Jennings, District Director of Internal Revenue for the Brooklyn District of New York, whose office is located at 35 Tillary Street, Brooklyn, New York, party of the first part and Richa--d ' Tubing and James_ E. Gillen, 24 Holmes Avenue, North Babylon, New York, parties of the second part. J5-5 - 04 _ Jrr WITNESSETH WHEREAS, a lien for unpaid federal taxes arose by reason of an assessment made on September, 5 1984, against Beeler S. and Klara M. Shoupe and notice of lien for such taxes was filed as follows: Date Place Taxpayer September 5, 1984 Registers Office, Suffolk Beeler S. and County Riverhead, N.Y. Klara M. Shoupe WHEREAS, purl; _: t to the authority contained in Section 6331 of the Internal Revenue Code of 1954, the District Director of the Internal Revenue for the Brooklyn, New York District seized for non-payment of such taxes the property of Beeler S. and Klara M. Shoupe hereinafter described; and WHEREAS, the said property was sold by public auction on April 30, 1985 at 444 Route 111 , Smithtown, County of Suffolk in the State of New York, in accordance with the provisions of Section 6335 of the Internal Revenue Code of 1954 and regulations promulgated thereunder, public notice having first been given of the time and place of such sale by advertising the same according to law; and WHEREAS, the said property was declared purchased by Richard P. Trebing and James E,. Gillen, 24 Holmes Avenue, North Bablon, New York for the sum of Forty three thousand ($43,000) dollars; it being the highest sum bid for the same; and WHEREAS, the ijibtrict Director: of internal Revenue for the Brooklyn, New York District by Jerold Gubin a Revenue Officer duly authorized to do so, did, pursuant to Section 6338(a) of the Internal Revenue Code of 1954 on May 30, 1985 issue a Certificate of Sale Seized Property upon receipt of the aforesaid sum Forty three thousand ($43,000) dollars; and WHEREAS, said Certificate of Sale of Seized Property provided that if the real property described therein should not be redeemed in the manner and within the time prescribed in Section 6337 of the Internal Revenue Code of 1954, the District Director would , upon surrender of said Certificate issue a deed of the real prc;�erty so purchased (being the same property as is by this instrument being conveyed) to said Richard P. Trebirg and James E. Gillen, which deed would operate as a conveyance of all the right, title, and interest of said Beeler S. and Klara M. Shoupe in and to the real property sold; and WHEREAS, the said property has not been redeemed within the 180 day period provided for in Section 6337 of the Internal Revenue Code of 1954; NOW THEREFORE THIS INDENTURE WITNESSETH, that John J. Jennings District Director of Internal Revenue for the Brooklyn, New York, District, the party of the first part to these presents, in conformity with Section 6338(b) of the Internal Revenue Code of 1954, and in consideration of the sum of money so bid as aforesaid duly paid, does hereby remise, release and quitc'. :im to Richard P. Trebing and James E. Gillen the parties of the second part, their heirs and assigns forever, all the right, title and interest which said Beeler S. and Klara M. Shoupe had at the time the said federal tax lien attached thereto, in and to: All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Orient, in the Town of Southold, County of Suffolk, and State of New York, known and designated as Plat No. 163 on a certain map entitled "Map of Orient—By—The Sea, Section three, situate at Orient Point, Town of Southold, Suffolk County, New York owned and developed by Woodhollow Properties Inc. , #3 Glen Lane, Glenwood Landing, New York, Otto W. Can Tuyl and Son, Licensed Land Surveyors Greenport, New York, and filed in the Office of the clerk of the County of Suffolk on October 16, 1974, as Map No. 6160. BEGINNING at a point on the westerly side of Plum Island at the extreme southerly end of an arc connectin¢ the southerly side of Uhl Lane with the Westerly side of Plum Island Lane. RUNNING THENCE South 01 degrees, 02', 20" West along the west side of Plum Island Lane 191 .79 feet at the division line of Lot 163 and Lot 174; RUNNING THENCE along the division line of Lot 163 and Lot 174, North 88 degrees, 57', 40" West 210.00 feet; of RUNNING THENCE along the division line Lot 163 and Lot 164, North 01 degrees, 02', 20" East 176.22 feet to the South side of Uhl Lane; RUNNING THENCE the following three (3) courses: H (a) North 71 degrees, 33' , 50" East along the south side of Uhl Lane 106.68 feet; (b) South 88 degree, 57' , 40" East 89.42 feet; (c) Running along an arch running to the right at a radius of 20 feet a distance of 31 .42 feet to the point or place of BEGINNING. Subject to any restrictions and easements of record. Located at: Plum Island Lane 6 Uhl Lane, Orient, N. Y. 11957 . TO HAVE AND TO HOLD the premises above mentioned and described , and hereby conveyed unto the said parties of the second part, their heirs and assigns forever.
