TERMS AND dONDITIONS
The Permittee Russell McCall. residing at 101140 New Suffolk Ave.. Mattituck, as part ofthe
consideration for the issuance of the Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits iarising directly or indirectly as a result of any
operation performed pursuant to this perrtlit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board al a later date.
3. That this Permit should be retained indeflnite1y, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstru4tion to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidctnce that a copy of this Trustee permit has been
recorded with the Suffolk County DepartIj:1ent of Real Properties Office as a notice
covenant and deed restriction to the deed pf the subject parcel. Such evidence shall be
provided within ninety (90) calendar day~ of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other petmits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Corwin:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., August 23,2006 regarding the above matter:
WHEREAS, David Corwin on behalf of RUSSELL McCALL applied to the Southold
Town Trustees for a permit under the provisions of Chapter 275 of the South old Town
Code, the Wetland Ordinance of the Town of Southold, application dated July 18, 2006,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, said application was found to be! Exempt from the Local Waterfront
Revitalization Program, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 23, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have persor!1ally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the ~tandards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of RUSSELL McCALL
to construct 85 If. of new vinyl seawall 15" in front of existing concrete seawall, and
backfill with approx. 31 cy. of sand, and as depicted on the plans prepared by David
Corwin dated May 24, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., August
16,2006, the following recommendation was made:

RESOLVED to recommend to the South old Town Board ofTrustees APPROVAL WITH
A CONDITION of the Wetland'Permit application of RUSSELL McCALL to construct 85
If. of new vinyl seawall 15" in front of existing concrete seawall, and backfill with approx.
31 cy. of sand.

Inspected by: Jack McGreevy, Don Wilder, Peter Young
The CAC recommends Approval of the application with the Condition of a 20' non-turf
buffer along the entire length of the concrete wall. The CAC has a concern with the 15"
bump-out and questions whether the bulkhead has been replaced in front of the existing
in the past.

The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is EXEMPT from L WRP review pursuant to 268-3 of the Town of
Southold Town Code:

Policy 2 Preserve historic resources of the Town of Southold.
There are no historical or archaeological artifacts in the vicinity of the area where
construction will be undertaken.
Policy 4 Minimize loss of life, structures, and natural resources from flooding and
erosion.
The original timber shore protection structure and the concrete shore protection
structures are deteriorated. Two concrete seawalls have been constructed behind the
timber shore protection structure. A new vinyl sheet shore protection structure is
proposed to protect the concrete seawall and thus hold the sand behind the seawall.
There are no groins associated with the existing seawall. Groins to the west of the
McCall property appear to be holding sand. An examination of the shore at the site and
the Downs Creek Inlet indicate that sand is moving from the west into and across the
inlet.
The existing Downs Creek Inlet is unstabilized. The proposed structure should have no
effect on the sands that now constitute the area of the inlet and are moving through the
inlet.
Policy 5 Protect and improve water quality and supply in the Town of Southold.
5.3 Protect and enhance quality of coastal waters.
No excavation with a backhoe or clamshell bucket is anticipated in front of the existing
structure. Installation of vinyl sheets and piles will be with a water jet. The area behind
the existing structure will be excavated to allow the installation of a tierod backing
system. Excavated area will use existing sand and some sand from an upland location
as backfill.
No discharge into coastal waters from the backing excavation is anticipated.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
The upland portion of the proposed project contains two indigenous plant species:
meadow grass (Spartina patens) and American beachgrass. Meadow grass is a
wetlands indicator plant. The meadow grass is the result of waves overtopping the
existing seawall thus producing the occasional salt water exposure that is part of the
habitat of the meadow grass.

Excavation for the backing system may damage some of the existing meadow grass and
some of the American beach grass.
Excavation will be accomplish by hand digging and water jet. After construction of the
tierod backing system the area adjacent to the new seawall will be raised six to twelve-
inches with clean sand similar to the sand on the site now.
The existing short meadow grass will spread by its rhizome root system to reestablish
itself in the salt spray area.
The American beach grass will spread by its rhizome root system to any damaged areas
after construction is completed.
A 20-toot no-trut zone will be maintained behind the new seawall construction which
will encourage the reproduction of meadow grass and American beachgrass. The 20-
foot no-turf zone will not receive any lawn chemicals such as fertilizers to eliminate
runoff of nutrients into the bay.
The project is adjacent to the Downs Creek Significant Coastal Fish and Wildlife Habitat.
Best construction practices will be observed to minimize turbidly or other effects on the
wildlife habitat.
The proposed shore protection structure will use vinyl sheets for a minimum impact on
the environment. CCA treated piles will be used for soldier piles for long life of the
structure. The bottom wale will be creosoted timber which has been found to be the only
material that provides satisfactory service when exposed to marine borers.
The proposed structure will be stepped out 15-inches on the top and will be kept as
close to the existing deteriorated timber structure on the bottom as practical. The
original wall was canted. The new seawall will be constructed plumb. This will result in
a step-out of approximately 9-inches at the level of low water. The step-out will allow the
existing seawall to remain in place rather than subject the waterbody to disturbance from
demolition of the existing wall. It will also eliminate the need for landfill space to dispose
of the existing seawall and the need to truck the debris over town roads.
Policy 8 Minimize environmental degradation in Town of Southold from solid waste
and hazardous substances and wastes.
No hazardous waste materials will be generated by the proposed project.
A step-out from the existing seawall to construct the new seawall is proposed. The step-
out will eliminate the need to remove the existing deteriorated structure and the need to
transport and deposit the debris from the removal of the existing deteriorated structure.
Landfill space will not have to be used to dispose of the existing structure.

structure. The access begins along the west side of Downs Creek. Public access will
