Status: Pending a decision from the Building Department on the amended site plan
requirements.
We spoke to Mrs. Gail Wickham on October 28, 2003 about this application. We were informed
by Mrs.Wickham that you are reviewing this application on whether a site plan is needed. The
Planning Board (PB) held a work session on October 20 & 27 to discuss this application. After
research the PB records show a site plan approved on June 6, 1988 for the Lumber Yard.
Attached you will find a copy of the resolution. We could not locate any current site plan
approval. The site plan approved on 6/6/88 is different from the current proposed site plan
reviewed. We requested the applicant forward to the Planning Board any records on the
current site plan approval. (See the letter attached)
Please refer to building permits that are open on this parcel: BP# 29514z & BP# 28106z. It
appears when BP# 27463z was issued the foot print was enlarged without PB site plan
approval. Attached are copies of the permits. Please refer to the attached memorandum from
your department dated June 20, 2003. For information two letters are attached from Gail
Wickham dated June 23, 2003 and September 5, 2003. At this time the site appears to be in
violation with Town code section 100-141 A and 100-250. The parcel is on the SPLlA list and
requires Landmark Preservation on changes.
Please determine whether an amended site plan is needed?
Please copy the Planning Board on any correspondence to the applicant about this issue.

At this time the new site plan submitted on September 5, 2003 will be placed in an
incomplete amended site plan application file. The file will be on hold until we receive
an amended site plan application, fee and corresponding documents.

Regarding the site plan on this matter, Capt. Frolmhoeffer recalls clearly meeting with
the Planning Board to discuss the rebuilding of the structure in question, and understood
that the Board cleared the matter. Since Bruno does not find any reference in his files to
this meeting, our client is looking through his records to see ifhe has any information
that would confirm his recollection. In the meantime, I will get the map of the property
updated for a site plan review should that be necessary.

I. The amended variance for attic !l$ third floor has been submitted to the ZBA. The hearing date is August
7. The primary basL~ for the request is that rather than straight attie space, they have proposed elevator access
so that their employees, including handicapped employees, may access the space more e/l.'lily for file storage.
They are requited to retain their records for 7 years, and they will be stored there in fil'flproof file storage.
2. On the other property of TowBee, the building permit for the building has been renewed, and inspections
for CO have been scheduled with tile Building Depa.rtn:lcnt. Both Joe Frohnhoefer and Jim Foley remember
going to the Planning Board at the time ~nd obtaining a site plan waiver because the new building was
essentially a c:eplt.cement of a dilapidated building.

We have recently received window questions about the site activity of the above
noted SCTM. In research we located one open expired permit (BP# 27463z), it
appears to be in violation of the Town Code section 100-141. At this time the
Planning Board has no current site plan on file for this project.
Per our conversation today the storage building would require a site plan as well
as the site improvements being done.
Reference any and all building permits on the property noted above which have
not been issued a certificate of occupancy.

During a review of our files it was noted that the above
building permit has expired, and a Certificate of Occupancy has
never been issued.
According to the Code of the Town of Southold, Article
XXVIII 100-281 and 100-284 a building permit is needed for any
construction of additions, accessory structures or new
dwellings, and it is unlawful to occupy or use said structure
until a Certificate of Occupancy has been issued.
Please contact this office as soon as possible so that we
may clear up this matter.
