THIS INDENTURE, made the 1 - - day of July, nineteen,
hundred and seventy, BETWEEN Sherwood Bauer and Geraldine Bauer,
his wife, both residing at 34 Spring Rock, Pine Orchard, Branford,
Connecticut, party of the first part, and William G. Cogger and

WITNESSETH, that the party of the first part, in con- ,

sideration of ten dollars and other valuable consideration paid
by the party of the second part, does hereby grant and release

unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of vacant land,

County of Suffolk and State of New York, and more particulary
described as follows :
BEGINNING at a monument on the easterly line of Navy Street
distant one hundred sixty-four and 73/100 (164.73) feet southerly
along said easterly line from the corner formed by the inter-
section of the easterly side of Navy Street, with the southerly
side of Orchard Street, said point of beginning being the south-
westerly corner of land of Tuthill and the northwesterly corner
of the premises herein described;

from said point of beginning running along said land of
Tuthill, South 87° 50' 20" east, ninety-one and 01/100 (91.01)
feet to a monument;
thence South 7° 33' 30" east, one hundred twenty-six and
25/100 (126.25) feet to a monument;
thence South 89° 47 ' 00" west, one hundred seven and 06/100
-(107:06) feet to a monument on said easterly line of 'Navy Street;;
thence along -said easterly line of Navy Street, ;north 0° IV
00" west, one hundred twenty-nine (129) feet to the ;-point or place
of beginning.
The grantors herein are the same persons as the grantoor' in
deed made by John J. Bondarchuk and Betty Jane Bondarchuk, dated

page 245 .
TOGETHER with all right; title and interest, if any, of
the party of the first part in and toany streets and roads
abutting the above described premises to the center lines thereof ;
TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises ;
TO HAVE AND TO HOLD the premises herein granted unto
the party of the second part, the heirs or successors and assigns
of the party of the second part forever.
AND the party of the first part covenants that the
party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of the first
part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of the
same for any other purpose.
THE WORD "party" shall be construed as if it read
"parties" whenever the sense of this indenture so requires .
