Southold , as part of the consideration for the issuance of the Permit does understand and prescribe to the following: I. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That iffuture operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. . . James F. SANFORD 780 PRIVATE ROAD 17, SOUTH OLD SCTM# 81-3-27.1 Dear Mr.Bertani: The Board of Town Trustees took the following action during its regular meeting held on Wed., October 18, 2006 regarding the above matter: WHEREAS, John Bertani Builder Inc as agent for LINDA SANFORD applied to the South old Town Trustees for a permit under the provisions of Chapter 275 of the South old Town Code, the Wetland Ordinance of the Town of Southold, application dated September 25,2006, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the installation of drywells to contain the roof run-off and pool backwash, the installation of a hay bale line during construction, and the use of native and drought tolerant vegetation, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 18, 2006, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 . . WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirements imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of LINDA SANFORD for the existing new construction of a single-family dwelling, renovation of the existing garage, new in-ground swimming pool, patios and new landscape plan with the condition that the pool be located 50' landward of the top of bank, a dry well for the pool, native species be used in the landscaping of the bluff, and all as depicted on the plans prepared by Keith E. Simpson, Associates, Inc. dated 10/27/06 and planting plan dated August 1,2006. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) The reconstruction of the home has negligible or no effect on solid waste in the Town of Southold and it is a redevelopment of a single one story home. PUBLIC COAST POLICIES Policy 9. The application does not provide for public access to and recreation use of coastal waters, public lands and public resources of the Town of Southold as it is a redevelopment of a single family home, renovation of an existing garage and addition of a swimming pool, patios and landscape. WORKING COAST POLICIES Policy 10. The instant application is not applicable to maintaining or protecting Southold's water dependent uses in promoting or citing of new water dependent uses in suitable locations in that the present location is zoned residential and the application seeks to rebuild a residential home on the location. Policy 11. The project promotes sustainable living marine resources in the Long Island Sound, the Peconic Estuary and town waters by providing for improved drywell capturing of gutter leaders and roof runoff which presents possible point source pollution which could negatively affect ecosystems and habitats. The application exceeds the configuration of the previously existing house as it provides better protection for roof runoff recapture. Policy 12. The application protects agricultural lands in the Town of Southold by redeveloping an already developed parcel instead of developing "virgin, natural undeveloped or agricultural lands". Policy 13. The architect contacted the building department for guidance and was told that he would have to apply for relief from the Variance Board for S' more than the front yard building Hne allowance that was shown. Even though the relief was QI II ,led, the existing new construction was moved back further than what was originally proposed to the Trustees. VIIhen applying for the building permit, the building departmant told the architect that since the new construction met the original requirements of the Trustee permit that he did not have to return to the Board. Construction was begun in January 2005 and has been ongoing since. We are hoping that the outdoor portion of the construction including all landscape, pool and renOIIation of garage will be completed by September 2007. The submitted plan fosters a pattern of development that enhances community character, preserves open space, makes sufficient use of infrastructure, makes beneficial use of coastal location, and minimizes adverse affects of development in the following manner: The application seeks to allow existing construction on a location on which there was an existing one family dwelling which was in disrepair and demolished. It also seeks to renovate in existing garage which was in disrepair and install an in- ground swimming pool with patio areas and landscape. This preserves the community character of the Town of Southold and it preserves the other open spaces while rehabilitating already developed areas. This application makes beneficial use of the coastal locations and minimizes adverse effects or development in that it is rehabilitating and reconstructing already existing development which currently has some infrastructure in place. Policy 2. Policy is not applicable to present application as the demolished one family structure and the exisiting garage were not historical and there are no archeological resources involved in the property. Policy 3. The proposed application and building does not impact the visual quality and protects any resources throughout the Town of South old in that it redevelops an already existing home and garage. While the applicant believes that it is a major esthetic improvement over the previously existing one family home and garage, this is totally a subjective determination and there is neither a decrease nor increase in the visual quality and protection of the scenic resources. . . NATURAL COAST POLICIES Policy 4. The application applicability to minimizing the loss of life structures and natural resources from flooding and erosion is not applicable to this application as the application simply seeks to allow the existing construction in an area where there was an already demolished one family dwelling and renovate an existing garage while adding a swimming pool, patios and new vegetation. It marginally increases the minimization of lose of life, structures and natural resources from flooding and erosion through better design and the addition of runoff retention devices. Policy 5. The application protects and improves water quality and supply in the Town of South old by the updating of the septic system and the enhancement of drywells on the property in order to control runoff into the natural resources. Policy 6. The application protects the quality and functions of the Town of Southold ecosystem in that it provides runoff retention measures which decrease point source pollution and allows natural habitats to better restore themselves without these intrusions. Policy 7. The application will not protect and improve air quality in the Town of Southold nor will it decrease or impair the air quality. The reconstruction of a single family home, renovation to existing garage and addition of an in- ground swimming pool, patios and new landscape will have no measurable impacts on air quality. Policy 8. The application will have no effect on the environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. . . The reconstruction of the home has negligible or no effect on solid waste in the Town of Southold and it is a redevelopment of a single one story home. PUBLIC COAST POLICIES Policy 9. The application does not provide for public access to and recreation use of coastal waters, public lands and public resources of the Town of Southold as it is a redevelopment of a single family home, renovation of an existing garage and addition of a swimming pool, patios and landscape. WORKING COAST POLICIES Policy 10. The instant application is not applicable to maintaining or protecting Southold's water dependent uses in promoting or citing of new water dependent uses in suitable locations in that the present location is zoned residential and the application seeks to rebuild a residential home on the location. Policy 11. The project promotes sustainable living marine resources in the Long Island Sound, the Peconic Estuary and town waters by providing for improved drywell capturing of gutter leaders and roof runoff which presents possible point source pollution which could negatively affect ecosystems and habitats. The application exceeds the configuration of the previously existing house as it provides better protection for roof runoff recapture. Policy 12. The application protects agricultural lands in the Town of Southold by redeveloping an already developed parcel instead of developing "virgin, natural undeveloped or agricultural lands". . . The application promotes appropriate use and development of energy and mineral resources in that the new construction and redevelopment of this single family house used significantly better energy efficient design and is compliant with the local building codes which have been strengthened in this regard over the codes in place at the time of the earlier construction. .
