The property is located on the s/s/o East End Road, at Block Island Sound on
Fishers Island.
SCTM#1000-4-7-1 & 2 Zoning Districts: R-120
Dear Mr Ham:
The Southold Town Planning Board, at a meeting held on Monday, October 16, 2006,
adopted the following resolution:
WHEREAS, this proposal is for a lot line change in the R-120 Zoning District that will
transfer 68,244 s.f. from Lot 1 (1000-4-7-1) to Lot 2 (1000-4-7-2) where, following the
transfer, Lot 1 equals 82,729 s.f. and Lot 2 equals 172,742 s.f.; and
WHEREAS, the resulting lot line change makes Lot 1 non-conforming with respect to
the minimum lot area requirement of 120,000 s.f. in the R-120 Zoning District; and
WHEREAS, although Lot 1 will become non-conforming, the parcel is subject to a
conservation easement and shall be perpetually protected from future development; and
WHEREAS, the Zoning Board of Appeals granted the necessary relief on May 11, 2006
(ZBA File # 5868); and
WHEREAS, on July 10, 2006, the Southold Town Planning Board granted a Negative
Declaration for the project pursuant to SEQRA; and
WHEREAS, on July 10,2006, the Southold Town Planning Board granted conditional
final approval on the surveys prepared by Richard H. Strouse, L.S., dated October 14,
2005; and
WHEREAS, on September 27, 2006, the applicant submitted certified copies of the
recorded deeds pertaining to the lot line change; be it therefore

RESOLVED, that the Southold Town Planning Board hereby grant Final Approval on
the map prepared by Richard H. Strouse, L.S., dated October 14, 2005 and authorize
the Chairperson to endorse the maps.

RESOLVED, that because this proposal results in a decrease in density by one
residential lot, the Southold Town Planning Board hereby waives the public hearing for
this project; and be it further
RESOLVED, the Southold Town Planning Board grant conditional final approval on the
surveys prepared by Richard H. Strouse, L.S., dated October 14, 2005, subject to the
following condition:
The filing of new deeds with the Office of the Suffolk County Clerk pertaining to the
lot line change and, upon filing, submission of a copy to this office.
Enclosed is a copy of the Negative Declaration for your records.
The conditions must be met within six (6) months of the resolution unless an extension
of time is requested by the applicant and granted by the Planning Board. Upon
fulfillment of the conditions, the Planning Board will issue final approval and authorize
the Chairperson to endorse the final surveys.

Dear Anthony:
I have enclosed certified copies of the deeds by which the co-executors of
the Estate of Glenn W. Boocock effected the referenced lot line change bytransferring part
of former tax lot 1 to the Henry L. Ferguson Museum and the balance of tax lot 1 and all
of tax lot 2 to themselves individually as a single merged parcel. The deeds were recorded
on September 22, 2006 in Liber 12470 pages 483 and 484, respectively.
With FIDCO having previously consented to the lot line change, I believe all
conditions to the Board's conditional final approval have now been satisfied. Accordingly,
I would appreciate it if you would have the several prints of the map endorsed by the
Chairman and forward at least one original to ane.

action described below will not have a significant effect on the environment and a Draft
Environmental Impact Statement will not be prepared.

Description of Action, This proposal is for a lot line change that will transfer 68,244
square feet from Lot 1 (1000-4-7-1) to Lot 2 (1000-4-7-2) where, following the transfer,
Lot 1 equals 82,729 square feet and Lot 2 equals 172,742 square feet, in the R-120
Zoning District.
Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed and it was
determined that no significant adverse effects to the environment were likely to occur
should the project be implemented as planned.
The determination was based upon the following:

