1938 , and recorded on October 19 , 1938, in Book 2010 of Deeds, page 148 &c. And the said Henry L. Eldredge departed this life on December 4, 1968, at Waterford, Conn. , leaving his wife, Nellie Eldredge, surviving. TOGETHER with a right-of-way over the private road leading northwesterly from "The Gloaming" and extending along the southwesterly line of the above described premises. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; 'TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
