GETCHES, residing at East Marion, Town of Southold, Suffolk County, New York, J\ ✓ la w 0 o u � la party of the first part,and JAMES S. GETCHES and MARJORIE E. GETCHES, his wife, both residing at East Marion, Town of Southold, Suffolk County, New York, party of the second part, WITNESSETH,that the party of the first part,in consideration of ------------------------------One($1.00)------------------------- delta., lawful money of the United States,and other good and valuable consideration paid by the lmny of the second part,does hereby grant and release unto the party of the second part,the heirs or sr,rsx or,and assigns of the party of the second part forever, ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate, lying and being inthr at East Marion, Town of Southold, County of Suffolk, State of New York, described as follows: BEGINNING at a point on the westerly side of Old Orchard Lane where it is intersected by the southerly line of property conveyed by Gardners Bay Company, Inc. to John Bauer, Jr. by deed dated September 9, 1948, and running thence westerly along said land conveyed to John Bauer, Jr, two hundred eighty-two (282) feet, more or less, to land conveyed by Gardners Bay Company, Inc. to Wayland C. Brown; thence southerly along said land conveyed to Wayland C. Brown one hundred(100)feet; thence easterly along land now or formerly of Gardners Bay Company, Inc. and parallel with the southerly line of land conveyed to John Bauer, Jr. two hundred eighty-two (282)feet, more or less, to the westerlyside of Old Orchard Lane; thence northerly along the westerly side of Old Orchard Lane one hundred(100) feet, more or less, to the point of beginning. TOGETHER with all the right, title and interest of the party of the first part of, in and to that part of Old Orchard Lane lying immediately in front of said premises to the center line thereof. The parties of the second part, for themselves, their distributees,executors, administrators and assigns, do hereby covenant that the above described premises shall be used for no purposes other than private residential purposes; that no buildings or structures of any kind shall be erected thereon other than a dwelling house designed for the use of not more than one family, together with the usual private garage appurtenant thereto; garage, unless a part of the dwelling, shall be erected at the rear of dwelling; that any dwelling erected shall not be nearer to the line of the street or lane than forty(40)feet (steps, cornices, and similar pro- jections excepted); that no top soil shall be removed from the premises (excepting where a cellar is :dug). BEING AND INTENDED TO BE the same premises conveyed to James S. Getches by Gardners Bay Company, Inc. by deed dated April 1st, 1953 and re- corded in the Suffolk County Clerk's Office on April 23rd, 1953 in Liber 3504 of deeds at page 588.
