WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs

RUNNING THENCE North 460 59' 50" East along the southerly side of Rabbit Way
3.00 feet;
RUNNING THENCE North 510 24' 50" East along the southerly side of Rabbit Way,
35.35 feet to land now or formerly of Frizzi;
RUNNING THENCE South 300 34' 20" East along last mentioned land 126.50 feet to
the average high water line of Gardiners Bay;
RUNNING THENCE Westerly along the average high water line of Gardiners Bay along
the tie line bearing South 430 12' 50" West 43.09 feet to land now or formerly
of Gray;
RUNNING THENCE North 290 05' 00" West along last mentioned land 133.00 feet to
the southerly side of Rabbit Way at the point or place of BEGINNING.
TOGETHER with all right, title and interest of seller under waters of Bay abutting,
also right of way 16 feet wide frau easterly line of Bay Avenue to northeasterly
C corner of premises.
•i BEING AND INTENDED TO BE those same premises conveyed to the party of the first
part by George W. Koch, Jr. and Barbara J. Koch, his wife, by a deed of conveyance
dated December 11, 1986 and recorded in the office of the Clerk of the County of
Suffolk on February 2, 1987 in Liber 10237 of conveyances at Page 570.

HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
