TERMS AND CONDITIONS
The Permittee, Fred Fragola. residing at 1145 Gull Pond Lane. Greenoort, as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to thlllcomplete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no umeasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That iffuture operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause umeasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days ofissuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Hall:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 20,2006 regarding the above matter:
WHEREAS, Land Use Ecological Services, Inc. on behalf of FRED FRAGOLA applied
to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated May 11, 2006, and,
WHEREAS, said application was referred to the South old Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 20, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town, and,
WHEREAS, the project has been found consistent with the LWRP,
NOW THEREFORE BE IT
RESOLVED, that the Board of Trustees approve the application of FRED FRAGOLA to
remove the existing dock and bulkhead and remove the debris to an approved offsite location;
install a 25'X 50' boat slip at the southwest corner of the parcel connecting to Fordham Canal,
dredge (-6') below MLW, 1000 +/- cy. of material and bring to an approved offsite location.
Install a 5'X 20' cutout off the boat slip in the northwest corner of the boat slip to accommodate
a 5'X 20' float with a ramp to provide access for a vessel moored within the boat slip. Restore
the natural shoreline vegetation to 1,092+/- sf. of area adjacent to the boat slip and create a
vegetated 50' buffer area of non-disturbance and to include a 4' wide pervious gravel path to
access the boat basin and shoreline area, and all as depicted on the plans prepared by S.L.
Maresca Associates last revised September 25, 2006.
Permit to construct and complete project will expire two years from the date the permit
Is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

Dear Board of Trustees:
During the hearing on the Fragola bulkhead and dock (SCTM #3548), it seems as if there
was some confusion in the use of terms. Mr. Fragola did not want to "shorten" his dock,
as suggested. I think you were suggesting pulling the dock close to the bulkhead, not
making the dock itself smaller in size.
It seems to me that simply pulling the dock close to the bulkhead would be a wonderful
solution. Removing the present bulkhead and cutting a slip into the land and cutting
down existing trees and shrubs would be most disruptive to wild life and the
environment.
Why would you do this and then plant grasses to preserve the land that was just stripped
of vegetation? A few years ago, the trees on this site were sacred and couldn't be
touched; now they're disposable. There's a beautiful beech tree and at least six other
trees that would be destroyed if the bulkhead is cut or taken down.
People cannot build within 75' of the water, but a slip can be cut into the land just 30'
from my house.
Excuse me, but I'm confused - trees - no trees, houses 75' from the water - houses 30'
from the water???
Why not just dredge, the man made canal, a bit and move the dock closer to the bulkhead
to be in line with existing docks?

1445 Gull Pond Lane Greenport:
Items for the Board of Trustees to review that affect the adjacent property at 1225 Gull Pond Lane
Greenport:
1) The proposed boat slip plan does not show the adjacent property. The boat slip will be
only about 30ft from the adjacent house (see enclosed composite drawing).
2) The current bulkhead is to be removed and relocated with a separate return installed.
When the bulkhead to be removed was constructed, it was tied-in to the adjacent
bulkhead. During construction a piling from the adjacent return, on the shore (north)
side was moved to the water (east) side of the adjacent bulkhead.
If the current tie-in is removed, a piling should be installed in the original location to
maintain the integrity of the adjacent bulkhead.
3) The hydrographic profile of the area adjacent to the proposed construction is not
current. It was done prior to the construction of the bulkhead.
The water depth in the immediate area of the current bulkhead is less than indicated on
the plan. The pilings and sheathing were jetted into the bottom. As a result, sediment
was deposited in the adjacent area and on the adjacent property. This caused the north
end of the adjacent dock to sustain damage from groundings during low tides.
If the same method of construction is to be used, the sediment displaced by the
installation of the proposed piles and sheathing will cause additional shoaling on the
adjacent property.
4) The construction extending into the canal will cause a navigation hazard to a northern
approach to the adjacent dock.
It will also impede the normal tidal current, which is likely to cause additional damage
to the adjacent dock by additional accumulation of sediment by boat traffic and winter
ice build up.
5) The aquatic grass to be planted is very close to the north end of the adjacent dock,
decreasing the water depth.

