Parcel 2. ALL those two lots of land situate at East Marion, in the Town of Southold, County of Suffolk, State of New York known and designated as and by the lots numbers one hundred sixty-four (164) and one hundred sixty-six (166) on a certain map entitled "Map of Section Two Gardiner's Bay Estates situate at East Marion, Long Island" which map was filed in Suffolk County Clerk's office on September 23rd, 1927 under the number 275. Parcel 3. ALL that plot of land, situate at East Marion, Town of Southold, County of Suffolk, State of New York, known and designated as and by the lots numbers one hundred sixty-one (161), one hundred sixty-two (162) and one hundred sixty-three (163) and also a strip of land lying immediately adjoining lot one hundred sixty-one (161) and bounded on the southwest side by lot one hundred and sixty-one (161); on the northwest side by the southerly line of Beach Court when extended; on the northeast side by the Channel and on the southeast side by Gardiner's Bay as shown on a certain Er,EE5043 a4„E map entitled, "Map of Section Two Gardiner's Bay Estates, situate at East Marion, Long Island" which map was filed in Suffolk County Clerk's Office on September 23rd, 1927 under the number 275, said lots and strip of land taken together being more particularly bounded and described as follows: BEGINNING at a point on the southeasterly side of Beach Court, said point being the division line between lots numbered one hundred sixty-four (164) and one hundred sixty-three (163) on said map; thence running north forty-four degrees two minutes thirty seconds east (N.440 02' 30" E.) along the southeasterly side of Beach Court one hundred twenty-eight feet and sixty-five one-hundredths of a foot (128.65) to the present ordinary highwater mark of the channel leading from Gardiners Bay to Spring Pond; thence running in a general easterly and southeasterly direc- tion along the said present ordinary highwater mark of said channel as it winds and turns on a course fixed by a tie line thereof south sixty-seven degrees fifty-seven minutes thirty seconds east (S.670 57' 30" E.) a dis- tance of seventy-four (74') feet to the timber bulkhead on the shore of Gardiners Bay; thence running south thirty-three degrees fifty-four min- utes forty seconds west (5.330 54' 40" W.) along said timber bulkhead on the shore of Gardiners Bay a distance of one hundred sixty-five feet and seventy-nine one-hundredths of a foot (165.79) to a point in the division line between lots one hundred sixty-three (163) and one hundred sixty-four (164) on said map; thence north forty-one degrees fifty-seven minutes thirty seconds west (N 410 57' 30" W.) along said division line ninety-eight feet (98.0') to the southeasterly side of Beach Court at the point or place of beginning. TOGETHER with all rights of the grantors in the streets shown on said map and in the water in front of the above described premises and subject to the rights of others in said streets and in the lands under said water. TOGETHER ALSO with the beach rights of the parties of the first part and in the right of way over Old Orchard Lane and over the beaches shown on said map, or adjoining the lands shown on said map. The premises above described are conveyed subject to the burden of beach rents in the amount of Five ($5.00) dollars per year set forth in Liber 1435 of Deeds, page 169, which rents, by the acceptance of this conveyance, the parties of the second part for themselves, their heirs, legal representatives and assigns, hereby covenant and agree to pay. SUBJECT ALSO to the covenants and restrictions of record. SUBJECT also to Zoning Restrictions and Ordinances adopted by any municipal, town, village or other governmental authority, if any.
