2. VARIANCE. By resolution of the Board it was determined that

it would not be in keeping with the development and would prevent applicant from
erecting sufficient income producing cott~a~es~to Justify her investment.

Board unanimously granted application on condition that the residence to be
constructed on lot no. 9 shall conform so far as front yard r~strictions are
concerned, and shall conform to the setback established by the residence on
lot no. 6 of this map.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce UNDUE HARDSHIP because
this lot is pa~t pfa development on a filed map, which map was
filed in the Suffolk Cpunty Clerk's Office on November 22, 1932
as Map No. ll06 and is known as "Subdivision of Property owned by
Nathan Goldin, situate at Southold, Suffolk Co., N.Y." There are
at present summer cottages on Lots l0 and 12, which lots are 50 by
85, approximately. On the East side of Goldin Lane in the same
development there are also several summer cottages on the same size
lots.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because this appllcation is made
simultaneously with application for other lots in this development
on the west side of Goldtn Lane, since cottages were butl~ on ms~y
lots prior to the enactment of the zoning ordinance. To require
strict complaince on these lots would not be in keeping with the
development and would prevent applicant from erecting sufficient
income p~oducing cottages to justify her investment.
3. The. Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because as noted in one above tb. ez, e are several
cottages on lots of similar size in this development. ~arcels on
Long Island Sound, also a part of this development are 50 foot lots
most of which have one cottage to each lot.
