� Wfi'NFSSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon'erected, situate,
lying and being imd#c at Fishers Island, in the Town of Southold, County of Suffolk,
State of New York, being bounded and described as follows:
BEGINNING at a drill hole in the walk on the proposed Northwesterly line of
Whistler Avenue, said point being 313. 09 feet South of a point which is 5815. 17
feet West of a monument marking the United States Coast and Geodetic Survey
Triangulation Station "PROS" and thence running along said proposed road line
North 67 degrees 13 minutes East 172. 09 feet to a drill hole; thence }
North 22 degrees 47 minutes West 117. 96 feet to land of the Fishers Mand Ferry
District; thence South 67 degrees 17 minutes West 110. 12 feet to a monument,
abutting Northwesterly on said Ferry District land; thence South 32 degrees
48 minutes East 40. 3 feet; thence South 18 degrees 38 minutes West 104. 5 feet
to the point of beginning.
TOGETHER with the right to use in common with others a strip of land
located between the curb line on the Northwesterly side of Whistler' Avenue and
the Southeasterly line of the premises until such time as such strip is dedicated
4 for public purposes and accepted by a town or village for such purposes.
BEING and intended to be the same premises conveyed to A. John Gada
and Margaret J. Gada, his wife, the parties of the first part herein, by deed '
dated April 8, 1965 and recorded in the Suffolk County Clerk's Office on
April 28, 1965 in Liber 5737 of deeds at page 04.

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in-anyway whatever, except as aforesaid:
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