CONSERVATION ADVISORY COUNCIL
TOWN OF SOUTHOLD
At the meeting of the South old Town Conservation Advisory Council held Wed., June
14,2006, the following recommendation was made:
Moved by Jack McGreevy, seconded by James Eckert, it was
RESOLVED to recommend to the Southold Town Board ofTrustees DISAPPROVAL of
the Wetland Permit application of FRED FRAGOLA to remove the existing dock and
wood bulkhead and remove the debris to an approved offsite location; install a 25'X 50'
boat slip at the southwest corner of the parcel connecting to Fordham Canal, dredge (-
6') below MLW, 1000 +/- cy. of material and bring to an approved offsite location. Install
a 5'X 20' cutout off the boat slip in the northwest corner of the boat slip to accommodate
a 5'X 20' float with a ramp to provide access for a vessel moored within the boat slip.
Restore the natural shoreline vegetation to 1,092+/- sf. of area adjacent to the boat slip
and create a vegetated 50' buffer area of non-disturbance and to include a 4' wide
pervious gravel path to access the boat basin and shoreline area.
Located: 1145 Gull Pond Lane, Greenport. SCTM#35-4-8
The CAC recommends Disapproval of the application because the removal of the
bulkhead would cause substantial harm to the canal. The CAC recommends leaving the
bulkhead in place, or slightly adjusting, and shortening the length of the dock.

Attached are the approved restoration plans for the above Order on Consent.
Project description:
1. Remove existing timber dock
2. Remove existing 104 If of timber bulkhead
3. Excavate upland area to -6 below mlw within boat slip as per approved plan with resultant
excavated material taken to an approved upland site.
4. Install 159.5' of timber bulkhead to create boat slip, 3' x 10' ramp, 5' x 20' float.
5. Dredge 17' x 25' area to 6' below mlw from mouth of slip to existing -6' mlw. Resultant
dredge material to be taken to an approved upland site and or used as backfill for new
bulkhead.
6. Plant buffer area and intertidal marsh as per approved plan.

Special conditions for the approved project are:
1. Any debris or excess material from construction of this project shall be completely removed
from the adjacent area and removed to an approved upland area for disposal. No debris is
permitted in tidal wetlands or protected buffer areas.
2. There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a
result of the permitted activities.
3. All areas of soil disturbance resulting from the approved project shall be stabilized with
appropriate vegetation (grasses, etc.) or as per the specifications of the approved plans
immediately following project completion or prior to permit expiration, whichever comes first. If
the project site remains inactive for more than 48 hours or planting is impractical due to the
season, then the area shall be stabilized with straw or hay mulch or jute matting until weather
conditions favor germination.
4. The storage of construction equipment and materials shall be confined within the project work
area andlor upland areas greater than 50 linear feet from the tidal wetland boundary.
5. All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48
hours shall be contained by a continuous line of staked haybales 1 silt curtains (or other
NYSDEC approved devices) placed on the seaward side between the fill and the wetland or
protected buffer area. Tarps are authorized to supplement these approved methods.
6. If seeding is impracticable due to the time of year, a temporary mulch shall be applied and
final seeding performed at the earliest opportunity when weather favors germination and growth,
but not more than six months after project completion.
7. All erosion control devices shall be maintained in good and functional condition until the
project has been completed and the area has been stabilized.
8. All fill shall consist of "clean" sand, gravel or soil (not asphalt, slag, flyash, broken concrete or

submitted to this department as well as the records available to me, it is my recommendation that
the proposed action is generally CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the L WRP.
Pursuant to Chapter 95, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

