A. For new building or new use:

2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming nses, or buildings and "pre-existing" land uses:
I. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is

FINDINGS, DELIBERATIONS AND DETERMINATION

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 28,356+- sq. ft. parcel is improved with an
existing dwelling and accessory guest house building, as shown on the 8/21/2003 survey prepared
by CME Associates Engineering and Land Surveying.
BASIS OF APPLICATION: Building Department's March 15, 2004, Notice of Disapproval, citing
Code Section 100-33 and 100-243 in its denial of a building permit application concerning "a deck
addition to an existing nonconforming guest house." The reasons stated are that Section 100-243
does not permit a non-conforming building containing a nonconforming use to be not be enlarged,
reconstructed or structurally altered or moved...unless the use of such building is changed to a
conforming use, and Section 100-33 requires an accessory building to be located in a rear yard,
instead of the existing front yard location.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on July 15, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to obtain a building permit and
certificate of occupancy for the "as-built" deck that was added by a previous owner many years ago
to the existing nonconforming accessory building, located in the front yard. The scale on the 8/21/03
survey indicates setbacks of the deck at 12+- feet from the closest lot line along Montauk Avenue
and 17+- ft. from the side lot line. .
ADDITIONAL INFORMATION: During the July 15, 2004 public hearing, the applicant, for
clarification purposes, was asked to obtained a Memorandum from the Building Department dated
July 14, 2004, to indicate that their office would not issue a pre-existing certificate of occupancy for
the deck, which also is preexisting of the code, because the deck was re-built after 1957. Once the
applicant is able to obtain a building permit for the deck. the Building Department would be in a " .

position to issue a Pre-Existing Certificate of Occupancy for the cottage, and therefore the only
question before the ZBA was whether or not to grant the setback and yard location of the "as builf
deck, rather than the use of the nonconforming cottage.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The "as built" new construction by a previous
owner was a replacement of the former deck, which was in need of repairs and new materials.
Information was submitted to confirm that the former deck had existed prior to zoning in a
nonconforming front yard location. The deck replacement will not change the existing setbacks.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The new construction is a replacement of the
former deck that was in need of repairs.
3. Although the new construction is in-kind replacement of the former deck, the variance granted
herein is substantial because the variance is 100% relief from the code required setbacks and yard
location.
4. The difficulty was self-created when the deck was reconstructed without conforming to the
current Town Code for a building permit and setback requirements.
5. No evidence has been submitted to suggest that a variance in this community of single-family
residences will have an adverse impact on the physical or environmental conditions in the
neighborhood.
6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of the deck reconstruction, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by
Chairwoman Oliva, and duly carried. to
GRANT the variance as applied for, as shown on the 8/21/04 survey prepared by CTM
Associates Engineering and Land Surveying, PLLC, subject to the condition that the deck
remain open to the sky.

This action does not authorize or condone any current or future use, setback or other feature of the
subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action.

Enclosed please find revised drawings for the Nigro Residence on Fisher's Island, which is an
amendment to the building permit # 28642. The drawings indicate more extensive
reinforcement of the existing second floor deck, based on my review of the structure with the
contractor. Also. a new opening and header is indicated at the Dining Room.