No substantial adverse change in existing air quality, ground or surface water quality or
quantity, traffic or noise levels, no substantial increase in solid waste production, potential

preservation of 82,729 square feet of land.
No significant removal or destruction of large quantities of vegetation or fauna, no
substantial interference with the movement of any resident or migratory fish or wildlife
species, no significant impacts on a significant habitat area, no substantial adverse impacts
on a threatened or endangered species of animal or plant or the habitat of such a species,
and no other significant adverse impacts to natural resources will occur.
The proposed action is not in a material conflict with a community's current plans or
goals as officially approved or adopted.
The proposed action will not impair the character or quality of important historical,
archaeological, architectural, or aesthetic resources or of existing community or
neighborhood character. No additional development will occur as a result of the lot line
change.
No major change in the use of either the quantity or type of energy will occur.
No creation of a hazard to human health will occur.
The proposed action will not cause a substantial change in the use, or intensity of use,
of land including agricultural, open space or recreational resources, or in its capacity to
support existing uses.
Based upon such, no significant adverse impacts to the environment are expected to
occur should the project be implemented as planned.

SEQRA DETERMINATION, The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type It category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTSiDESCRIPTION: The existing Lot 1 is 150,973+/- square feet, and Lot F is 104,496+1-
square feet,or combined area of 255,471 square feet.
BASIS OF APPLICATION: Section 100-32, based on the Building Inspector's February 26, 1-006 Notice of
Disapproval, amended March 7, 2006, concerning Lot 1 with a proposed nonconforming lot size of less than
120,000 square feet(and conforming area for Lot 2) in the proposed lot line change.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on April 27,2006, at whish time written
and oral evidence were presented. Based upon all testimony, documentation, personal insaeelion of the
properly, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant is requesting the change the conficuration of lots
which will result in a nonconforming area for Lot 1 of 82,729+- square feet, to be deeded to The Henry L.
Ferguson Museum, inc., with the remaining land to be a conforming area of 172.742+!- square feet for
proposed Lot 2. The existing Lot t is 150,973+1-square feet, and Lot 2 Is 104,498+1-square fee,:.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections,the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a

Ladies and Gentlemen:
Thank you for your March 15, 2006 Memorandum, requesting FIDCO's
comments on the applications for Lot Line Modifications filed by Glenn W. Boocock
(1000-4-7-1&2), George and Elisabeth W. Ireland (1000-4-7-3.1) and John R. and Katha
A. Hesse (1000-3-5-2.1). Since the Board's current procedures do not normally call for a
public hearing on lot line changes, we are less likely to hear about a proposed change on
the East End of Fishers Island and are particularly grateful to receive notifications such as
this one.
As you know, in 1926 FIDCO's predecessor, the developer of the East End of
Fishers Island, engaged the renowned landscape architect Frederick Law Olmsted(who
designed New York City's Central Park, among other notable projects) to plan its
development. Olmsted's Plan, creating a residential "Park" with recreational amenities,
was ultimately filed with the Town as a sort of subdivision for the East End. The
Olmsted Plan has had the effect of grandfathering the lots laid out in the Plan (which
average about two acres in size) under the Town's Zoning Code (which now classifies the
East End as an R-120 three-acre residential zone).
Over the years, FIDCO and its predecessors have imposed covenants on all Lots
sold for development in the"Park". These covenants, which were recently extended for a
twenty-year period through 2025, restrict development to one single-family residence
and necessary outbuildings on each Lot, and grant to FIDCO the power to approve all
plans for the construction, alteration, siting and landscaping of all structures. The
covenants were designed, in Olmsted's words,to preserve "the parklike atmosphere" of