Project Description:
As mandated by an article 25 violation settlement and consent order (RI-
20040319-67) from the NYSDEC the applicant is required to complete the following
restoration and mitigation measures:
The existing dock and wood bulkhead at the site are proposed to be removed and
debris brought to an approved off site location. A 25' wide by 50' long boat slip is
proposed at the southeast comer of the parcel connecting to Fordham Channel. The boat
slip is proposed to be dredged (-6') below ML W, 1000 +/- cubic yards of material is
proposed to be removed and brought to an approved off site location. A 5' by 20' cutout
off the boat slip is proposed in the northwest comer of the boat slip to accommodate a
5'x20' float with a ramp to provide access for a vessel moored within the boat slip.
The applicant is also required to restore natural shoreline vegetation tol,092+/-
s.f. of area adjacent to the boat slip and create a vegetated 50' buffer area of non-
disturbance per the restoration planting specifications below. A 4' wide pervious gravel
path is proposed to access the boat basin and shoreline area.
Restoration Planting Specifications
The area between the apparent low water and apparent high water, approximately
780 s.t:, is to be planted with Soartina altemiflora in 2" peat pots on 12" centers.
The area between the apparent high water and the 2' elevation contour (toe of
slope), approximately 312 s.f., is proposed to be planted with Soartina oatens in 2" peat
pots on 12" centers.
The 50' buffer area, approximately 4,740+/- s.f., is proposed to be planted with
shrubs and seeded with grass as listed below:

Project Description:
As mandated by an article 25 violation settlement and consent order (R1-
20040319-67) from the NYSDEC the applicant is required to complete the following
restoration and mitigation measures:
The existing dock and wood bulkhead at the site are proposed to be removed and
debris brought to an approved off site location. A 25' wide by 50' long boat slip is
proposed at the southeast comer of the parcel connecting to Fordham Channel. The boat
slip is proposed to be dredged (-6') below ML W, 1000 +/- cubic yards of material is
proposed to be removed and brought to an approved off site location. A 5' by 20' cutout
off the boat slip is proposed in the northwest comer of the boat slip to accommodate a
5'x20' float with.a ramp to provide access for a vessel moored within the boat slip.
The applicant is also required to restore natural shoreline vegetation to 1 ,092+/-
s.f. of area adjacent to the boat slip and create a vegetated 50' buffer area of non-
disturbance per the restoration planting specifications below. A 4' wide pervious gravel
path is proposed to access the boat basin and shoreline area.
Restoration Planting Specifications
The area between the apparent low water and apparent high water, approximately
780 s.t:, is to be planted with Soartina altemiflora in 2" peat pots on 12" centers.
The area between the apparent high water and the 2' elevation contour (toe of
slope), approximately 312 s.f., is proposed to be planted with Soartina oatens in 2" peat
pots on 12" centers.
The 50' buffer area, approximately 4,740+/- s.f., is proposed to be planted with
shrubs and seeded with grass as listed below:

A. INSTRUCTIONS
1. All applicants for permits. including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of SouthoId agency in

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town, and,
WHEREAS, the project has been found consistent with the LWRP,
NOW THEREFORE BE IT
RESOLVED, that the Board of Trustees approve the application of FRED FRAGOLA to
remove the existing dock and bulkhead and remove the debris to an approved offsite location;
install a 25'X 50' boat slip at the southwest corner of the parcel connecting to Fordham Canal,
dredge (-6') below MLW, 1000 +/- c:y. of material and bring to an approved offsite location.
Install a 5'X 20' cutout off the boat slip in the northwest corner of the boat slip to accommodate
a 5'X 20' float with a ramp to provide access for a vessel moored within the boat slip. Restore
the natural shoreline vegetation to 1,092+/- sf. of area adjacent to the boat slip and create a
vegetated 50' buffer area of non-disturbance and to include a 4' wide pervious gravel path to
access the boat,basin and shoreline area, and all as depicted on the plans prepared by S.L.
Maresca Associiltes last revised September 25, 2006.
Permit to construct and complete project will expire two years from the date the permit
Is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
I. All applicants for permits' including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. · Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Watemont Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
