(631) 765-1809 • Fax (631) 765-9064 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF AUGUST 17, 2006 ZB File No. 5918 - STEPHEN MATTEINI (and STENDA REALTY, LLC) Property Location: 1060 Willow Terrace Lane, Orient CTM 26-2-22 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is 16,875 square feet (measured to the bulkhead) with 100 feet along Willow Terrace Lane and 124.01 feet along the bulkhead adjacent to Orient Harbor. The premises is improved with a new dwelling, under construction (Building Permit No. 31554-Z issued 10/25/05. BASIS OF APPLICATION: Zoning Code Section 100-32, based on the Building Inspector's April 12, 2006 Notice of Disapproval concerning a proposed open, roofed -over front entry addition which will be less than the code -required 35 feet from the front yard lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on July 27, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The appficant requests a variance for a front yard setback of 29 feet instead of the required 35 foot setback for a columned entry portico with a platform landing, stairs and a covered roof. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Replacing the as built (84 sq. ft.) covered entry portico with a narrower entry that does not require an area variance would detrimentally alter the aesthetic appeal and proportions of the elevation that fronts on Willow Terrace. 3. The variance granted herein is not substantial. The roof overhang for which the variance is required is 54 square feet, of which 24 square feet extends beyond the permitted five foot encroachment into the required front yard. 4. The alleged difficulty was self-created when the builder constructed a roof portico that exceeded the permitted five foot encroachment into the required front yard setback. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a columned, covered entry portico at the front of the dwelling (under construction), while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Weisman, seconded by Member Dinizio, and duly carried to GRANT the variance as applied for, shown on the site map dated October 6, 2006, revised March 8, 2006, prepared by Joseph A. Ingegno, land surveyor, and architectural diagrams Al - A6, prepared by Mark K. Schwartz Architect PLLC prepared March 20, 2006. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. RIDGE -TO -RAFTER ASSEMBLY: 1-1/4" x 20 gauge strap shall be attached to each pair of rafters in accordance to table 3.4. When a collar tie is used in leu of a ridge strap, the number of 10d common nails required in each end of the collar tie need not exceed the tabulated (number of 8d nails in the strap. 2). RAFTER -TO -WALL ASSEMBLY: Lateral framing and shear wall connections for rafter, ceiling or truss to top plate shall be in accordance to table 3.3. When wall studs above do not fall in line with studs below, the studs shall be attached to a common member in the floor assembly with uplift connectors in accordance with table 3.3. 4). WALL ASSEMBLY TO FOUNDATION: First wall studs shall be connected to the foundation, sill plate, or bottom plate with uplift connectors. Steel straps shall have a minimum embedment of 7 inches in concrete foundation and slab -on -grade, 15 inches in masonry block foundations, or lapped under the plate and nailed in accordance with table 3.31b. When steel straps are lapped under the bottom plate, 3 inch square washes shall be used with the anchor bolts. Anchor bolt spacing is to be spaced and sized in accordance to table 3.2a.