the Olmsted Park. FIDCO's mandate, thus, is to monitor these covenants to preserve the
parklike atmosphere envisioned by Olmsted.
In order to carry out this mandate, and in addition to protect the Island's
infrastructure(ferry,roads, water, electricity) from being overrun, the announced policy
of FIDCO for at least the last two decades has been to restrain development on the East
End. It has decided to refrain from selling for development any of the remaining lands
which it holds. Instead, it has contributed lands to the Land Trust managed by the H.L.
Ferguson Museum and has encouraged other landowners to donate lands or conservation
easements to the Land Trust.
While the FIDCO covenants may not give FIDCO legal standing to appear before
the Planning Board in lot line modification proceedings, FIDCO has always taken the
position that the covenants give it the independent right to approve lot line changes that
alter the Olmsted Plan, and to object to any change that is inconsistent with the covenants
or threatens the parklike atmosphere of the Olmsted Park. In the most general terms,
under its policy of restraining development, FIDCO would look with favor on a lot line
change that reduced the number of building sites, and would object to a change that
increased the number of building sites.
Turning to the three proposed lot line modifications,
Boocock Modification
The Boocock change would divide an undeveloped and presently buildable
(conforming) lot into two parts; consolidate one part with the adjacent developed
(nonconforming) lot; and set up the other part for contribution to the Land Trust. The
effect is thus to reduce the number of buildable lots from two (one conforming, one
nonconforming) to one conforming lot and to dedicate some two acres as open spaces.
This change would clearly enhance the parklike atmosphere of the Chocamount Beach
area and further FIDCO's open space policies, and we enthusiastically support it.
Ireland Modification
The proposed change would rationalize the two adjacent buildable lots owned by
the Irelands; convert the nonconforming developed lot into a conforming lot; give it
direct access to the beach instead of an easement over the second lot; and extend it to
include the existing driveway easement over the second lot. It would have no effect on
the number or character of buildable lots, and FIDCO has no objection to it.
Hesse Modification
The Hesse application raises certain difficult issues for FIDCO. We will provide
our comments as soon as we have resolved them.

In response to your request for comments, the Planning Board reviewed the Zoning
Board of Appeals application for the above referenced property and offers the following
comments at this time.
The proposed action involves reconfiguring the lot lines between the subject parcels
resulting in the addition of 62,244 square feet from Lot 1 (1000-4-7-1) to Lot 2 (1000-4-
7-2). The portion so added will merge with Lot 2 as to form a 172,742 square foot
parcel, which is currently improved with a residence. The merger will allow the
accessory structures on Lot I (deck and tennis court) to be located on the same lot as the
principal dwelling. The remaining portion of Lot 1 is already subject to a conservation
easement and will be conveyed to the Henry L. Ferguson Museum, Inc.
The Planning Board has no objections to this proposal as there will be a reduction in
density by one residential lot.

Dear Anthony:
On behalf of the Estate of Glenn Winnett Boocock, I am applying for approval
of a lot line change pursuant to which the division line between two parcels shown on the
Map of Fishers Island Development Corporation will be relocated so as to permit the
completion of a testamentary gift to The Henry L. Ferguson Museum, Inc. The proposed
lot line changes are shown on the enclosed map prepared by CME Associates
Engineering, Land Surveying&Architecture, PLLC and described in the list of enclosures
below.
In connection with this lot line change application, I have enclosed the
following:
1 . Application for Re-Subdivision/Lot Line Modification.
2. Photocopies of deeds recorded in Liber 12011 page 662 and Liber
12011 page 663, respectively.
3. Short Environmental Assessment Form.

Land Surveying & Architecture, PLLC.
I understand that, although the lot line modification will make what is now a
nonconforming lot (tax lot 2) conforming, it will also result in the change of tax lot 1 from
a conforming lot to a nonconforming lot. I have asked the Building Department for an
opinion as to whether a variance will be required in this case and that Department has
issued a Notice of Disapproval, a copy of which is enclosed. Accordingly, I am applying
to the Zoning Board of Appeals simultaneously herewith for the requisite variance.
Please look over the enclosed documents and notify me immediately if you
will require any further information, documentation or payments (other than action by the
Zoning Board of Appeals) before you can commence your review process.

The current division line between the Boocock parcels shown on the Map
of Fishers Island Development Corporation (Tax Lots 1 and 2) will be
relocated in part, resulting in the addition of 62,244 square feet from
Tax Lot 1 to Tax Lot 2. The portion so added will merge with and become
a part of Tax Lot 2 so as to form a 172,742+/- sq. ft. parcel which is
currently improved with a residence. The merger will allow the accessory
structures on Lot 1 (a deck and tennis court) to be located on the same
lot as the principal dwelling. The remaining portion of Tax Lot 1 will
then be conveyed to The Henry L. Ferguson Museum, Inc. to carry out a
specific devise of that property in the last will and testament of the
deceased owner. The portion to be conveyed to the Museum is already
subject to a conservation easement in favor of the Museum.
