THIS INDENTURE made the,11th day of May, nineteen hun-
dred and sixty-eight between J. AND J. W. ELSWORTH COMPANY, a New
Jersey corporation, whose address is Shipyard Lane, in the Town
of East Marion, County of Suffolk and State of New York, party
of the first part, and THE F. MANSFIELD 6 SONS COMPANY, a Con-
necticut corporation, whose address is Quinnipiac Avenue, in
the Town of New Haven, County of New Haven and State of Connecti-
cut, pasty of the second part,
W I T N E S S E T H
That the party of the first part, in consideration of
One Dollar ($1.00) and other valuable considerations, lawful
money of the United States, to it paid by the party of the second
part, does hereby grant and release unto the party of the second
part, its successors and assigns of the party of the second part,
forever,
ALL that certain plot, piece or parcel of land, with
the buildings and improvements thereon erected, situate, lying
and being at East Marion, Town of Southold, County of Suffolk
and State of New York, bounded and described as follows:
PARCEL ONE
BEGINNING at the intersection of the easterly side of
Shipyard Lane with the ordinary high water mark of Gardiners Bay,
from said point of beginning running along said easterly line of
Shipyard Lane North 23 degrees 30 minutes 50 seconds West, 564.28
feet to a point; thence North 80 degrees 15 minutes 00 seconds
East, 382.86 feet to a point; thence North 64 degrees 51 minutes
10 seconds East, 129.53 feet to a point; thence South 24 degrees
04 minutes 30 seconds West, 560 feet more or less to the ordinary
high water mark of Gardiners Bay; thence northwesterly across a
dredged channel and along said high water mark of Gardiners Bay
510 feet more or less to the easterly side of Shipyard Lane, the
point or place of beginning.
PARCEL TWO
BEGINNING at a point on the easterly line of Shipyard
Lane 970 feet more or less from the ordinary high water mark of
Gardiners Bay and at a monument situated at the southwest corner

of land of Cherepowicz running thence along said land of
Cherepowicz North 68 degrees 09 minutes 00 seconds East, 860
feet to a monument and Lot 10 as shown on "Map of Marion Manor"
filed in the Suffolk County Clerk's Office as Map No. 2038;
thence along said Lot 10 and along Lots 9, 8, 7 and 6 South 25
degrees 08 minutes 50 seconds East, 457.73 feet; thence South
64 degrees 51 minutes 10 seconds West, 291.49 feet; thence North
25 degrees 08 minutes 50 seconds West, 50 feet to a point; thence
South 64 degrees 51 minutes 10 seconds West, 202.77 feet to a
point; thence South 80 degrees 15 minutes 00 seconds West, 388.35
feet to the easterly line of Shipyard Lane; thence North 23 degrees
30 minutes 50 seconds West, 354.24 feet to the point or place of
beginning.
SUBJECT to any and all zoning ordinances or amendments
thereto, heretofore adopted by any Town, County or Municipality
having jurisdiction thereover.
SUBJECT to a perpetual easement set forth in a deed
from Northern Oyster Company, Inc. to J. and J. W. Elsworth
Company, dated October 10, 1967 and recorded in the office of
the Clerk of Suffolk County at Liber 6241 at page 365, which is
as follows:
IN CONSIDERATION of this conveyance, the Grantee
hereby grants to the Grantor a perpetual easement into,
out of and through a dredged channel running from Gardiners
Bay into a certain dredged basin as shown on a survey pre-
pared for the grantor by R. Van Tuyl dated April 20, 1966
and as amended under date of June 23, 1967, and said
Grantee at its own cost and expense shall bear the cost of
dredging when necessary said channel to maintain a depth
of not less than eight feet at mean low water.
AND the Grantee further grants to the Grantor a
perpetual easement into, out of and over and through a
certain dredged basin which is connected by the foregoing
dredged channel with Gardiners Bay which dredged basin is
shown on the foregoing survey of Van Tuyl subject to the
maintenance of bulkheads and docks presently existing in
said dredged basin.
SUBJECT to a first mortgage now held by the Eastern
Federal Savings and Loan Association of Sayville dated October
15th, 1959 and recorded in the office of the Clerk of the County
of Suffolk, in Liber 3316 of Mortgages, page 423.
SUBJECT to permanent restraining order granted on
July 29, 1967 and recorded in the office of the Clerk of the
County of Suffolk in Liber 344 at page 280, as follows:
ORDERED, ADJUDGED AND DECREED that the de-
fendants, and each of than, their officers, agents,
employees, successors and assigns, be and they era
permanently restrained from the manufacture of fish
meal and fish oil in the manner and by the practices
as practiced by the defendants in the years 1963,
1964, and 1965, as described in the said Findings,
