After investiga%ien amd inspestien the Beard finds that the applicamt requests permissien te erect a fence ever three feet high in the fren% ya~ area ef ~reperty teeated em the merth sl~e ef Bay View Read, ~mtheld, New Yerk. The findings ef the Beard are that t~e Ordinance specifies that a frent yard fence shall Be ne higher than 3 feet, that this is net a unique hardship, amd that te g~ant the request weulA have the affect ef.rewriti~g the 0~inanee. T~e Bear~ sugg~ste~ te the ap~lieant.~that he erect the 4 feet high fence, which he requested in the ap~licatien, im the si~e yar~ area. (The si~e yar~ area is ~etermined by the frent line ef the heuse). The Bear~ finds that strict applicatien ef the Ordinance will net ~reduce ~ractieal ~ifficulties er unnecessary hardship; the hardship create~ is met unique and weuld Be shared ~y all preperties alike in the immediate vicinity ef this preperty and in the same use district; and the variance dees net e~serve the spirit ef the O~dinanee an~ will cha~ge ~he character ef the district. Your ho~se is ever quite a bit to yemr ~ortherly prepe/r~y line. ER. PRE,BY: We have present plans to ~uild in that direction but net to the point where we weald need a variance. We would be 13 feet closer tent. Miller's property. Seutheld Tewn Beard ef Appeals MR. EOWA~ED T~RY, Building Inspector: If the teem size were l~e reduced it weald net meet the Eemsing Cede. TEE CNAIRMAN: Does anyone else wish to speak against this applicatien? (There was no response.) After investigatiem and inspection the Board fimds that the applicant requests permission te build an addition em an existing building with insufficient side yard located en 0akDrive, Reyden ~ho~es~ Seutheld, New Ye~k. The Beard finds that this is an undersized let overall, that this is an eld development and a la~ge num~er ef hemes a~e close te ~roperty lines; with a 14 feet addition there will still ~e a S Feet side yard en the northerly side ef the house; with an 8 feet addition te the carport, there will be a 14 feet side yard em the semtherly side ef the building. The interior layout ef the he, se ~es it impractical te locate the additional bedroom en amy other side ef the house, and if the room size were te be reduced applicant wemi~ net meet the Reusing Cede. The Beaed finds that strict application ef the Ordinance will ~reduee ~aetieal difficulties er unnecessaz~y hardship; the ha~dsht~ created is umique and weald net be sha~ed by all properties alike in the immediate vieimtty ef this property and in the same use district; amd the variance does observe the spirit ef the O~imanee amd will met ehamge the character ef the district. After investigation and inspection the Beard finds that applicant requests ~e~missien to conduct a yard sale on premises east side ef Oaklawn Avenue, Seuthold, New York.~ The Board agrees with the reasoning ef the applicant. After i~vestigatien amd inspection the Board finds that the a~plican~ reqmests lmermission to divide property.and set off lot with existimg /~elllng locate~ on the south ~side ef ~eund View Avemue, ~eutheld, New Ye~k. The Board agrees with the reasoning of the a~plieant that it is an equitable division of property, that the a~licant is proposing a division which is as fair as cam be acoem~lished fe~ the purposes of the Town. The lot on which the~e is a house is approximately in the middle of the property that the applicant owns. The Boa~d finds that striot applicatiem of ~he Ordinance ~r~ll ~rodmco practical difficulties or unnecessary hardship; the hard- ship created is a~ique am~ weald n~t be sha~ed by all properties alike in ~he immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the O~dinanee and will not ohange the character o£ the district.
