ACTION OF THE ZONING BOARD OF APPEALS OF TOWN OF SOUTHOLD

At a meeting of the Zoning Board of Appeals on November 6, 1958
was considered and the action indicated below was taken on your

1. SPECIAL PERMIT. By resolution of the Board it was determined that a special permit ( ) be

2. VARIANCE. By resolution of the Board it was determined that
(a) Strict application of the Ordinance (would) (~mmlJdu,~O produce undue hardship because
it would not be in keeping with the development and would prevent applicant from
erecting sufficient income producing cettages to. jastify her investment.
(b) The hardship created (is) ~ unique and (mimdcJi:~would not) be shared by all properties
alike in the immediate vicinity of this oroperty and in the same use district because ti~'e are
several other summer cottages o~ the same size lots.
(c) The variance (does) (d~:m~t) observe the spirit of the Ordinance and .G,....'~i (would not)
change the character of the district because there are several other cottages on lots of
similar size in the development.
and therefore, it was further determined that the requested variance (x) be granted ( ) be denied
and that the previous decisions of the Building Inspector ( ) be confirmed (x) be reversed

Board unanimously granted application on condition that it shall be considered to be
on Goldin I~ns and shall conform to the setback established by the residence already
constructed on lots 10 end 12. No part of this residence shall be closer than
twenty (20) feet to the North Road.

1.' sTRicT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because
this lot is part of a development on a filed map, which map was filed
in the Suffolk COunty Clerk's Office on November ~2, ~193'2 as Map No.
1106 and is known as ,Subdi. vision of Property owned by Nathan Goldin,
Situate at $outhold, Suffolk Go., N.Y." There are at present summer
cottages on ~ots 10 and 12, which lots a~e 50 by 85, approximately.
On the East side of .~!.ldin Lane in the same development there awe
also several summer cottages on the same size lots.

deveiopment and would prevent applicant from erecting sufficient
