Dear Mr. Cuddy:
The Board of Town Trustees took the following action during its regular meeting held on
Monday, December 20, 2004 regarding the above matter:
WHEREAS, Charles Cuddy as agent for LEONARD SESSA applied to the Southold
Town Trustees for a permit under the provisions of Chapter 97 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated November 15,
2004, and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 20, 2004 at which time all interested persons were given an
oppodunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of LEONARD SESSA to
reconstruct a 4'X 38' timber dock and replacement of existing piles inkind/inplace with the
condition the shed sitting on the marsh be moved to the upland, and the floating dock be
removed from the marsh, and all as depicted on the plan surveyed by Joseph A. Ingegno
last dated December 22, 2005.
Permit to construct and complete project will expire two years from the date the permit is
signed. Fees must be paid, if applicable, and permit issued within six months of the date
of this notification.
Inspections are required at a fee of $50.00 per ~nspection. (See attached schedule.)

Dear Mr. & Mrs. Swahn:
On April 23, 2004, the New York District Corps of Engineers
received a request for Department of the Army authorization to
replace, in-place, existing docking assembly consisting of a 4
foot wide by 38 foot long pier supported by six (6) guide piles,
a 4 foot wide by 18 1/2 foot long ramp, and a 5 foot wide by 40
foot long float in Mattituck Inlet, a tributary to the Long
Island Sound, Mattituck, Town of Southold, Suffolk County, New
York.
Based on the information submitted to this office, our
review of the project indicates that an individual permit is not
required. It appears that the activities within the jurisdiction
of this office could be accomplished under Department of the Army
Nationwide General Permit Number 3. Nationwide Permits are
prescribed in the January 15, 2002 Federal Register, Final Notice
of Issuance, Reissuance, and Modification of Nationwide Permits
(67 FR 2020). The work may be performed without further
authorization from this office provided the activity complies
with the permit conditions listed in Section B, No. 3, Section C,
the following special condition and any applicable regional
conditions, copies enclosed.
Special Condition
(A) The permittee understands and agrees that, if future
operations by the United States require the removal, relocation,
or other alteration, of the structure or work herein authorized,
or if, in the opinion of the Secretary of the Army or his
authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable
waters, the permittee will be required, upon due notice from the
Corps of Engineers, to remove, relocate, or alter, the structural
work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States
on account of any such removal or alteration.
This determination covers only the work described in the
submitted material. Any major changes in the project may require
additional authorizations from the New York District.
Care should be taken so that construction materials,
including debris, do not enter any waterway to become drift or
pollution hazards. You are to contact the appropriate state and
local government officials to ensure that the subject work is
performed in compliance with their requirements.
This verification is valid for a period of two years from
the date of this 'letter, unless the nationwide permit is
modified, suspended or revoked. This verification will remain
valid for two years from the date of this letter if the activity
complies with the terms of any subsequent modifications of the
nationwide permit authorization. If the nationwide permits are
suspended, revoked, or modified in such a way that the activity
would no longer comply with the terms and conditions of a
nationwide permit, and the proposed activity has commenced, or is
under contract to commence, the permittee shall have 12 months
from the date of such action to complete the activity.
Within 30 days of the completion of the activity authorized
by this permit and any mitigation required by this permit, you
are to sign and submit the attached compliance certification form
to this office.

I understand from your letter regarding the above application that you wish to have a new survey
prepared to show a different location of the shed. Perhaps, there is some misunderstanding. While,
I indicated that the shed could be moved that movement will only be several feet in any direction. The
property owned by the applicant is only 30' by 50'. Access to the site is over the easement and land
of others.
