Gillispie, Jr., Chairman Robert E~ergen Charles Grigonis, Jr. Serse Doyen~ Jr. Fred Hulse, Jr. MINUTES SOUTHOLD TOWN BOARD OF APPEALS February 18, 1972 A special meeting of the Southold Town Board of Appeals was held at 3:30 P.M., Friday, February 18, 1972, at the Town Office, Main Street, Southold, New York. There were present: Messrs: Robert W. Gillispie, Jr., Chairman; Fred Hulse, Jr.; Charles Grigonis, Jr. This special meeting was held for the purpose of reviewing the special exception application of Stuart E. Staples - Appeal No. 1492. The Board of Appeals made a favorable decision on Appeal No. 1492 - Stuart E. Staples, on February 17, 1972, with conditions, subject to the approval of the Town Attorney. It is now necessary, based on the Town Attorney's opinion, to rescind this decision because in the Town Attorney's opinion it is not valid. Sou~hold Town Board of Appeals -2- February 18, 1972 On motion by Mr. Gillispie, seconded by Mr. Grigonis, it was RESOLVED that the Southold .Town Board of Appeals rescind their original decision of February 17, 1972 made on the special exception application of Stuart E Staples in Appeal No. 1492. Vote of the Board: Ayes:- Messrs: Gillispie, H~lse, Grigonis. The following letter to be sent to Mr. Staples: Stuart E. Staples 35 North Montgomery Avenue Bayshore, L.I., New York 11706 Dear Mr. Staples: You will recall that the Board of Appeals action last night on your application NO. 1492 was subject to a favor- able review of such action by the Town Attorney. The Town Attorney's opinion is that the Board of Appeals action in granting a special exception for what was determined to be a "C" light industrial use in a "C-i" General or heavy in- dustrial zone is invalid (even though the bulk or area requirements for the light industrial uses are much smaller khan the bulk requirements pertaining to a heavy industrial or "C-l" General Zone) because the site does not meet the bulk~or area requirements in the present "C-l" General Industrial Zone. Since property in the "C-l" zone such as yours may be used for any lawful purpose, the remedy in your situation would be either to apply for a variance of the "C-l" bulk requirement at least 2 weeks before the next meeting of the Board of Appeals on March 16th, or apply to the Town Board for a change of zone to "C" Light Industrial. Our understanding is that you leased the subject site, which was zoned industrial, last spring with an option to purchase the following October, and that at the time of the lease the site met all area requirements of the Ordinance at that time. In an action today, the Board of Appeals has rescinded the special exception granted on Eebruary 17, 1972. Yours truly, Robert W.
