BEING AND INTENDED TO BE part of the same premises conveyed to
Katherine Miller by deed dated May 6, 1938, and recorded
in Eiber 1980 at page 560 in the Suffolk County Clerk's Office
on May 11, 1938. ,
SUBJECT to the following covenants, restrictions and agreements which 1
shall run with the lands
1. The entire parcel shall be forever devoted to the following
two purposes:
a. To protect and enhancetheview of the tidal wetlands,
Orient Harbor, and the hamlet of Orient for the benefit and enjoyment
of the local residents, and
b. To preserve and protect the tidal wetlands and adjacent
areas as a nature preserve and wildlife habitat in keeping with the
purposes of the Tidal Wetlands Act of the State of New York.
2. The upland portion of this parcel shall be maintained by
mowing, trimming, grubbing and other appropriate means such that
a. The view of the Creek across this upland portion, as
viewed from the Main Road, is not significantly obstructed by
vegetation of any kind, whether natural growth or horticultural
planting.
b. The view of the Creek across this upland portion, as
viewed from any residence on the north side of the Main Road, is
completely unobstructed by vegetation of any kind. Trees with the
potential of obstructing this view at any time in the future shall be
removed before they grow to a height of six (6) feet.
c. The growth of poison ivy and other noxious pests is
actively controlled.
3. The following activities,which are not an exclusive
enumeration,�shall be permitted when they conform to or assist in the
achievement of the purposes as set forth herien:
a. Filling and grading of topsoil and fill as required to
improve the ease or quality of maintenance of the upland portion.
b. Maintenance dredging, ditching fw mosquito control, and
ulkheading to prevent erosion of the upland or silting of the
wetlands.
C. Erection and maintenance of osprey nesting sites, bird
ouses, feeding stations, and other minor structures to enhance the
abitability of the area as a wildlife preserve.
d. Erection and maintenance of fencing and other minor
tructures including signs as required to protect wildlife or control
ublic access provided that such structures do not significantly
betruct the view as defined herein.
e. Construction and maintenance of storm water drainage
acilities designated to minimize erosion by providing an underground
onduit for such storm water into the wetlands, including the granting
f a right-of-way for such conduit to the State of New York.
4. The following activities shall not be permitted on this
larcel at any times
a. Erection of any buildings.
b. Construction, maintenance or use of any lot or area for
ublic parking.
c. Leasing or use of the upland for farming or other
ommercial operations.
d. Construction of storm water drainage facilities designed
oleach the storm water into the ground, whether by means of any open
ump or by means of an underground leaching field, including the
ranting of a right-of-way or the sale or 1 se of any portion of this
arcel for such use to the State of New Y Via.
5. If the Orient-East Marion Palr 'ptorc'hits successors or
ssigns shall violate or attempt to vhe covenants and
estrictions enumerated herein, it shor any person
esiding within the confines of tfie Penforce said
venants and restrictions and to proceee person or persons
iolating or attempting to violate said restriction by
mmencing an action or proceeding, at law or in equity, to prevent the
iolation or to recover damages therefor;.-�,.�,(,
6) Any of the covenants, restrictions or agreements herein may be
hanged by a further written agreement in recordable form as signed by
he grantor and the Orient, East Marion Park District, - its successors
r assigns. ° r
• _ 7) Invalidation of any one of these covenants or restrictions, in
hole or ;in -part by ju"ment or court-order, .or otherwise, shall `iri sso
iso affect any of the other provisions which shall remain in full
orce and effect.
