residing at 440 Riley Avenue, Mattituck, New York 11952, party of
2 the first part, and THE PEOPLE OF THE STATE OF NEW YORK, parties
of the second part,
WITNESSETH, that the party of the first part, in
consideration of TWO HUNDRED FORTY THOUSAND AND 00/100 DOLLARS
($240,000.00) , lawful money of the United States, paid by the
parties of the second part, does hereby grant and release unto

G easterly side of Narrow River Road with the northerly side of
Orchard Street;
RUNNING THENCE along the easterly side of Narrow River Road,

THENCE south 350 15' 40" east 236.00 feet to the ordinary
high water line of Hallock's Bay;
RUNNING THENCE on a tie line along the ordinary high water
line of Hallock' s Bay south 680 08' 20" west 141. 88 feet;
RUNNING THENCE north 620 07' west 153. 00 feet to the
easterly side of Narrow River Road the point or place of
BEGINNING. CONTAINING 0. 75± acres
BEING the same premises conveyed by Barbara Hughes and
Phyllis E. Hale to Jon C. Kerbs by deed dated August 20,: 19B7 and
recorded September 29, 1987 in Liber 10433 of deeds at Page 291.
BEING identified as Lot 5, Block 2, Section 27, District
1000 on the Suffolk County Tax Map.
ALL as shown on a "Map of property surveyed for Alexander G.
Koke at Orient, Town of Southold, N.Y. " made by Roderick
Van Tuyl, P. C. , Licensed Land Surveyors, dated August 16, 1985
and last revised on March 28, 1988, a copy of said map to be
recorded simultaneously herewith.

TOGETHER with all the right, , title and interest of the
party of the first part in and to any lands lying in the bed of
any right of way, highway, road, street or avenue, or in the bed
+. of any waterway, marsh, pond, lake, bay, drainage or irrigation
ditch, river, creek or stream running through the premises to be
conveyed or lying in front or adjacent thereto; and
TOGETHER with any and all right of ingress or egress over
and across any private drive, land, waterway or road leading to
and from any highway, road, street or avenue, to the real
property herein described.
SUBJECT to easements of record, if any.
TOGETHER with the appurtenances and all the estate, rights
and interest of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD, the above granted premises unto the
said parties of the second part, their successors and assigns
forever.
And the said party of the first part does covenant with said
parties of the second part as follows:
FIRST: That said party of the first part is seized of said
premises in fee simple, and has good right to convey the same;
SECOND: That the parties of the second part shall quietly
enjoy the said premises;
THIRD: That said premises are free from incumbrances;
FOURTH: That said party of the first part will execute or
procure any further necessary assurance of the title to said
premises;
FIFTH: That said party of the first part will forever
warrant the title to said premises.
SIXTH: That, if any improvements, repairs or alterations
have been commenced upon the foregoing premises and have not been
completed at least four months before the making and recording of
this deed the grantor will receive the consideration for this
conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the
cost of the improvements, and that the grantor will apply the
same first to the payment of the cost of the improvements before
using any part of the total of the same for any other purpose.
