The following action was taken by the Board of Trustees during their
regular meeting held on May 28, 1987 regarding the above application.
.ffiEREAS, Michael M. & Jane B. Sueiro applied to the Southold Town Trustees for
a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated March I, 1987, and
.ffiEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
IffiEREAS, a public hearing was held by the Town Trustees with
respect to said application on May 28, 1987 at which time all interested
persons were given an opportunity to be heard, andno objections were raised, and
IffiEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area, and
l~EREASJ the ~oRrd hRs considerp.d all the testimony and documentation
submitted concerning this application, and
I<HEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE, BE IT
RESOLVED that Mr. & Mrs. Michael Sueiro BE AND HEREBY IS GRANTED PERMISSION UNDER TH
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Maintenance dredge

Pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531) and
baeed upon a review of the latest published version of the threatened and
endangered species listing, a preliainary determination is that the
activity under consideration will not affect those species listed or their
critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Placea, there are no known sites eligible for or
included in the Register within the permit area. Presently unknown
archeological, scientific, prehistorical or historical data may be lost by
work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act will
include application of the guidelines promulgated by the Administrator,
U.S. Environmental Protection Agency, under authority of Section 404( b) of
the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance with
Section 401 of the Clean Water Act prior to a permit decision.
Pursuant to Section 307(c) of the Coastal Zone Management Act of 1972 as
amended (16 U.S.C. 1456(c)). for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program, the applicant has certified in the permit
application that the activity complieo with and wIll be conducted in a
manner that 1s consistent with the approved state coastal zone management
program. By this p~blic notice, we are requesting the state's concurrence
with, objection to, or waiver of the applicant's certification. No permit
decision will be made until one of these actions occur. For activities
within the coastal zone of New York State, the applicant's certification

DESCRIPTION OF WORK
The appl icants Michael and Jane Sueiro, requests Department of the Army
authorization to dredge, with 10 years maintenance, and install floating
piers in Dawn Lagoon, Shelter Island Sound. at East Marion, Suffolk County.
New York.
The work involves the dredging of a 65 foot long by 20 foot wide area
to 3 feet below the plane of mean low water, removing 40 cubic yards
of material. The applicant anticipates dredging 3 times during the life
of the permit. removing approximately 40 cubic yards per event. All
dredged material from initial and subsequent activities would be placed
on an upland site. where it would be suitably retained from re-entering
the waterway.
In addition. two 20 foot by 5 foot floating piers would be installed
with access provided by a permanent ladder.

This notice is issued pursuant to the provisions of Article 8
of the Environmental Conservation Law State Environmental Quality
Review and 6NYCRR Part 617, Section 617.10 and Chapter 44 of the Code
of the Town of Southold, notice is hereby given that the Southold
Town Trustees, as lead agency for the action described below has
determined that the project will not have a significant effect on
the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
1.hich may also have an application pending for the same or similar
project.
TYPE OF ACTION: UNLISTED
DESCRIPTION OF ACTION: To maintenance dredge 40 cu. yds. of spoil and to
install two 20' x 5' floating piers.
LOCATION OF PROJECT: Wiggins Lane corner of Dawn Drive, East Marion, New York.
REASONS SUPPORTING THIS DETERMINATION:
1. An environmental assessment form has been submitted which
indicated that there would be no adverse effect to the
environment should the project be implemented as planned.
2. Because there has been no response in the allotted time from
the Southold Town Building Dept. and the New York State D.E.C.
it is assumed that there are no objections nor comments from
those agencies.
