Tessier, his wife, both residing at 106 Ninth Street, Garden City, New York, I party of the second part, Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors and assigns of the party of the second part forever, ALL those certain lots, pieces or parcels p ocat of land, with the buildings and improvements thereon erected,situate,lying and Vbeing in the hamlet of East Marion, Town of Southold, County of Suffolk and State of;New York, known a-rid designated as and by lets numbered 112 and I13 on a certain map entitled, "Map of Section Two, Gardiner's Bay Estates, situate at East Marion, Long Island", which map was filed in the Suffolk county clerk's office September 23, 1927, under map number 275. ( Lot 112--Being and intended to be the same premises conveyed by Carrie E. Watson to Marion M. Holahan, now known as Marion L. Stuart, by deed dated C\) August 31, 1948, recorded in said county clerk's office, liber 287'6 at page "'CJ 4q4,__ September 10, 1948. Lot 113--Being and intended to be the same premises conveyed by Gardners Bay Company, Inc. , to Marion M. Holahan, now known as Marion L. Stuart, by deed dated June 24, 1957, recorded in the said county clerk's office, liber 4322 at page 355, July 2, 1957. SUBJECT to the covenants, restrictions, obligations and conditions in said deeds. TOGETHER with all of the rights conveyed to the party of the first part by said deeds. And the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever,except as aforesaid. And the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the pay- ment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party"shall be construed as if it read "parties"whenever the sense of this indenture so requires.
