PARCEL II is subject to the rights of others to maintain the monument and flagpole presently on the premises. SUBJECT TO a purchase money mortgage in the amount of Ninety-Five Thousand Six Hundred Twenty-Five ($95,625.00) Dollars, which mortgage was executed, and delivered by the party of the second part to the party of the first part as security for a portion of the purchase price and which mortgage is intended to be recorded simultaneously herewith. PARCEL I hereinabove described is conveyed subject to the right of the owners of the premises across the street (Bay Avenue, Village Lane or Main Street) to the West known as Revolutionary, Sunset and Edgewater, to take sufficient quantities of water from the exist- ing well and/or wells now on said Parcel I and to share in the cost of repairing, maintaining and replacing the well and/or. wells and the piping that supplies the premises on the West. The cost of maintain- ing and repairing the said water supply and piping as aforesaid, shall be borne in the following proportions: Twelve-seventeenths (12/17%) per centum thereof by the owner of Parcels known as Revolutionary, Sunset and Edgewater, and Five-seventeenths (5/17%) per centum thereof by the owner of Parcel I above-described (Bay House) and Parcel II above-described (Bayside). The aforesaid premises to the West pre- sentl take water from the water supply and piping on Parcel I (Bay House and this declaration continues the present arrangement. The right continued and granted herein shall be twelve (12) feet in width and extend from the water source presently located on Parcel I above- described and connedadby underground piping in a general southwest, south and .westerly direction across Parcel I hereinabove described through Village Lane or Main Street to the premises on the West across . the street known as Revolutionary, Sunset and Edgewater and as pre- sently laid out and delineated on a Map of the premises made by Roderick Van Tuyl on September 4, 1980. This conveyance has -been made by the consent of the holder of at lease two-thirds (2/3) of the outstanding shares of the party of the first part entitled to vote thereon obtained at a meeting duly called.
