TEINY, residing at (no number) Main Road, Orient, New York D _ party of the second part, WITNESSETH,that thertof the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, uitkibe dn9dixoma lfsituate, lying and being iKAK at East Marion, Town of Southold, County of Suffolk thy; and State of New York, bounded and described as follows : BEGINNING at a large rock at the northeast corner of the premises hereby conveyed said point being where the easterly line of the Mpremises hereby conveyed intersects the southerly line of land of Tisdale ; running thence in a general southerly direction along land of Tisdale a distance of approximately 850 feet; running thence in a general westerly direction a distance of approximately 290 feet along land about to be conveyed to Irving C. Latham to land formerly of Thomas E. Rackett; running thence in a general northerly direction along land formerly of Thomas F. Rackett approximately 830 feet to land of Tisdale; running tbence in a general easterly direction .� along land of Tisdale approximately 280 feet to the point or place of beginning. BLOCK TOGETHER with the right of way feet in width along the westerly boundary line of land adjoining the above described premises on the south and which is being conveyed by Spencer B. Terry and others to J Irving C. Latham deed bearing even date. Said right of way running from the southerly line of land hereby conveyed to the land of. Averill LOT Ketcham and together with whatever right of way the parties have running from the southwest corner or part of land about to be conveyed �3 to Irving C. Latham over land formerly of Thomas E. Rackett, land formerly of Daniel E. Tuthill, land now or formerly of Edward S. Edwards and over land formerly of Adelaide Tuthill to the Main Highway. Said premises hereby conveyed consist of approximately 5.7 acres. BEING AND INTENDED TO BE THE SAME PREMISES conveyed to the party of the first part under the Last Will and Testament of Spencer B. Terry, p� Sr. , deceased, dated August 31, 1946 and filed with the Surrogate' s Court of the County of Suffolk under File No. 999 P 1966. TOGETHER with all right, title and interest, if any, of the party of the first part, in and to any streets and roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
