REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that substantially all of the lots in this area owned by petitioner were sold prior to enactment of the Ordinance. For the most part these parcels p~ovide fo~ 100 feet or more frontage on the road, and 90 feet or more on the canal. At present petitbner (Continue on other side) REASON FOR APPEAL Continued 97. 39 has five lots left, ~ of which have road frontage of ~ ~ee~ only. f,STRICT APPLICATION OF THE ORDINANCE Av,~jild pr~c~c~UNDUE HARDSHIP because petitioner is una'ole to sell the j ~l~t~ frontage lot~ he would be deprived of th~ parcels in an area where theaverag,~ f~ontage of the lots~arles between 90 and ll0 feet. Previously this board construed"frontage" as water frontage as well as road frontage, and p. et. itioner/~elied om such construction. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property o'nd in this use district because All other percel~ in this pa~tlcul~r tract have been sold., ~nd are in the prcce~s of development, except these five lots, on ~ of which p~titioner desires a variance. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because as aforesaid, the lots iD. th~8 t~ac~ are in the process of development; many of these parcels have under 100 feet frontage on the road, but in each instance ~hey have at least 100 feet frcntage on either roaA or canal.
